HomeMy Public PortalAbout2023.074 (07-18-2023)RESOLUTION NO. 2023.074 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING AND DIRECTING THE COUNTY ASSESSOR TO LEVY AND COLLECT DELINQUENT REFUSE BILLS AGAINST SINGLE FAMILY RESIDENTIAL PARCELS (UP TO THREE UNITS) FOR FISCAL YEAR 2023-2024 ON THE COUNTY TAX ROLL AND DIRECTING THE COUNTY ASSESSOR TO INCLUDE RESIDENTIAL REFUSE BILLS FROM WASTE RESOURCES, INC. (WRI) AS A SPECIAL ASSESSMENT TO BE COLLECTED AT THE SAME TIME AND IN THE SAME MANNER AS COUNTY TAXES FOR FY 2023-2024 WHEREAS, Section 38790.1 of the California Government Code authorizes cities to collect delinquent refuse bills via a special assessment to be collected with county taxes; and WHEREAS, Section 5473 of the Health and Safety Code allows any entity, by a two-thirds vote of the members of the legislative body, to elect to have refuse and garbage collection on the property tax roll; and WHEREAS, the City Council by a vote of at least two-thirds of its members adopted Resolution No. 2023.067 which provides for collection of delinquent refuse bills in accordance with California Government Code Section 38790.1; and WHEREAS, in accordance with Resolution No. 2023.067, property owners can pay their delinquent refuse bill following the July 18, 2023 public hearing, without delaying the submittal of the list of delinquent amounts per parcel to the County. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Each delinquent refuse bill shall be increased by an amount not to exceed the actual costs incurred by the County of Los Angeles, and charged to the City of Lynwood for placing the delinquent refuse bills on the property tax roll via a special assessment, in addition to the administrative costs incurred by the City for placing the delinquent charges on the tax roll. Section 2. Each delinquent refuse bill shall be increased by the City's administrative costs to compensate the City for administrative costs incurred for collecting delinquent refuse bills via a special assessment. Section 3. The list of properties and the amount to be collected attached as Exhibit "A," shall be forwarded to the County Assessor for posting on the tax bill as a special assessment. Exhibit "A", including the parcels and amounts, may be modified prior to placing the delinquent bills on the property tax roll where delinquent refuse charges are paid following the July 18, 2023 public hearing.
