AN ORDINANCE AMENDING CHAPTER 3.24 OF THE CITY OF
BEAUMONT MUNICIPAL. CODE ENTITLED "UNIFORM LOCAL
BALER AND USE TAY ORDINANCE OF THE CITY OF
BEAUMONT;" PROVIDING FOR A CREDIT AGAINST THE
PAYMENT OF TAXER UNDER SAID CHAPTER IN THE AMOUNT.
OF BALER OR USE TAXER DUE TO THE REDEVELOPMENT
AGENCY OF THE CITY OF BEAUMONT PURSUANT TO SECTION
7202.6 OF THE REVENUE AND TAXATION CODE OF
CALIFORNIA; AND MAKING CERTAIN OTHER FINDINGS AND
DETERMINATIONS IN CONNECTION THEREWITH
WHEREAS, the City Council of the City of Beaumont (the
"City") duly passed and adopted on July 1, 1957, Ordinance No. 288
entitled "Uniform Local Sales and Use Tax Ordinance of the City of
Beaumont (codified as Chapter 3.24 of the Beaumont Municipal Code)
(the "Code")"; and
WHEREAS, pursuant to said Ordinance No. 288, the City
Council approved the execution of a certain Agreement for State
Board of Equalization administration of local sales and use taxes
(the "Agreement"); and
WHEREAS, the Agreement provides for the collection and
distribution of sales and use taxes to the City under Chapter 3.24
of the Code by the State Board of Equalization; and
WHEREAS, the City has operated under said Ordinance, said
Agreement and Chapter 3.24 from July 1, 1957 to the present time;
and
WHEREAS, in 1981, the State Legislature enacted
Section 7202.6 of the Revenue and Taxation Code of the State of
California which provides a means by which a redevelopment agency
may impose a sales and use tax within a project area provided that
the city council of the city within which such redevelopment agency
is located enact an ordinance or an amendment to its sales and use
tax ordinance which provides for a credit against sales and use
taxes payable to said city, the amount of sales and use taxes due
to the redevelopment agency under its ordinance; and
WHEREAS, the City of Beaumont has duly activated its
Redevelopment Agency pursuant to the provisions of Section 33000,
et sea., of the Health and Safety Code of the State of California;
and
WHEREAS, said Redevelopment Agency wishes to utilize the
provisions of said Section 7202.6; and

WHEREAS, it is in the public interest and convenience
that Chapter 3.24 of the Code be amended to provide for such
credit.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE
OF CALIFORNIA, AS FOLLOWS:
Section 1. That the recitals set forth hereinabove
are true and correct in all respects.
Section 2. That Chapter 3.24 of the City of Beaumont
Municipal Code be and the same is hereby amended by the addition of
Section 3.24.060 thereto, which Section 3.24.060 shall provide as
follows:

"Section 3.24.060. CREDIT AGAINST TAXES DUE AND
PAYABLE TO REDEVELOPMENT AGENCY. In the event that the
Redevelopment Agency of the City adopts an ordinance
pursuant to the provisions of Section 7202.6 of the
Revenue and Taxation Code of California which provides
for the levying of a sales and use tax within a project
area of the Redevelopment Agency of the City, any
retailer or other person required to pay a sales or use
tax pursuant to provisions of this Ordinance shall be
given a credit against amounts payable under this
Ordinance in the amount of sale and/or use taxes payable
to the Redevelopment Agency of the City under such
ordinance adopted pursuant to the provisions of said
Section 7202.6. In the event the Redevelopment Agency of
the City issues obligations secured in whole or in part
by taxes levied pursuant to the provisions of Section
7202.6 of the Revenue and Taxation Code of California,
the City shall not revoke this credit in whole or in part
nor shall it reduce its sales and use tax rate."
Section 3. Effective Date
This Ordinance shall take effect upon the date of its
Section 4. Posting
The City Clerk shall cause this Ordinance to be published
and/or posted within fifteen days after its adoption.
Section 5. The findings and determinations herein
shall be final and conclusive. This Ordinance shall take effect as
provided by law.
