AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT,
CALIFORNIA, REPEALING SECTION 2.12.070 OF THE BEAUMONT
MUNICIPAL CODE, AND ADDING NEW SECTION 2.12.070 TO THE
BEAUMONT MUNICIPAL CODE, AMENDING TITLE 2, ADMINISTRATION AND
PERSONNEL, CHAPTER 2.12, CITY MANAGER.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE
OF CALIFORNIA, AS FOLLOWS:
SECTION 1: Section 2.12.070 is hereby repealed from the
Beaumont Municipal Code.
SECTION 2: New Section 2.12.070 is hereby added to the
Beaumont Municipal Code to read as follows:
2.12.070 REMOVAL.
A. The removal of the City Manager shall be only on a
majority vote of the whole Council, subject, however, to Section
2.12.080. In case of his/her intended removal by the Council, the
City Manager shall be furnished with a written notice stating the
Council's intention to remove him/her, the reasons therefor and
the effective date of the removal.
B. Within seven days after delivery to the City Manager
of such notice, he/she may, by written notification to the City
Clerk, request a public hearing before the Council. Thereafter
the Council shall fix a time for the public hearing, which shall
be held at its usual meeting place, and at which time the City
Manager shall appear and be heard.
C. After furnishing the City Manager with written
notice of removal, the City Council may suspend him/her from duty,
but his/her compensation shall continue until the date of removal.
Upon removal, the City Manager shall receive a lump sum cash
severance payment equal to two (2) month's aggregate salary unless
removal is due to conviction of an illegal act.
D. In removing the City Manager, the City Council shall
use its uncontrolled discretion and its action shall be final and
shall not depend upon any particular showing or degree of proof at
the hearing; the purpose of which is to allow the City Manager to
publicly present to the City Council his/her grounds of opposition
to removal prior to its action.
