A RESOLUTION: AUTHORIZING THE TOWN MANAGER TO EXECUTE A LICENSE
AGREEMENT BETWEEN THE TOWN OF LEESBURG AND
SUMMITIG FOR TELECOMMUNICATIONS FACILITIES IN
THE TOWN'S RIGHT OF -WAY
WHEREAS, SummitlG seeks to use the Town's Right -of -Way for telecommunication
purposes; and
WHEREAS, SummitlG seeks to operate and maintain a telecommunications system for
the benefit of telephone customers, which will use public streets within the Town; and
WHEREAS, SummitlG acknowledges that the primary use of the Town's Right -of -Way
is for street purposes, and that the construction and operation shall not adversely affect such
properties primarily used for street purposes; and
WHEREAS, a License Agreement is necessary to allow the operation and maintenance of
the telecommunications system; and
WHEREAS, the Town Attorney has negotiated a License Agreement between the Town
and SummitlG to install, operate and maintain the telecommunications system; and
WHEREAS, SummitlG has agreed to install fiber optic lines for the use of the Town on
future projects as part of this license agreement; and
WHEREAS, the term of the License Agreement will be five (5) years; and
WHEREAS, SummitlG has approved the License Agreement; and
WHEREAS, the terms contained in the License Agreement are reasonable and equitable
and will benefit the Town.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute the License Agreement with SummitlG in a form
approved by the Town Attorney.
