AN ORDINANCE REPEALING ORDINANCE NO. 742 OF THE CITY OF BEAUMONT AND
DELETING SECTION 3.24.060 OF THE CITY OF BEAUMONT MUNICIPAL CODE
ENTITLED "UNIFORM LOCAL SALES AND USE TAX ORDINANCE OF THE CITY OF
BEAUMONT" AND DETERMINATIONS IN CONNECTION THEREWITH
WHEREAS, the City of Beaumont (the "City") previously adopted Ordinance No. 742
which added Section 3.24.060 to the City Municipal Code entitled a Sales and Use Tax Ordinance
of the City of Beaumont, in accordance with Section 7202.6 of the Revenue and Taxation Code;
WHEREAS, Section 7202.6 of the Revenue and Taxation Code was repealed by
California Statutes of 1993, Chapter 942 (Assembly Bill 1290), § 37; and
WHEREAS, Section 3.24.060 is no longer in the public interest or convenience since
Section 7202.6 of the Revenue and Taxation Code, the statute enabling Section 3.24.060, has been
repealed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, STATE OF
CALIFORNIA, AS FOLLOWS:
Section 1. That the recitals set forth hereinabove are true and correct in all respects.
Section 2. That Section 3.24.060 of the City Municipal Code which reads as follows be
repealed in its entirety:
"Section 3.24.060. CREDIT AGAINST TAXES DUE AND PAYABLE TO
REDEVELOPMENT AGENCY. In the event that the Redevelopment Agency of the City adopts
an ordinance pursuant to the provisions of Section 7202.6 of the Revenue and Taxation Code of
California which provides for the levying of a sales and use tax within a project area of the
Redevelopment Agency of the City, any retailer or other person required to pay a sales or use tax
pursuant to provisions of this Ordinance shall be given a credit against amounts payable under this
Ordinance in the amount of sale and/or use taxes payable to the Redevelopment Agency of the City
under such ordinance adopted pursuant to the provisions of said Section 7202.6. In the event the
Redevelopment Agency of the City issues obligations secured in whole or in part by taxes levied
pursuant to the provisions of Section 7202.6 of the Revenue and Taxation Code of California, the
City shall not revoke this credit in whole or in part nor shall it reduce its sales and use tax rate."
Section 3. Effective Date
This Ordinance shall take effect thirty (30) days after the date of its adoption.
Section 4. Posting
The City Clerk shall cause this Ordinance to be published and/or posted within fifteen days
after its adoption.
Section 5. The findings and determinations herein shall be final and conclusive. This
Ordinance shall take effect as provided by law.
