HomeMy Public PortalAboutOrdinance 708ORDINANCE NO. 708 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, REPEALING CHAPTERS 15.04, 15.08, 15.12, 15.16, 15.20 AND 15.24 OF THE BEAUMONT MUNICIPAL CODE, AND ADDING NEW CHAPTERS 15.04, 15.08, 15.12, 15.16, 15.17, 15.20 AND 15.24 TO THE BEAUMONT MUNICIPAL CODE FOR THE ADOPTION OF UNIFORM CODES AND STANDARDS, FOR BUILDINGS AND CONSTRUCTION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE OF CALIFORNIA, AS FOLLOWS: SECTION 1: Chapters 15.04, 15.08, 15.12, 15.16, 15.20 and 15.24 are hereby repealed from the Beaumont Municipal Code. Uniform Building Code, as Amended. Violation --Penalty. 15.04.010 Adoption of Uniform Codes. Certain documents, three copies of which are on file in the Office of the City Clerk and the City, being marked and designated as the Uniform Building Code, as amended in Section 15.04.020, Uniform Plumbing Code, Uniform mechanical Code, Uniform Fire Code and Uniform Housing Code, 1991 Editions, and the Uniform Building Code Standards, 1991 Edition, published by the International Conference of Building Officials, are adopted as the Code of the City for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in the City providing for issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such Uniform Building Code, 1991 Edition, and the Uniform Building Code Standards, 1991 Edition, published by the International Conference of Building Officials, on file in the Office of the City are referred to, adopted and made a part of this Chapter as if fully set out in this Chapter. Page 2 15.04.020--15.04.030 15.04.020 Uniform Building Code, as Amended. Chapter 3, Permits and Inspections are amended to read as follows: Section 301(b)(2), "except masonary fences are three (3) feet in height." Section 301(b)(s) "retaining walls not over three (3) feet in height measured from footing to top of wall, unless supporting a surcharge or impounding Class I, II, III -A liquids. 15.04.030 Violation --Penalty. Violation of the provisions or failure to comply with any of the requirements of the Uniform Codes of the City is an infraction. Page 3 Sections: 15.08.010 15.08.020 15.08.030 15.08.010 Chapter 15.08 BUILDING PERMIT FEES Permit Issuance Fees Additional Fee. Changes by Resolution. Permit Issuance Fees. 15.08.010--15.08.030 The following fees, as set by resolution and changed from time to time, shall be collected prior to the issuance of a permit: A. B. Building and Grading Valuation Data Schedules. Permit Fee Schedules amending Plumbing Code. Sheet and Fee Table 3A of the Uniform C. Permit Fee Schedules amending the 1990 Edition of the National Electrical Code. D. Permit Fee Schedules for Mobile Home and Structures Outside of a Mobile Home Park. E. Permit Fee Schedules for Mobile Homes Inside a Mobile Home Park. 15.08.020 Additional Fee. In addition to the permit fees, the following fee is to be collected prior to the issuance of a permit: Strong Motion Instrumentation Program (SMIP), 0.007 percent per thousand dollars of valuation with a minimum of fifty cents each permit. (S.B. 1374 Chapter 1152 ALQUIST). 15.08.030 Changes by Resolution. All fees and charges enumerated within this Chapter may be increased or decreased periodically by resolution of the City Council. Additions --Installation Standards Additions --Inspection and Utility Connections Additions --Authority of Building Inspector to Disconnect Additions--Violation--Penalty 15.12.010 National Electrical Code Adopted. The National Electrical Code, 1990 Edition, as published by the National Fire Protection Association is adopted as the City Electrical Code and was a part of this Chapter by reference, three copies of which are on file for the use and examination by the public in the Office of the City Clerk, with the additions set out in this Chapter. 15.12.020 Additions --Permit Requirements. A. Applications. Applications for electrical permits describing the work to be done shall be made in writing to the building inspector by licensed electrical contractor or authorized representative, by the owner of the property, or the person, firm or corporation installing the work. The application shall be accompanied by such plans, specifications and schedules as may be necessary to determine whether the installations will be in conformity with the requirements of this code. If the installations conform to all requirements and the applicant has complied with the provisions of this code, a permit shall be made without the written approval of the building inspector. B. No Permit Shall be Transferable. A permit issued to one person, firm or corporation shall not authorize any person, firm or corporation, except an employee of the permittee, to do any electrical work. C. Expiration of Permits. Page 5 15.12.030--15.12.050 1. Every permit shall expire and become null and void for any of the following reasons: a. Whenever the electrical work authorized by a permit is not commenced within sixty days from the date of issuance of such permit; b. Whenever the electrical work authorized by a permit has been suspended, abandoned or discontinued for a continuous period of one hundred eighty days; c. Whenever the electrical work done during any continuous period of one hundred twenty days amounts to less than ten percent of the total electrical permit authorized by such permit. 