AN ORDINANCE OF THE CITY OF BEAUMONT AUTHORIZING
ITS POLICE OFFICERS TO REMOVE UNATTENDED
MOTOR VEHICLES ON CITY STREETS, HIGHWAYS
AND ALLEYS WITHIN CITY LIMITS
THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Rescission. Ordinance No. 361, an ordinance
prohibiting abandonment of vehicles and providing for the
impounding thereof, and Ordinance No. 558, amending Ordinance No.
361, are hereby rescinded in their entirety.
SECTION 2: Purpose. The purpose of this Ordinance is to
provide the authority to the City of Beaumont Police Department and
its members thereof to remove, or cause to be removed, any and all
unattended motor vehicles on any City street, highway or alley
within the City limits in violation of this Ordinance.
SECTION 3: Definitions. As used herein the terms
"alley", "highway", "street", and "motor vehicle" shall have the
same definitions as found in the California Vehicle Code at Section
100 et seq.
SECTION 4. Circumstances Permitting Removal. The City of
Beaumont Police Department and its members thereof may remove a
motor vehicle located within the teritorial limits of the City of
Beaumont under any of the circumstances described in Vehicle Code
Section 22651, which Section is incorporated herein by this
reference as though set forth in full, as such Section now exists
or may hereafter be amended.
Additionally, the Police Department or any member thereof may:
a. Remove any motor vehicle parked or left standing
upon any alley, street or highway for 72 or more consecutive hours,
and;
b. Remove any motor vehicle parked on an alley, street
or highway during the time the use of such alley, street or
highway, or portion thereof, is necessary for the cleaning, repair,
or construction of the alley, street or highway, or for the
installation of underground utilities, provided that signs giving
notice that the vehicle may be removed were erected or placed at
least 24 hours prior to the removal, and;
c. Remove any motor vehicle parked or left standing
where parking or standing is prohibited and signs are posted giving
notice of such prohibition and the authorization to remove.
SECTION 5. Obstruction of or Interference With Police
Officers. No person shall interfere with or obstruct in any
way any Police Officer or other officer or employee of this City in
his or her enforcement of the provisions of this Ordinance. The
removal, obliteration or concealment of any chalk mark or other
distinguishing mark used by any Police Officer or other employee or
officer of this City in connection with the enforcement of the
parking regulations set forth herein constitutes such interference
or obstruction.
SECTION 6. Violation and Penalty. Violation of this
Ordinance is an infraction punishable by:
a. A fine not exceeding $100.00 for a first
violation, or;
b. A fine not exceeding $200.00 for a second violation
of this Ordinance within one year, or;

c. A fine not exceeding $500.00 for each additional
violation of this Ordinance within one year.
