November 21, 2019
The Leesburg Planning Commission met on Thursday, November 21, 2019 in Town Hall
Council Chambers, 25 West Market Street, Leesburg, Virginia 20176. Staff members present
included Susan Berry Hill, Mike Watkins, Barbara Notar, Tina Newton, and Karen Cicalese.
CALL TO ORDER
The meeting was called to order at 7:00 pm by Vice Chair Nacy.

Mr. Watkins explained that The Town of Leesburg Town Council was the applicant for this
application and the purpose of this application was to designate corresponding zoning districts
pursuant to TLZO Sec. 4.3 Zoning Upon Annexation. More specifically it will be a Boundary
Line Adjustment. The State Code of Virginia provides enabling legislation for localities that
allows the Town to designate whether it's temporary or pending the orderly amendment of the
ordinance zoning designations to properties. There are three options in the Zoning Ordinance that
allows the Town to do these designations.
Mr. Watkins gave an overview of the Boundary Line Adjustment Process as follows:
• Initiated by the Leesburg Town Council and the Loudoun County Board of Supervisors
• Several meetings have been held with the property owners representatives
• Prepared two new zoning districts to continue County development approvals
• At this meeting the Planning Commission will recommend the designation of appropriate
zoning districts for the property
• Town Council and the Board of Supervisors will hold public hearings (The Board of
Supervisors has already held their public hearing)
• The Boundary Line Agreement is forwarded to the Court for Approval
The subject properties are part of the Joint Land Management Area (JLMA) which is an
interjurisdictional policy regarding the area surrounding the Town of Leesburg. This policy
permits Boundary Line Adjustments (BLAs) to incorporate land into the Town. The subject
properties are part of an area identified as Area 1-A.
This application proposes to designate zoning districts which would permit by -right development
utilizing the underlying zoning district development standards. The designated districts include B-
35 I-1, MA, R -E, and two new zoning districts, PD -CC -SC and PD -IP. The pending PD -CC -SC
and PD -IP districts were reviewed by the Planning Commission with the zoning text amendment
TLOA-2019-0007.
Mr. Watkins explained that the rezoning, if approved, will not occur until the BLA is approved by
the Court. The Town Council public hearing is scheduled for November 26, 2019 and will include
the Zoning Text Amendments for PD -CC -SC and PD -IP, the Zoning Designations being reviewed
at this meeting, and the Boundary Line Agreement.
Mr. Watkins gave an overview of the subject properties and proposed designations.
Mr. Watkins completed his presentation with an overview of suggested findings and staff's
recommendation of approval.

What is the estimated tax benefit to the Town?

Barbara Notar, Town Attorney, answered that it is estimated that the tax revenue to the General
Fund is over $800,000 annually.
Has Council already adopted the Zoning Designations?
Mr. Watkins explained that the list of designated districts includes the pending text amendment
for the Town's version of the PD -CC -SC and PD -IP designations.
Will this all be done on at the November 26th Town Council public hearing?
Mr. Watkins explained that the Council will either adopt or modify the pending text amendment
and then take action on the other two items.
Why is one parcel designated as I-1 and not PD -CC -SC or PD -IP?
Mr. Watkins replied that it had to do with conversations regarding restricted provisions of the
ordinance in terms of implementing the proffers. This is the closest district that would facilitate
the future intended use for the property.
How long will the BLA process take once the Town and County have both petitioned the Court?
Ms. Notar responded that they were hoping that it would be a matter of weeks.
What would happen if the BLA does not go through?
Mr. Watkins explained that everything that is going before Council is contingent upon the BLA.
The public hearing was closed at 7:22 PM.
Commissioner Lanham moved that Rezoning Amendment Application TLZM-2019-0002,
Compass Creek Properties, be forwarded to the Town Council with a recommendation of
approval on the basis that the Approval Criteria of Zoning Ordinance Sections 3.3.15 have been
satisfied and that the proposal would serve the public necessity, convenience, general welfare
and good zoning practice.
Commissioner Walker seconded the motion and the motion carried by a vote of 7-0.

Elections
Commissioner Nacy was elected as Interim Chair
Commissioner Robinson was elected as Interim Vice Chair
Commissioner Lanham remains as Parliamentarian
Quorum for Janaury 2, 2020 Meeting
Ms. Berry Hill asked the Commission members regarding their availability to attend the January
2, 2020 meeting. It was determined that the majority of members will be available to meet on
January 2nd
H-2 Work Group
Ms. Berry Hill informed the Commission that they will be reconvening the H-2 Work Group and
that both Commissioners Lanham and Robinson served previously and will be serving again.
Their first meeting will be held on Tuesday, November 26th. She asked if one of the other
Commission members would be available to serve as a backup. It was determined that more
specific information regarding when they would meet was needed to determine their availability
to be a back up.