2. Before recommencing, proceeding with, or doing any electrical work authorized by, but not done before expiration of any such permit, a new permit shall be obtained therefor, and the fee for such permit shall be fifty percent of the fee required for a new permit if less than one year. D. Revocations and Suspensions of Permits. The building inspector may suspend or revoke any electrical permit for any of the following reasons: 1. If any reason is found to exist which would have been cause for denial of such permit; 2. Any misrepresentation of false statement in the application upon which a permit was issued; 3. For failure to comply with the provisions of this code pertaining to electricity after due notice of corrections and the time limit therefor has expired or failure to comply with other codes of this jurisdiction that may be related to this code. 15.12.030 Additions --Number of Permits per Job. Where one person, firm or corporation has an active rough wiring permit, and another person, firm or corporation intends to do the electrical equipment or fixture work on the same job, a final rough writing inspection shall be made and approved before a permit for equipment or fixtures will be granted to a second person, firm or corporation. 15.12.040 Additions --Electrical Fees. The City Council of the City shall from time to time prescribe a reasonable fee schedule for the issuance of electrical permits by resolution. Page 6 15.12.050--15.12.060 15.12.050 Additions --Installation Standards. A. Standards. 1. Authority. All electrical installations in the City shall be in accordance with this Chapter, the National Electrical Code, 1990 Edition, and all applicable statutes of the state. 2. Conductors and Equipment. The conductors and equipment required or permitted by this Chapter shall be acceptable only when approved. The building inspector may classify as "approved" electrical materials, devices, fittings and appliances used in electrical installations that have been listed or labeled after examination for safety as described in the National Electrical Code, Article 90-6. 3. Used materials. Previously used electrical materials shall not be reused without the written approval obtained in advance from the building inspector. B. mobile Homes Not in mobile Home Parks. Electrical service supplying mobile homes used for residential or commercial purposes in other than approved mobile home parks shall have the following minimum service requirements: Service conductors and equipment shall be rated at not less than one hundred amperes; branch circuit provision for six overcurrent devices. 15.12.060 Additions --Inspection and Utility Connections. A. When any part of a wiring installation is to be hidden from view by the permanent placement of part of the building, the person, firm and corporation installing the wiring shall notify the building inspector and such parts of the wiring installation shall not be concealed until they have been inspected and approved by the building inspector or his representative. The building inspector shall have the power to remove, or require the removal, of any obstruction that prevents proper inspection of any electrical installation or electrical equipment. B. Upon completion of any electrical installation which has been authorized by issuance of a permit, it shall be the duty of the person, firm or corporation doing the work to notify the building inspector who shall inspect the work to determine if it is in conformity with the provisions of this code. He shall issue to the person, firm or corporation performing the work a certificate of approval and shall send notice of such authorization to the electrical utility furnishing the electrical service. Page 7 15.12.070--15.12.080 If upon inspection, the installation is found to be not full in conformity with the provisions of this code, the building inspector shall at once notify the person, firm or corporation performing the work stating the defects which have been found to exist. All defects shall be corrected within ten days after inspection and notification, or within other reasonable time as permitted by the building inspector. When a certificate of approval is issued authorizing temporary use and temporary utility connection of any electrical installation such certificate shall be issued to expire at a time to be stated therein and shall be removable by the building inspector. 