MINUTES
JOINT PUBLIC HEARING
HILLSBOROUGH TOWN BOARD & PLANNING BOARD
April 19, 2012
7:00 p.m.
PRESENT: Town Board - Mayor Tom Stevens, Mike Gering, Eric Hallman, Brian Lowen
Planning Board – Bryant Warren, Dan Barker, John Bemis, Rick Brewer, Mary Donegan, Erin Eckert,
Kate Faherty, Janie Morris
STAFF PRESENT: Planning Director Margaret Hauth
ITEM #1: Call to Order. Mayor Tom Stevens called the meeting to order at 7:02 p.m. He asked if there were
adjustments to the agenda. Hearing none, he asked for a motion to accept the agenda as written.
MOTION: Commissioner Hallman moved to accept the agenda as written. Commissioner Gering seconded.
VOTE: Unanimous.
Mayor Stevens turned the gavel over to the Chair of the Planning Board, Bryant Warren.
ITEM #3i: Text Amendments to the Unified Development Ordinance - Section 6.3 to correct errors and missing
information in the tables of dimensional standards
Planning Director Hauth introduced the requested amendments to the dimensional standards tables to
correctly group residential and non-residential uses, to group Special Use and General Purpose zones with
the same setbacks, and to insert the standards from the Zoning Ordinance that were overlooked in the
conversion. She noted that the proposal also included correcting the height limit in the Multi-family
Special Use district to 45 feet, removing the impervious surface limit from the Central Commercial
district, and establishing only a height limit for the Special Design Special Use district .
There were no public comments and no board member questions.
ITEM #3ii: Text Amendments to the Unified Development Ordinance - Section 6.18 to establish a setback requirement
for freestanding signs
Planning Director Hauth introduced the requested amendments to establish a setback for freestanding
signs of 10 feet unless the ordinance or permit issuing authority specified a different setback.
There were no public comments and no board member questions.

ITEM #3iii: Text Amendments to the Unified Development Ordinance - Section 6.20 and Section 9 – amendments to
amend stormwater management requirements consistent with the state requirements and define certain
terms
Planning Director Hauth introduced the requested amendments to meet state requirements for compliance
with the Falls Lake watershed rules. She noted that many new definitions are requested and she has
inserted “for stormwater review purposes” for some terms to limit the impact of the definition to the
stormwater program. She noted the amendments don’t change any of the standards; they insert the actual
state standard in the ordinance where they had referred to state requirements more generally.
Commissioner Gering asked if Ms. Hauth knew how our review compared with comments other
jurisdictions received. Ms. Hauth said she felt they were similar. She said she knew Orange County had
been questioned about using the Falls Lake implementation schedule in a different watershed, but the
state agreed to allow a single process in the county rather than redoing it in the other watershed.
Kate Faherty asked about the definition of owner in Section 6.20.12. Ms. Hauth said that was one of her
concerns. The State’s required definition, which includes leaseholders, will be used anywhere in Section
6.20 where owner is referred to, including the section Ms. Faherty referred to, but not elsewhere in the
UDO where owners are referenced.
MOTION: Commissioner Hallman moved to close the public hearing on all items. Ms. Faherty seconded.
VOTE: Unanimous.
Mr. Warren noted the that public hearing was therefore concluded and the agenda called for the Town
Board members to be excused, but the Planning Board would continue in a work session.
