HomeMy Public PortalAboutOrdinance 755ORDINANCE NO. 755 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, AMENDING THE ZONING ORDINANCE OF THE MUNICIPAL CODE BY ADDING AN OVERLAY ZONING DISTRICT TO PERMIT BED AND BREAKFAST ESTABLISHMENTS IN CERTAIN AREAS OF THE CITY. WHEREAS, the City of Beaumont Planning Department has been approached about the potential for the establishment of bed and breakfast lodging facilities in conjunction with the City's commercial core which caters to antique sales establishments; and WHEREAS, the areas of the City of Beaumont which adjoin the Sixth Street and Beaumont Avenue commercial corridors contain numerous large, historical residences from the Victorian and California Craftsman architectural eras which are suitable for use as bed and breakfast establishments; and WHEREAS, given the configuration of streets, infrastructure, parcelization and land uses in the historic portion of Beaumont, bed and breakfast establishments, when reviewed on a case-by- case basis, can co -exist compatibly with existing and proposed residential and commercial uses in such areas, and will be a community benefit by enhancing the vitality and tax base of such areas; and WHEREAS, bed and breakfast establishments have proven to be desirable and attractive land uses in many California and adjoining communities, particularly in conjunction with other visitor -serving and tourist activities. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF BEAUMONT HEREBY RESOLVES AND ORDAINS AS FOLLOWS: Section 1. Title 17 of the Municipal Code is hereby amended by adding a new Chapter 17.37 to read as follows: Ordinance No. 755 MOVED AND PASSED upon the first reading this 24th day of July, 1995, by the following vote: AYES: NOES: ABSTAIN: ABSENT: Mayor Leja, Mayor Pro Tem Parrott and Councilmembers Berg, Brey and Russo. I Transmitted: S7/A9 .s- I Time: //,'e/ I Operator: e I Agenda Item No. /1 Staff Report To: Mayor and City Council Members From: Community and Economic Development Department Agenda Date: July 24, 1995 Subject: Proposed Zoning Ordinance Amendment to Establish A Bed and Breakfast Overlay Zoning District ******************************************************************************** BACKGROUND: City staff has been approached by Mr. Donald Echlin regarding the possibility of expanding the use and function of some of the larger historic homes in the historic core of Beaumont, with an emphasis on complementing the burgeoning antique trade and tourist attraction which the City is becoming and which it hopes to enhance in the future. Staff has considered this matter and feels that it is possible and desirable to create a mechanism . which will facilitate these types of uses in a manner which can be compatible with existing and planned residential and commercial areas. As a result, the proposed Zoning Ordinance Amendment which is attached and assessed herein was developed for consideration by the Planning Commission. and the Commission considered this matter on July 11 and recommends City Council approval thereof.. ANALYSIS: The central portions of Beaumont are becoming increasingly known as a location for antique stores, which are frequently regularly by antique enthusiasts from throughout Southern California. This type of business caters to tourists and visitors, as opposed to most other businesses which operate to meet the daily needs of residents of Beaumont and the vicinity. It is believed that the establishment of enabling regulations to allow bed and breakfast inns provides the opportunity to develop uses which are complementary to existing businesses and which can enhance the City's desirability as a destination point. These types of uses are also beneficial with regard to special community events, such as the Cherry Festival or Stage Coach Days. Most of the City's commercial areas to the west of Beaumont Avenue and certain adjoining residential areas are in staffs opinion suitable for this type of use. The areas which warrant strong consideration include parcels fronting both sides of Beaumont Avenue, between Sixth Street and Fourteenth Street, and the general area bounded by Elm Avenue on the west, Eighth Street on the north, Beaumont Avenue on the east, and Fifth Street on the south. These areas contain a variety of commercial and office uses and older historic residences on generally larger parcels, and possess 11 Staff Report Bed and Breakfast Overlay Zone Page 2 good circulation and proximity to the antique sales establishments. The proposed Zoning Ordinance amendment which is attached would establish the authority to convert existing homes or to develop new bed and breakfast inns in the designated areas, with the approval of a conditional use permit (CUP) by the Planning Commission. The CUP process allows a case-by-case review to evaluate the suitability of a particular site or structure for this use, including an evaluation of its compatibility with its surroundings. Thus, if the proposed conversion of a residence was deemed to be incompatible with a particular neighborhood, the Commission could make findings to deny or condition the proposal. The proposed methodology would establish an "Overlay Zone", which is a zoning district which overlaps the underlying base district (e.g., single-family residential, neighborhood commercial). This same approach is already in use in the Beaumont Municipal Code with the R -OB (Residential Overlay Bonus Zone, which supplements underlying residential districts. The prevailing zoning designations would not be compromised by the current proposal. FINDINGS: The following findings are in order relative to the proposed Zoning Ordinance Amendment: 1. The proposed ordinance is consistent with the adopted Beaumont General Plan. 2. The proposed ordinance will further the goals of the General Plan and the Redevelopment Plan by providing an opportunity to enhance and revitalize the downtown area. 3. The proposed ordinance provides a sufficient degree of control through the conditional use permit process to ensure neighborhood compatibility. 4. The proposed ordinance is exempt from the provisions of the California Environmental Quality Act (Section 15303). RECOMMENDATION: Staff recommends that the City Council introduce the proposed zoning ordinance amendment to establish the Bed and Breakfast Overlay Zone. Respectfully Submitted, Ernest A. Chapter 17.37 BED AND BREAKFAST OVERLAY ZONE Sections: 17.37.005 B&B (Bed and Breakfast) Overlay Zone - Intent 17.37.010 Location of Properties Designated 17.37.015 Permitted Uses 17.37.020 Special Provisions and Limitations 17.37.005 B&B (Bed and Breakfast) Overlay Zone - Intent. The provisions of Section 17.37, inclusive, shall be known as the B&B Bed and Breakfast Overlay Zone, and are intended to accommodate bed and breakfast inns in certain areas of the City of Beaumont deemed to be appropriate for such uses. The application of the Bed and Breakfast Overlay Zone to such designated properties shall be in addition to the underlying Zoning District to which such properties are subject to under Title 17 of the Municipal Code. The general purpose of this overlay zoning . district shall be to facilitate uses which are compatible with the development of the historic portions of Beaumont for tourist and visitor -serving uses, primarily by the conversion, where appropriate, of existing residential structures into bed and breakfast inns. 17.37.010 Location of Properties Designated. The subject designation of B&B (Bed and Breakfast) Overlay Zone shall apply to such properties as are identified on the map attached hereto as Exhibit "A", and shall include all properties bounded by Elm Avenue, Eighth Street, Beaumont Avenue and Fifth Street, and all properties fronting on Beaumont Avenue between Fifth Street and Fourteenth Street. 17.37.020 Permitted Uses. In addition to the uses permitted under the underlying zoning district, properties in the B&B Overlay Zone may be utilized for bed and breakfast inns, subject to the approval of a conditional use permit by the City of Beaumont Planning Commission. 17.37.025 Special Provisions and Limitations. It is intended that the primary use of the B&B Overlay Zone shall be for the purpose of maintaining and enhancing historic residences in the City of Beaumont, while maintaining a high degree of compatibility with adjoining and nearby uses. The application of this zone for new projects or for the conversion or enlargement of other commercial or residential structures shall be evaluated on a case-by-case basis. Section 2. This ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage the City Clerk shall cause it to be published in the Community Advisor, a newspaper of general circulation, printed and published in the City of Beaumont, in the ORDINANCE NO. manner prescribed by law for publishing ordinances of said City.
