AN ORDINANCE OF THE CITY COUNCIL OF THE CIZY
OF BEAUMONT, CALIFORNIA, REPEALING SECTIONS
17.50.100, 17.50.105 AND 17.50.205 OF THE
BEAUMONT MUNICIPAL CODE AND ADDING NEW
SECTIONS TO THE MUNICIPAL CODE THEREBY ADDING
POULTRY PROCESSING AS A PERMITTED USE IN M -C
AND M -L ZONES.
THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES OFDAIN AS
FOLLOWS:
SECTION 1: Chapter 17.50, Sections 17.50.100, 37.50.105 and
17.50.205, inclusive, and Sub -section 17.50.110 #11 cf the
Municipal Code of the City of Beaumont are repealed.
SECTION 2: Sections 17.50.100 and 17.50.105 are added to
the Municipal Code of the City of Beaumont to read aE follows:
17.50.100 M -C ZONE (COMMERCIAL - LIGHT MANUFACTtRING)
INTENT.
The M -C zone is intended to provide for and encourage the
grouping together of light industrial and commercial uses that
can maintain high standards as to the appearance of the buildings
and the treatment of land about them and so operate Es to be not
detrimental to adjacent commercial and residential u:,es,
excluding any which by reason of its nature or manner of
operation would create conditions hazardous, noxious or offensive
to the community when so located.
17.50.105 PERMITTED USES. In the M -C zone, no building
shall be erected, reconstructed or structurally altezed, nor
shall any building or land be used for any purposes except as
hereinafter specifically provided and allowed by this; Article.
A. PRINCIPAL PERMITTED USES. No uses are permitted
without requiring specific planning approval..
B. PLOT PLAN USES. The following uses are periiitted
subject to the approval of a plot plan pursuant to
Article XII of this ordinance. More than one use shall
be permitted on a lot.
1. Minor Plot Plan. The following Manufacturing and
Service Commercial Uses are permitted provided a
minor plot plan has been approved pursuant to the
provisions of Section 17.70.005 (a) (2) of this
ordinance.
(a) Ambulance services;
(b) Automobile repair garages, automob:_le parts
and supply stores, tire sales and services;
(c) Banks and financial institutions;
(d) Barber and beauty shops;
(e) Bicycle sales, rental and repair;
(f) Blueprint and duplicating services!
(g) Boat and other marine sales and se::vices;
boat building and repair (boats not to
exceed 42 feet in length). Recreational
vehicle and boat storage, trailer and boat
storage;
(h) Building material sales yards, inc:_uding
the sale of rock, sand, and gravel as an
incidental part of the main business.
Lumber yards, including only incidental
mill work;
(i) Catering services;
(j) Ceramic sales and manufacturing provided
there is no pulverizing;
(k) Concrete batching plants and the manufacture
of concrete products;
(1) Contractor's equipment and storage yards, or
rental yards for equipment used by con-
tractors;
(m) Draying, freighting, or trucking terminals;
(n) Drive-in theaters;
(o) Dwelling unit, on the same parcel as a
permitted industrial or commercial use,
provided it is occupied by the proprietor,
supervisor or caretaker of such industrial
or commercial use and immediate family;
(p) Equipment rental services, including roto -
tillers, sanders, power saws, cement and
plaster mixers;
(q) Feed and fuel sales, retail and wholesale;
(r) Fence manufacture or assembly;
(s) Flour mills;
(t) Frozen food lockers;
(u) Gasoline service stations;
(v) Golf cart sales and service;
(w) Hardware stores, including the outside
storage of lumber, paint and wallpaper
stores;
(x) Laboratories, film, dental, medical,
research or testing;
(y) Liquid petroleum service stations;
(z) Mail order businesses;
(aa) Manufacturer's agent;
(bb) Market, food, wholesale or jobber;
(cc) Mimeograph and addressograph services;
(dd) Mobile homes, provided they are usEd for:
(1) Sales offices on mobile home :ales lots;
(2) Construction offices and caretaker's
quarters on construction site: for the
duration of a valid building permit,
provided they are inconspicuotsly
located;
(3) Caretakers or watchmen and thEir
families, provided no rent is paid,
where a permitted and existinc commer-
cial or manufacturing use is established.
