HomeMy Public PortalAbout2019_11-26_O022 TLZM 2019-0002, Compass Creek PropertiesThe Town of Leesburg, Virginia PRESENTED: ORDINANCE NO. 2019-0-022 ADOPTED: November 26, 2019 November 26, 2019 AN ORDINANCE: APPROVING TLZM 2019-0002, COMPASS CREEK PROPERTIES TO REZONE PERTINENT PROPERTIES B-3, COMMUNITY RETAIL; MA, MUNICIPAL AIRPORT SPECIAL PURPOSE DISTRICT; I-1, INDUSTRIAL/RESEARCH PARK DISTRICT; PD-CC-SC, PLANNED DEVELOPMENT -COMMERCIAL CENTER -SMALL REGIONAL CENTER; DP-IP, PLANNED DEVELOPMENT INDUSTRIAL PARK; R-E, SINGLE-FAMILY RESIDENTIOAL ESTATE DISTRICT IN CONJUNTION WITH A CORPORATE BOUNDARY LINE ADJUSTMENT TO INCORPORATE PERTINENT PROPERTIES INTO THE TOWN OF LEESBURG WHEREAS, on September 11, 2018 Town Council approved Resolution 2018-117 to initiate steps to incorporate a portion of the Leesburg Joint Land Management Area identified as Area lA and further known as Compass Creek; and WHEREAS, on August 13, 2019 Town Council directed staff and Planning Commission to incorporate the relevant County zoning district regulations into the Town of Leesburg Zoning Ordinance to facilitate the incorporation of pertinent County parcels; and WHEREAS, on October 15, 2019 Leesburg Planning Commission held a public hearing on Zoning Ordinance text amendments to add the Town's version of PD-CC-SC and PD-IP districts; and WHEREAS, the Planning Commission recommended approval of adding these two new zoning districts, PD-CC-SC and PD-IP, to the Town of Leesburg Zoning Ordinance; and WHEREAS, on November 21, 2019, the Leesburg Planning Commission held a public hearing on, and recommended approval of, remapping of the following parcels to the ascribed districts: • PIN 234-39-9964 from County zoning (PD-CC-SC) to Town B-3 • PINs 233-18-8634-001 and 195-25-8128-001 from County zoning (PD-IP and JLMA20) to Town MA -2- AN ORDINANCE: APPROVING TLZM 2019-0002, COMPASS CREEK PROPERTIES TO REZONE PERTINENT PROPERTIES B-3, COMMUNITY RETAIL; MA, MUNICIPAL AIRPORT SPECIAL PURPOSE DISTRICT; I-1, INDUSTRIAL/RESEARCH PARK DISTRICT; PD-CC-SC, PLANNED DEVELOPMENT -COMMERCIAL CENTER -SMALL REGIONAL CENTER; PD-IP, PLANNED DEVELOPMENT INDUSTRIAL PARK; R-E, SINGLE-FAMILY RESIDENTIAL ESTATE DISTRICT IN CONJUNTION WITH A CORPORATE BOUNDARY LINE AGREEMENT TO INCORPORATE PERTINENT PROPERTIES INTO THE TOWN OF LEESBURG • Portion of PINS 234-39-9964, 235-20-1426, 235-20-1426-001, 234-29-0522 and 234- 29-4515 from County zoning (PD-CC-SC) to Town PD-CC-SC • PIN 234-48-3058-001 from County zoning (PD-IP) to Town PD-IP • PIN 233-17-6768 from County zoning (AR1) to Town R-E • PIN 234-38-2798 from County PD-IP to Town I-1; and WHEREAS, on November 26, 2019 the Town Council held a duly advertised public hearing on this application; and WHEREAS, the Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, the Council of the Town of Leesburg in Virginia hereby ordains: SECTION 1. Rezoning application TLZM-2019-0002, Compass Creek Properties as identified above, and as depicted on the attached "Town of Leesburg Proposed Boundary Line Adjustment 2019 And Rezoning Map" is hereby approved; and SECTION 2. Severability: If a court of competent jurisdiction declares any provision of this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of this ordinance; and -3- AN ORDINANCE: APPROVING TLZM 2019-0002, COMPASS CREEK PROPERTIES TO REZONE PERTINENT PROPERTIES B-3, COMMUNITY RETAIL; MA, MUNICIPAL AIRPORT SPECIAL PURPOSE DISTRICT; I-1, INDUSTRIAL/RESEARCH PARK DISTRICT; PD-CC-SC, PLANNED DEVELOPMENT -COMMERCIAL CENTER -SMALL REGIONAL CENTER; PD-IP, PLANNED DEVELOPMENT INDUSTRIAL PARK; R-E, SINGLE-FAMILY RESIDENTIAL ESTATE DISTRICT IN CONJUNTION WITH A CORPORATE BOUNDARY LINE AGREEMENT TO INCORPORATE PERTINENT PROPERTIES INTO THE TOWN OF LEESBURG SECTION 3. This zoning will be effective at such time as the Loudoun County Circuit Court approves the Boundary Line Agreement for these properties and it shall not be effective if such BLA is not approved by the Circuit Court.
