HomeMy Public PortalAbout2023.059 (06-06-2023)RESOLUTION 2023.059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA APPROVING THE REPORT OF THE PARKING AND BUSINESS IMPROVEMENT DISTRICT (PBID) ADVISORY BOARD SETTING THE ASSESSMENT AGAINST BUSINESS ENTERPRISES IN THE PBID FOR FISCAL YEARS 2023-24 AND 2024-25, APPROVING THE PBID SPENDING PLANS FOR FISCAL YEARS 2023-24 AND 2024-25, AND FIXING THE TIME AND PLACE. FOR THE PUBLIC HEARING FOR THE LEVY OF THE ASSESSMENT WHEREAS, pursuant to Section 36500, et. sec. of the Streets and Highway Code of the State of California (CSHC), on November 27, 1985, Ordinance No. 1262 was adopted into law establishing the Parking and Business Improvement District (PBID); and WHEREAS, PBID assessments are levied as a fair and equitable way to provide fundsto maintain operate and improve business areas in the City; and WHEREAS, Section 3 of Ordinance No. 1262 identifies the PBID area as all of the territory within the exterior boundaries of the City of Lynwood; and WHEREAS, Section 4a of Ordinance No. 1262 established the system of charge and the method each business would be assessed annually and is based on 50% of the business license tax to all business located within the PBID area; and WHEREAS, the proposed PBID Spending Plan and use of funds in Fiscal Year 2023-24 and 2024-25 Report ("Report") was submitted and approved by the PBID Advisory Board on May 9, 2023, after having determined that the use of funds would be beneficial to the business community; and WHEREAS, the Report has the full detailed description of the improvements and activities to be provided and identifies the proposed levy on the businesses within the PBID area for Fiscal Years 2023-24 and 2024-25; and WHEREAS, it is the desire of the City of Lynwood City Council to adopt the Report, as approved by the PBID Advisory Board, and scheduled a public hearing to allow for any public comment and protests, whether oral or verbal, concerning the intended use of funds pursuant to Sections 36524 and 36525 of the CSHC; and WHEREAS, at the closing of the public hearing, unless protests are received that collectively represent 50% or more of the proposed annual assessment amount, the Council may adopt a resolution to levy the annual assessment and approve the Report outlining the PBID Spending Plans for Fiscal Years 2023-24 and 2024-25; and WHEREAS, the City Council wishes to set the public hearing to take place Tuesday, June 20, 2021, at a regularly scheduled City Council meeting, beginning at 6:00 p.m., in the Council Chambers. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council hereby adopts the Report, as approved by the PBID Advisory Board, for the levy of assessments within the PBID area for the Fiscal Years 2023- 24 and 2024-25 as mandated in Ordinance No. 1262 Section4a. Section 2. The City Council hereby sets a public hearing to take place on June 20, 2023, at a regularly scheduled City Council meeting beginning at 6:00 p.m. in the Council Chambers at Lynwood City Hall Annex to consider approval of the Report that outlines the PBID Spending Plans for Fiscal Years 2023-24 and 2024-25 and use of the PBID funds for an Economic Development Initiative, which includes: infrastructure design, seasonal decorations, marketing and promotional strategies, sidewalk cleaning, graffiti removal, street sweeper maintenance, and City -owned parking lot improvements, as described in Exhibit A to this resolution. Section 3. The City Council hereby directs the Finance and Administration Services Department to include the PBID Spending Plans for FY 2023-24 and 2024-25 in the FY 2023-24/2024-25 Operating Budget to reflect the proposed $360,300 and $180,300 budgets, respectively. Section 4. A copy of the Report is on file and available to public examination with the City Clerk's Office. Section 5. The City Manager, or her designee, is hereby authorized to sign all documents necessary and appropriate to carry out and implement said improvements and activities on the behalf of the City. Section 6. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect. PASSED, APPROVED and ADOPTED this 6th day of June 2023. Oscar P411"---lores, EXHIBIT A PBID SPENDING PLAN AND USE OF FUNDS REPORT for FISCAL YEAR 2023-24 & 2024-25 Summary On November 27, 1985, Lynwood Ordinance 1262 was adopted into law establishing the Parking and Business Improvement District (PBID). PBID assessments are levied as a fair and equitable way to provide funds to maintain, operate, and improve business areas in the City. The fundamental purpose of the PBID is to promote the economic revitalization and physical maintenance of the Lynwood businesscommunity. Section 3, of the Ordinance identifies the PBID Area as all of the territory within the boundaries of the City of Lynwood and Section 4(a) of the Ordinance established the system of charge and the method each business is assessed. The mandated levy imposes an additional 50% fee of the business license tax to all businesses located within the PBID area, which is assessed each year at the same time as the business license renewal, which takes place each December. PBID assessments are levied as a fair and equitable way to provide funds to maintain, operate, and improve business areas in the City. The City expects to receive approximately $115,000 in assessment funds by the end of the current fiscal year (FY 2020-21). When combined with prior year carryover funds (estimated at $245,300), the City anticipates having approximately $360,300 in PBID funds available for FY 2023-24. The assumption of $57,300 in contingency carryover from FY 2023-24 along with anticipated annual revenue of $125,000 provides the basis of an estimated $180,300 in assessment funds for FY 2024-25. Lew of Assessments The levy of assessments imposing an additional 50% fee of the business license tax to all businesses located within the PBID area will continue in Fiscal Years 2023-24 and 2022- 23.
