A RESOLUTION: VETERANS OF FOREIGN WARS SANITARY SEWER PUBLIC
FACILITIES PERMIT GRANT
WHEREAS, the Veterans of Foreign Wars (VFW) Post 1177 facility located at 401 Old
Waterford Road desires to connect to the Town's sewer system; and
WHEREAS, the facility is currently served by a failing septic system; and
WHEREAS, it is in the best interest of the community to discontinue use of failing septic
systems and connect to the municipal sanitary collection and treatment system; and
WHEREAS, in a letter dated September 13, 2019, VFW Post 1177 requested financial
assistance to update the current sanitary sewer service; and
WHEREAS, the Town's Utilities Fund is a self-supporting enterprise fund with revenue
from utilities charges and fees and is not enabled to waive fees; and
WHEREAS, the public facilities permit for sanitary sewer connection for VFW Post 1177
is $7,512; and
WHEREAS, Code of Virginia Section § 15.2-953 (Donations to charitable institutions and
associations, volunteer and nonprofit organizations, chambers of commerce, etc.) authorizes
localities to make appropriations of public funds to charitable institutions or associations within
their respective limits if such entities provide services to residents of the locality; and
WHEREAS, the Fiscal Year 2020 General Fund operating budget for the Town Council
includes $10,000 to be used for granting fee waivers.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia that the
Town Council hereby approves a grant from the Fiscal Year 2020 General Fund Town Council

operating budget equivalent to the sanitary sewer public facilities permit cost not to exceed $7,512
to VFW Post 1177 for which the grant payment will be made by the Town once VFW Post 1177
submits a zoning permit to the Town for the necessary sanitary service work, and upon execution of
the Town's Community Agency Agreement.