15.12.070 Additions --Authority of Building Inspector to Disconnect. The building inspector shall have the authority to cut or disconnect any wire in case of emergency where necessary for safety to life or property or where such wire may interfere with the work of the fire department. The building inspector is authorized to disconnect or order the discontinuance of electrical wiring, devices, appliances or equipment found to be dangerous to life or property because they are defective or defectively installed until such wiring, devices, appliances and equipment and their installation have been made safe and approved by the building inspector. 15.12.080 Additions--Violation--Penalty. A. It is a violation of this chapter for any person, firm or corporation to install, alter or maintain any electrical wiring device, appliance or equipment, or cause the same to be done, in violation of any of the provisions of this code. Maintenance of equipment which was unlawful at the time it was installed shall constitute a continuing violation of this code. B. It shall be a violation of this Chapter for any person, firm or corporation to make connection from a source of electrical energy to an installation for which a permit is required, unless such person, firm or corporation has obtained a certificate of approval from the building inspector that such wiring devices, appliances or equipment are in conformity with all the requirements of this code. The International Association of Plumbing Officials Uniform Plumbing Cod-, 1991 Edition, is adopted as the Uniform Plumbing Code of the City, providing for the protection of the public health and safety, requiring a permit and inspection for the installation, alteration or repair of plumbing and drainage systems and the inspection thereof. B. Each and all of the regulations, provisions, penalties, conditions, and terms of such International Association of Mechanical Officials Uniform Mechanical Code, 1991 Edition, are referred to, adopted and made a part of this Chapter, as though fully set forth in this Chapter. 15.16.020 Copies on File. Three copies of the Plumbing Code adopted by Section 15.16.010 shall be on file in the Office of the City Clerk. Chapter 15.17 MECHANICAL CODE Sections: 15.17.010 Adoption of Uniform Code 15.17.020 Copies on File 15.17.010 Adoption of Uniform Code. A. The International Association of mechanical Officials Uniform (Mechanical Code, 1991 Edition, is adopted as the Uniform Mechanical Code of the City, providing for the protection of the public health and safety, requiring a permit and inspection for the installation, alteration or repair of mechanical systems and the inspection thereof. B. Each and all of the regulations, provisions, penalties, conditions, and terms of such International Association of Mechanical Officials Uniform (Mechanical Code, 1991 Edition, are referred to, adopted and made a part of this Chapter, as though fully set forth in this Chapter. 15.17.020 Copies on File. Three copies of the Mechanical Code adopted by Section 15.17.010, shall be on file in the Office of the City Clerk. Page 9 Chapter 15.20 FIRE CODE Sections: 15.20.010 Adoption of Uniform Code 15.20.020 Copies on file 15.20.030 Violation --Penalty 15.20.010 Adoption of Uniform Code. A. The International Conference of Building Officials and Western Fire Chief's Association, Uniform Fire Code, 1991 Edition and Riverside County Fire Department, Fire Protection Ordinance 546 are adopted as the fire code of the City, providing regulations consistent with nationally recognized standard practice, safeguarding life, health, property and public welfare to a reasonable degree the hazards of fire and explosion arising from the storage, use and handling of dangerous and hazardous materials, substances and devices, the operation, installation, construction, locations safeguarding and maintenance of adequate means of egress. B. When in any specific case, different Sections of these codes specify different materials, methods of construction, or other requirements, the most restrictive shall apply. C. Each and all of the regulations, provisions, penalties, conditions, and terms of the Uniform Fire Code, 1991 Edition, Riverside County Fire Department, Fire Protection Ordinance 546, are referred to, adopted and made a part of this Chapter, as though fully set forth in this Chapter. 15.20.020 Copies on File. Three copies of the Fire Code Riverside County Fire Department Fire Protection Ordinance 546 adopted by Section 15.20.010 shall be kept permanently in the Office of the City Clerk. 15.20.030 Violation --Penalty. Any person, firm or corporation violating any of the provisions of the Code so adopted in Section 15.20.010, shall be guilty of a misdemeanor, and upon conviction thereof, shall be punishable by a fine of not more than five hundred dollars or by imprisonment in the County jail for a period of not more than six months, or by both such fine and imprisonment.
