HomeMy Public PortalAbout2019_10_15_R158 Initiation of Zoning Text Amendment - Development of Zoning Regulations for Architetural Design for the Eastern Gateway DistrictThe Town of Leesburg, Virginia PRESENTED: RESOLUTION NO. 2019-158 ADOPTED: October 15, 2019 October 15, 2019 A RESOLUTION: INITIATION TO AMEND ZONING ORDINANCE ARTICLES 7 AND 18 TO .ESTABLISH A NEW ARCHITECTURAL DESIGN OVERLAY DISTRICT FOR AREAS WITHIN THE EASTERN GATEWAY DISTRICT WHEREAS, the Town has developed a small area plan entitled the Eastern Gateway District Small Area Plan for a corridor area between the Route 7 Bypass and the corporate limits of Town; and WHEREAS, the Town Council wishes to implement the policies of this small area plan by developing a new architectural control overlay district particularly for areas designated in the small area plan for mixed land use; and WHEREAS, this new zoning overlay district may include regulations that address site planning objectives by using zoning methods such as form -based zoning; and WHEREAS, this new zoning overlay district will include regulations to address desired architectural outcomes that are compatible and complementary to the historic architectural aesthetic of Leesburg and which are based on periods of architectural significance in the Town of Leesburg; and WHEREAS, the public necessity, convenience, general welfare, and good zoning practice require the proposed amendments. THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as follows: -2- A RESOLUTION: INITIATION TO AMEND ZONING ORDINANCE ARTICLES 7 AND 18 TO ESTABLISH A NEW ARCHITECTURAL DESIGN OVERLAY DISTRICT FOR AREAS WITHIN THE EASTERN GATEWAY DISTRICT SECTION I. Amendments to the Zoning Ordinance are hereby initiated, and referred to the Planning Commission to establish a new architectural design control overlay district that may include site design regulations and will include architectural design regulations to achieve design objectives for East Market corridor as envisioned in the Eastern Gateway District Small Area Plan and which will be compatible with the historic periods of significance in Leesburg. SECTION II. Staff will return to Council by January 2020 with cost estimates to hire consulting services for the project and receive funding authorization from Council prior to proceeding with the selection of architectural consulting services for the project. SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Zoning Ordinance, and report its recommendation to the Town Council pursuant the Section 15.2-2204 of the 1950 Code of Virginia, as amended.