Not more than one dwelling unit shall be
allowed for a parcel of land. Homes
must be on permanent foundation pursuant
to the provisions of Section :.7.80.100 of
this ordinance;
(ee) Mobile home and travel trailer sales;
(ff) Motorcycle, motorbike, or scooter rales;
(gg) Nurseries and garden supply stores, retail
or wholesale;
(hh) Offices, businesses and profession<<1,
employment agencies, telephone exchanges;
(ii) Outdoor advertising, minimum 500 foot
intervals, pursuant to the provisions of
Section 10.3 of this ordinance;
(jj) Parking lots and parking structuress;
(kk) Printers and publishers;
(11) Public utility substations and service
yards, not including power generat:_on;
(mm) Restaurants and other eating estab:_ishments;
(nn) Shoe repair shops;
(oo) Signs, on-site advertising pursuant: to the
provisions of Section 17.60.020 of this
ordinance;
(pp) Sports and recreational facilities, not
including motor driven vehicles and riding
academies, but including archery ranges,
athletic playgrounds, sports arenas, skating
rinks, stadiums, and commercial sw:_mming
pools, bicycle motorcross tracks;
(qq) Stations, bus, railroad and taxi;
(rr) Swap meets;
(ss) Taxidermist;
(tt) Trucks and trailers, rental sales rind
services;
(uu) Typewriter sales, rental and repairs;
(vv) Upholstery shops;
(ww) Watch repair services.
C. PLOT PLANS REQUIRING PUBLIC HEARING.
1. A plot plan approved in accordance with the
provisions of Section 17.70.005(a) 3 and 4 of this
ordinance, will be required for the uses specified
in Sub -section B1, above, when:
(a) The uses proposed are on vacant or under-
developed land and there are no off-site
improvements.
(b) Expansion of existing uses exceeds existing
development by 25% or more.
(c) More than one structure is proposed on one
parcel.
(d) The proposed use would require greater than
200 square feet of outside storage.
(e) The provision of the California Environmental
Quality Act (CEQA) must be met (i.e., struc-
tural occupancy load is for 21 or Wore persons
and the parking provisions require 11 or more
spaces).
(f) The proposed use lies within an area that is
not served by a community water or sewer
system and does not have adequate circula-
tion to accommodate projected increased
traffic.
2. The following uses are permitted provided they are
conducted within a completely enclosed tuilding
except for incidental storage, and a plct plan
has been approved pursuant to the provisions of
Section 17.170.005 (a) 3 and 4 of this crdinance.
(a) The manufacture, assembly, processing or repair
of the following products:
(1) Articles or merchandise from the following
previously prepared materials: cork,
feathers, fiber, hair, horn, glass,
leather, paper, tobacco, and paint, not
employing a boiling or rendering process.
(2) Bakeries and candy factories; distribution
and sale of bakery and candy products on
wholesale basis.
(3) Batteries, manufacturing and rebuilding.
(4) Drugs, pharmaceuticals, and toiletries,
not including refining or rendering of
fats or oils.
(5) Food products, human or animal, not
including meat packing plants.
(6,) Furniture, cabinets, sash and doors,
including only incidental mill work.
(7) Garments and any other products made of
fabric.
(8) Jewelry, optical goods, scientific or
musical instruments and equipment, toys,
novelties, and metal stamps.
(9) Office machines.
(10) Sheet metal products, such as heating and
ventilating ducts, cornices and eaves.
(11) Signs, electrical and neon, commercial
advertising structures.
(b) Distribution plants, parcel delivery
services.
(c) Fabrication of plastic, rubber or synthetic
rubber products.
(d) Ice or cold storage plants, bottling or canning
of fruit, vegetable or soft drink products.
