HomeMy Public PortalAbout2019_09_10_O014 TLOA-2019-0005 Public Fleet Storage and MaintenanceThe Town of Leesbur Virginia ORDINANCE NO. 2019-0-014 PRESENTED: September 10, 2019 ADOPTED: September 10, 2019 AN ORDINANCE: AMENDING ZONING ORDINANCE ARTICLES 6, 9, AND 18 TO ESTABLISH A GOVERNMENTAL VEHICLE AND EQUIPMENT MAINTENANCE, STORAGE AND SERVICE FACILITY USE IN THE I-1 DISTRICT WHEREAS, the Town Council initiated zoning text amendment TLOA-2019-0005 on May 28, 2019 by adopting Resolution No. 2019-083 authorizing Zoning Ordinance amendments to amend the Industrial/Research Park (I-1) zoning district to allow government vehicle and equipment maintenance, storage, and service facilities; and WHEREAS, the County of Loudoun currently owns industrially zoned land within the Leesburg's Town Limits; and WHEREAS, this useis not currently allowed in the I-1, and the district must be amended in order to allow the use; and WHEREAS, a duly advertised Planning Commission public hearing was held on August 1, 2019; and WHEREAS, at their August 1, 2019, meeting, the Planning Commission recommended approval of this amendment to the Zoning Ordinance to the Town Council; and WHEREAS, the Town Council held a duly advertised public hearing on these amendments on September 10, 2019; and WHEREAS, the Council has concluded that the approval of these amendments to the Zoning Ordinance would be in the public interest and in accordance with sound zoning and planning principles; and -2- AN ORDINANCE: AMENDING ZONING ORDINANCE ARTICLES 6, 9, AND 18 TO ESTABLISH A GOVERNMENTAL VEHICLE AND EQUIPMENT MAINTENANCE, STORAGE AND SERVICE FACILITY USE IN THE I-1 DISTRICT WHEREAS, the Council has concluded that the approval of the amendments to the Zoning Ordinance is rationally related to serving legitimate government interests, including balancing the needs of the community and managing safety concerns. The Council of the Town of Leesburg, Virginia hereby ORDAINS: SECTION I. The zoning text amendments contained in TLOA 2019-0005 — establishing governmental vehicle and equipment maintenance, storage, and service facility use in the I-1 District, is hereby approved; and SECTION II. That the sections of the Zoning Ordinance of the Town of Leesburg, Virginia, 2003, as amended, be and the same are hereby amended to read as follows: Sec. 18.1 Definitions 18.1.66.1 Fleet Storage, Public A paved enclosed parking area, with access to a public street, used for the maintenance, servicing, outfitting, or repair of fleet vehicles generated by a duly constituted local, county, state, or federal government or agency. 18.1.66.2 Fleet Vehicle, Public A vehicle or piece of equipment owned and/or operated by a duly constituted local, county, state or federal government or agency used in conducting the primary purpose of the government or agency. A. Fleet Storage. This use is limited to the storage of public government fleet vehicles,,-_ as defined below in "Fleet Vehicle, Public". B. Intensity. This use is limited to no more than 60% of the property. Property is defined as an individual subdivided lot. C. Location. This use shall be limited to the rear and side of existing buildings. D. Yard Requirements. The storage site of any fleet vehicle may not be located within any buffer yard required in Section 12.8 Buffer Yards and Screening. E. Compatibility. This use shall not be located closer than 500 feet to any residential use or residential zoning district. F. Lighting: Light fixtures shall comply with Section 12.11 Outdoor Lighting. On -site lighting levels shall be limited to a maximum of 1.0 foot-candles. G. Fleet Maintenance. Vehicle maintenance may be permitted as an accessory use to fleet storage if requested as part of the original minor special Exception approval, but is limited to existing buildings or within an expansion to an existing building shown on the minor special exception plat. All such vehicle maintenance shall be conducted within an enclosed building. H. Screening. The fleet storage area shall be completely enclosed by an opaque screen at least six (6) feet in height. I. Pavement Marking. Pavement marking is not required for Individual spaces. J. Interior Parking Lot Landscaping. This use is exempt from the interior parking lot landscaping requirements in Section 12.6. K. Stormwater Management. This use is subject to any applicable stormwater management requirements for "Hot Spots" in the Design and Construction Standards Manual (DCSM). SECTION IV. All prior ordinances in conflict herewith are hereby repealed. SECTION V. Severability. If a court of competent jurisdiction declares any provision of this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of this ordinance. - SECTION VI.
