AN URGENCY INTERIM ORDINANCE OF THE CITY C')UNCIL
OF THE CITY OF BEAUMONT, CALIFORNIA,
REZONING FROM RESIDENTIAL HIGH DENSITY TO
RESIDENTIAL SINGLE FAMILY THAT PORTION OF
THE CITY WITHIN THE FOLLOWING BOUNDARIES:
FROM THE WESTERN CITY LIMITS TO CHERRY AVENUE,
AND FROM 6TH STREET TO 11TH STREET
WHEREAS, by Resolution of the City Council, The Planning
Commission has been directed to study a General Plan Amendment
and Zone Change in the area from the western city limits to
Cherry, and from 6th to llth, for the purpose of changing the
General Plan and Zoning from high density to single family; and
WHEREAS, by Resolution of the City Council, staff has been
directed to study the need for a review and revision of the
General Plan, in particular the Housing Element, and come back to
the City Council with a proposal for accomplishing that review
and revision;
WHEREAS, it is urgent that the welfare of single family
homeowners and residents in said location be protected in a
timely manner; and
WHEREAS, the approval and erection of High Density
Residental Units in Beaumont since the adoption of the General
Plan may have met the requirements for such housing.
THEREFORE, IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT AS FOLLOWS:
SECTION 1: The Beaumont Zoning Map is hereby amended to
read as follows:
Property currently identified as Residential High
Density (RHD) Zoning from the Western City Limits
to Cherry Avenue and from 6th Street north to llth
Street, including both sides of llth Street, is
temporarily rezoned within that area to Residental
Single Family (RSF).
SECTION 2: That this ordinance is adopted because there is
a current and immediate threat to the public health, safety, or
welfare in that the traditional single-family residential
character of the central area of Beaumont is being encroached
upon by high density residential use as multi -family dwellings
are erected on small lots between and contiguous lith long-
standing single family dwellings.
SECTION 3: That no plot plans, subdivisions, use permits,
variances, building permits, or any other applicatle entitlements
shall be approved for the area described in Secticn 1 except
those which are appropriate for uses in a Residential Single
Family zone.
SECTION 4: That this ordinance is adopted because the
approval of additional plot plans, subdivisions, Lse permits,
variances, building permits, or any other applicatle entitlement
which is required in order to comply with the current zoning
ordinance for high density residential use in the area described
in Section 1 would result in a threat to public t.ealth, safety,
or welfare.
SECTION 5: That this ordinance is adopted a: an urgency
measure pursuant to the provisions of Section 658E8 of the
Government Code of the State of California and she'll take effect
immediately.

SECTION 6: That this interim ordinance shall be of no
further force and effect 45 days from its date of adoption,
unless extended.
SECTION 7: That after this ordinance's passage the City
Clerk shall schedule a public hearing to be held on December 14,
1987 for the purpose of the City Council considering an extension
of this interim ordinance for a period of up to te:1 (10) months
and fifteen (15) days, and cause notice to be giver at least ten
(10) days before said public hearing pursuant to Section 65090 of
the Government Code of the State of California.
SECTION 8: At or before the public hearing o1 the proposed
extension of this interim ordinance, the Community Development
Director shall make a written report to the City C)uncil on the
status of the zoning study.
SECTION 9: At least ten (10) days prior to the expiration
of this interim ordinance or any extension, the City Council
shall adopt a written report describing the measures taken to
alleviate the condition which led to the adoption pf this
ordinance.
MOVED, PASSED AND ADOPTED as an Urgency Ordinance at its
first reading on this 9th day of November , 1987,
upon the following roll call vote.
AYES: Council Member Bauer, Connors, Waller and Mayor
Partain.
NOES: None.
ABSTAIN: None.
ABSENT: Council Member Shaw.

on November 9, 1987, and was duly adopted as an Urgency Ordinance upon
its first reading on November 9, 1987.