(e) Machine, welding and blacksmith shops,
provided that impact machines shall not exceed
a capacity of two tons and non-impar;t machines
shall be limited to 50 horsepower.
(f) Manufacture of recreation and utility trailers
recreation vehicles and mobile homes.
(g) Tires, retreading and recapping.
(h) Vehicle and trailer repair, overhauling,
assembly, rebuilding,painting and recondi-
tioning, rebuilding of vehicle parts,
accessories or assemblies.
(i) Veternaries and animal hospitals.
(j) Wholeselling and warehousing.
(k) Meat packing plants, provided there is no
slaughtering of animals or rendering of meat.
(1) Processing of poultry and poultry products
including slaughtering, packing, freezing
and canning, but not including rend?ring.
SECTION 3: Section 17.50.205 is added to the Municipal Code
of the City of Beaumont to read as follows:
17.50.205 PERMITTED USES. In the M -L Zone, no building
shall be erected, reconstructed or structurally altered, nor
shall any building or land be used for any purposes except as
hereinafter specifically provided and allowed by this Article.
A. PRINCIPAL PERMITTED USES. No uses are permitted
without requiring specific planning approval.
B. PLOT PLAN USES. The following uses are permitted
subject to the approval of a plot plan pursuant
to Chapter 17.70 of this ordinance. The Plot Plan
approval may include conditions requiring fencing
and landscaping of the parcel to assure that the
use is compatible with the surrounding area. More
than one use shall be permitted on a lot.
1. Minor Plot Plans. The following uses are permitted
provided a minor plot plan has been approved
pursuant to the provisions of Section 17.70.005 (a)
2 of this ordinance:
(a) Ambulance services;
(b) Auto impoundment yards;
(c) Automobile parts and supply stores,
automobile repair garages, tire sales and
service;
(d) Banks and financial institutions;
(e) Blueprint and duplicating services,
mimeograph and addressograph services,
printers and publishers;
(f) Boat and other marine sales and services,
boat builders and repairs, recreational
vehicle, trailer and boat storage;
(g) Building material sales yards, including
the sale of rock, sand and gravel. Hard-
ware stores including the outside storage
of lumber, lumber yards;
(h) Car washes;
(i) Catering services;
(j) Ceramic sales and manufacturing provided
there is no pulverizing of clay;
(k) Concrete batching plants and the
manufacture of concrete products;
(1) Contractor's equipment and storage yards,
or rental yards for equipment used by
contractors;
(m) Dog and cat kennels, commercial;
(n) Draying, freighting, or trucking terminals;
(o) Dwelling unit, on the same parcel, as a
permitted industrial or commercial ase,
provided it is occupied by the proprietor,
supervisor or caretaker of such industrial
use and immediate family;
(p) Equipment rental services, including roto -
tillers, power mowres, sanders, power saws,
cement and plaster mixers;
(q) Feed store, flour mills and fuel sales,
retail or wholesale;
(r) Fence manufacture and assembly;
(s) Fertilizer, packaging and sales;
(t) Frozen food lockers;
(u) Gas, natural, above surface storage to
500,000 cubic feet;
(v) Gasoline service stations, liquid petroleum
service stations;
(w) Golf cart sales and service;
(x) Laboratories, film, dental, medical,
research and testing;
(y) Machinery storage yard including sales and
display;
(z) Mail order businesses, offices, business
employment agencies;
(aa) Manufacturer's agent;
(bb) Market, food, wholesale or jobber;
(cc) Mobile homes, provided they are useJ for:
(1) Sales offices on mobile home sales lots.
(2) Construction offices and caretaker's
quarters on construction sites for the
duration of a valid building permit,
provided they are inconspicuously
located.
(3) Caretakers or watchmen and their
families, provided no rent is paid,
where a permitted and existing
commercial or manufacturing use is
established. Not more than one
dwelling unit shall be allowd for a
parcel of land. Homes must be on a
permanent foundation pursuant to the
provisions of Section 13.5 of this
ordinance.
