HomeMy Public PortalAboutOrdinance 736ORDINANCE NO. 736 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, AMENDING THE BEAUMONT MUNICIPAL CODE REGARDING CURFEW FOR MINORS THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The following Sections of Chapter 9.24 of the Beaumont Municipal Code are hereby repealed in their entirety. SECTION 2: The following new sections are hereby added to Chapter 9.24 of the Beaumont Municipal Code to read as follows: 9.24.010 Curfew Established. It shall be unlawful for any person under the age of eighteen (18) years to loiter, idle, wander, stroll, or play upon or about any public streets, avenue, alleys, parks, playgrounds, shopping malls or plazas or any other public place between the hours of 10:00 P.M. and sunrise of the following day unless: 1. The minor is accompanied by his or her parent or guardian having legal custody and control of the minor. 2. The minor has been emancipated under the Emancipation of Minors Act (Civil Code 60 et seq.). 3. The minor is upon an errand directed by his or her parent or guardian having legal custody and control of the minor. 4. The minor is returning directly home from a public meeting or public place such as a library or a place of public entertainment such as a theater, play, sporting event, dance, or school activity. 5. The presence of the minor in said place or places is connected with or required with respect to a business, trade, profession, or occupation in which said minor is lawfully engaged. 9.24.020 Responsibility of parent or guardian. Any parent, guardian, or other person having legal care, custody or control of any person under the age of eighteen (18) years who violates Section 9.24.010 shall also be in violation of this ordinance 1 9.24.030 Violation --Penalty. Any person who violates any of the provisions of this Chapter shall be guilty of an infraction. (1) A first violation is punishable by a fine not exceeding One Hundred Dollars ($100.00); (2) A second violation of this Ordinance within one year is punishable by a fine not exceeding Two Hundred Dollars ($200.00). (3) Each additional violation of this Ordinance within one year is punishable by a fine not exceeding Five Hundred Dollars ($500.00). SECTION 2: Effective Date. This Ordinance shall take effect thirty (30) days after adoption. MOVED, PASSED AND ADOPTED this 22nd day of November 1993.
