A RESOLUTION: APPROVE AND AUTHORIZE THE TOWN MANAGER TO EXECUTE
DESIGN CHANGE ORDER NO. 3 IN THE AMOUNT OF $49,475 FOR
THE WEST MARKET STREET SIDEWALK IMPROVEMENT
PROJECT FROM AYR STREET TO MORVEN PARK ROAD
WHEREAS, the original design contract for the West Market Street Sidewalk
Improvement Project from Ayr Street to Morven Park Road was awarded to Clark Nexsen Inc. in
the amount of $199,219; and
WHEREAS, two change orders have been previously authorized on this project totaling
$18,170.00 which results in a current contract amount of $217,389; and
WHEREAS, Change Order No. 3 is necessary to complete the design of a complete
watermain replacement with this project in the amount of $49,475, and results in a revised contract
value of $266,864; and
WHEREAS, the contractual increase by Change Order No. 3 causes the contract amount to
be exceeded by the greater of 25% or $50,000; and
WHEREAS. the Virginia Public Procurement Act and the Town's Procurement Policy
require that change orders that cause the contract to be exceeded by the greater of 25% or $50,000
be approved by Town Council; and
WHEREAS, the West Market Street — Ayr Street to Morven Park Road Sidewalk
Improvements and the Town -wide Waterline Improvements and Repairs projects have sufficient
funds in their budgets to cover the associated costs; and
WHEREAS, the Director of Public Works and Capital Projects and the Director of Utilities
recommend approval of this change order.

A DESIGN CHANGE ORDER IN THE AMOUNT OF $49,475 FOR THE
WEST MARKET STREET — AYR STREET TO MORVEN PARK ROAD
SIDEWALK IMPROVEMENTS PROJECT
THEREFORE. RESOLVED, by the Council of the Town of Leesburg in Virginia that
Change Order No. 3 in the amount of $49,475 is hereby approved, and the Town Manager is
authorized to execute Change Order No. 3 to the design contract with Clark Nexsen Inc. for the
West Market Street Sidewalk Improvement Project from Ayr Street to Morven Park Road in the
amount of $49,475.