(dd) Mobile home and travel trailer sales;
(ee) Motorcycles, motorbike or scooter sales,
rental repair or demonstration, but not
including race tracks;
(ff) Nurseries and garden supply stores, retail
and wholesale;
(gg) Parking lots and parking structures;
(hh) Public utility substations and service yards,
not including power generation;
(ii) Restaurants and other eating establishments;
(jj) Shoe repair shops, upholstery shops;
(kk) Signs, on-site advertising, pursuant to
Section 17.60.020 of this ordinance;
(11) Sports and recreational facilities, including
archery ranges, athletic playgrounds, sports
arenas, skating rinks,stadiums and commercial
swimming pools, bicycle motorcross track;
(mm) Stations, bus, railroad and taxi;
(nn) Taxidermist;
(oo) Swap meet;
(pp) Telephone exchanges;
(qq) Trucks and trailers, rental, truck sales
and service;
(rr) Typewriter sales, rental and repairs. A
plot plan approved in accordance with the
provisions of Section 17.70.005 (a) 3 or 4
of this ordinance, will be required for
the above uses when:
(1) The uses proposed are on vacant or
undeveloped land and there are no
off-site improvements.
(2) Expansion of existing uses exceeds
existing development by 25% or more.
(3) More than one structure is proposed
on one parcel.
(4) The proposed use would require greater
than 200 square feet of outside storage.
(5) The provision of the California
Environmental Quality Act (CEQA) must
be met (i.e., structural occupancy load
is for 21 or more persons and the parking
provisions require 11 or more spaces).
(6) The proposed use lies within an area
that is not served by a community
water or sewer system and does not
have adequate circulation to accommodate
projected increased traffic.
(7) The response time for emergency service
vehicle (Fire and Polce) is five
minutes or more.
2. Plot Plans Requiring Public Hearing. Tte
following uses rae permitted provided they are
conducted within a completely enclosed building
except for incidental storage, and a plct plan has
been approved pursuant to the provisionE of
Section 17.70.005 (1) 3 or 4 of this ordinance.
(a) The manufacture, assembly, processing or
repair of the following products:
(1) Abrasive, acids, cleaning compounds,
blending of.
(2) Articles of merchandise from the follow-
ing previously prepared materials:
cork, feathers, fiber, hair, torn, glass,
leather, paper, tobacco and paint, not
employing a boiling or rendering
process.
(3) Bakeries and candy factories; distribu-
tion and sale of bakery or cardy
products on a wholesale basis.
(4) Batteries, manufacturing and rebuilding.
(5) Drugs, pharmaceuticals and toiletries,
not including refining or rendering of
facts or oils.
(6) Fabrication of plastic, rubber or
synthetic rubber products.
(7) Food products, human or animal, not
including meat packing plants.
(8) Furniture, cabinets, sash and doors.
(9) Garments and other products made of
fabric.
(10) Jewelry, optical goods, scientific or
musical instruments and equipment toys,
novelties and metal stamps.
(11) Office machines.
(12) Sheet metal products, such as heating
and ventilating ducts, cornicEs and
eaves.
(13) Signs, electrical and neon, commercial
advertising structures.
(14) Recreation and utility trailers,
recreation vehicles and mobilc homes.

plating and finishing, foundries, forging
works.
(h) Paper shredding and storage.
(i) Retreading and recapping of tires.
(j) Vehicle and trailer repair, overhauling,
assembly, rebuilding, painting and
reconditioning, rebuilding of vehicle parts,
accessories and assemblies.
(k) Veterinaries and animal hospitals.
(1) Wholesaling and warehousing.
(m) Processing of poultry and poultry products
including slaughtering, packing, fr3ezing and
canning, but not including rendering.
SECTION 4: Section 17.50.110 of the Municipal CDde of the
City of Beaumont is amended by renumbering Sub-sectiols 12, 13,
14 and 15 respectively 11, 12, 13 and 14.
SECTION 5: This ordinance shall take effect as provided by
law.
