HomeMy Public PortalAboutOrdinance 778ORDINANCE NO. 778 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, ADOPTING A ZONE CHANGE TO APPLY THE PROVISIONS OF THE R -OB (RESIDENTIAL OVERLAY BONUS) ZONE TO THE A 40.1 ACRE PROPERTY LOCATED NORTH OF THE TERMINUS OF PALM AVENUE AT COUGAR WAY (97-RZ-1) WHEREAS, Mr. Raymond Spehar has submitted an application to develop a senior citizen residential project with affordable housing units on a vacant 40.1 acre property located north of the terminus of Palm Avenue at Cougar Way; and WHEREAS, the underlying zoning designation of the subject site is R -SF (Residential Single Family), permitting a maximum of 4.1 dwelling units per acre; and WHEREAS, Section 17.20.500 of the Municipal Code provides for the use and application of the R -OB (Residential Overlay Bonus) Zone for projects which provide for affordable housing, with proper assurances that such housing will be maintained in this manner; and WHEREAS, the proposed project is consistent with the General Plan Housing Element and will assist in the accomplishment of applicable State mandates and the provisions of the Beaumont Municipal Code; and WHEREAS, duly noticed public hearings were conducted on this matter as required by law by the Planning Commission on December 2, 1997 and the City Council on December 8, 1997 and January 13, 1998.. THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Official Zoning Map of the City of Beaumont is hereby amended to designate the subject property identified as APN # 406-080-003) for the following overlay zoning designation: R -OB (RESIDENTIAL OVERLAY BONUS) SECTION 2: This Ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage the City Clerk shall cause a summary to be published in a newspaper of general circulation, printed and published in the City of Beaumont, in a manner prescribed by law for publishing of ordinances of said City.
