HomeMy Public PortalAboutOrdinance 749 (2)ORDINANCE NO. 749 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA ESTABLISHING AND AMENDING CERTAIN LIMITATIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE BEAUMONT REDEVELOPMENT PROJECT WHEREAS, the Beaumont Redevelopment Agency (the "Agency"), has formulated, prepared and approved the Redevelopment Plan 'for the Beaumont Redevelopment Project (the "Redevelopment Plan"); and WHEREAS, the City Council of the City of Beaumont, on December 27, 1993, approved and adopted the Redevelopment Plan pursuant to a duly enacted Ordinance; and WHEREAS, Section 33333.6 of the California Community Redevelopment Law has established certain limitations on the incurring and repaying of indebtedness and the duration of redevelopment plans as well as the use of eminent domain, which limitations apply to every redevelopment plan adopted on or before December 31, 1993; and WHEREAS, Section 33333.6 further provides that unless a redevelopment plan adopted prior to January 1, 1994, already containslimitations which comply with that Section, the legislative body shall adopt an ordinance on or before December 31, 1994, to amend the redevelopment plan either 1) to amend an existing time limit that exceeds the applicable time limit established by that Section, or 2) to establish time limits that do not exceed the provisions of that Section. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE OF CALIFORNIA, AS FOLLOWS: Section 1. Section X(1000) of the Redevelopment Plan which establishes the time limit of the Plan is hereby amended in its entirety to read as follows: "Except for the non- discrimination and non -segregation provisions which shall run in perpetuity, the provisions of this Redevelopment Plan shall be effective, and the provisions of other documents formulated pursuant to this Redevelopment Plan may be made effective for forty (40) years from the effective date of adoption of this Redevelopment Plan of the Agency. Section 2. The time limit on establishing of loans, advances, and indebtedness set forth in the last paragraph of Section 702 of the Redevelopment Plan, is hereby amended to read: "Twenty (20) years from the date of adoption of the Ordinance approving and adopting this Redevelopment Plan". Ordinance No. 749 Section 3. A new paragraph shall be added at the end of Section 702 which shall provide: "The Agency shall not pay indebtedness or receive property taxes pursuant to Section 33670 after ten (10) years from the termination of the effective date of the Redevelopment Plan." Section 4. The City Clerk is hereby directed to send a certified copy of this ordinance to the Agency. Section 5. Effective Date. This ordinance shall be in full force and effect thirty (30) days after its passage. Section 6. Publication. The City Clerk is hereby ordered and directed to certify to the passage of this ordinance and cause the same to be published more than five days prior to its introduction and within 15 days of its adoption in the Community Advisor, a newspaper of general circulation published and circulated in the City of Beaumont, California. Section 7. If any part of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this ordinance and the City Council hereby declares that it would have passed the remainder of this ordinance, if such valid portion thereof had been deleted. Council Member Berg moved to waive further reading of the ordinance. Second by Council Member Russo and unanimously approved. Council Member Berg moved to introduce Ordinance No. 749. Second by Mayor Pro Tem Parrott and unanimously approved. 7. CITY COUNCIL/STAFF REPORTS/APPOINTMENTS: Plannning Director Egger presented a report of a Planning Commission meeting held December 6, 1994, indicating that a plot plan and a negative declaration had been approved subject to certain conditions, and a sign permit continued to the meeting to be held January 3, 1995, for McDonald's restaurant which will be located at Beaumont Avenue and Fifth Street. He also reported that the Commission had approved parcel maps for Lockheed and Loma Linda University, with certain conditions. At 7:15 p.m., by order of Mayor Leja, the City Council recessed to a meeting of the Beaumont Redevelopment Agency. The City Council meeting was reconvened at 7:35 p.m. and after a brief recess, the City Council recessed to closed session. 8. CLOSED SESSION: A closed session was held on litigation cases Snediker vs the City and Dulmage vs the City. The Council returned to open session at 8:31 p.m. with all council members present. Mayor Leja announced that the Council had taken no action in closed session. ADJOURNMENT: There being no further business to be considered by the City Council, the meeting was duly adjourned by Mayor Leja at 8:31 p.m. 6
