A RESOLUTION: CONDITIONAL APPROVAL OF SANITARY SEWER EXTENSION TO
SAGE HILL FARM
WHEREAS, Mr. Rene Dennis on behalf of Sage Hill Farm LLC., (the "Applicant")
requests approval of Town sanitary sewer extension to a proposed single family dwelling at 42740
Edwards Ferry Road, Leesburg Virginia 20176 on the Sage Hill Farm parcel of land ("Sage Hill
Farm") (PIN 147477733000); and
WHEREAS, Sage Hill Farm is located outside the Town's corporate limits, but within the
Town and County Joint Land Management Area (JLMA), and within the Town's existing sanitary
sewer service area; and
WHEREAS, existing Town sanitary sewer infrastructure is located within the vicinity of
Sage Hill Farm; and
WHEREAS, existing sanitary sewer pro-rata agreements identify Sage Hill Farm as a
"Benefitted Parcel" and/or a "named property" and therefore the Applicant is responsible for sewer
pro-rata payments due under these agreements; and
WHEREAS, the Director of Utilities recommends approval of the extension of Town
sanitary sewer service for Sage Hill Farm so long as the conditions set forth in this Resolution are
met by the Applicant.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The extension of municipal sanitary sewer service for Sage Hill Farm is

approved in accordance with Section 34-123 of the Town Code so long as the following conditions
are met by the Applicant:
1. All sewer connection, availability, sanitary sewer pro-rata share, and any other applicable
fees for water and sanitary sewer services shall be paid prior to the issuance of a Building
Permit issued by Loudoun County and occupancy.
2. All sanitary sewer flow will be by gravity. A public sanitary sewer pump station will not
be approved.
3. The average daily water demand and sanitary sewer flow from the proposed house at
42740 Edwards Ferry Road, Leesburg VA 20176 will not exceed 350 gpd.
4. A single sanitary sewer lateral connection from the proposed house to the Town's sewer
main is hereby granted. Additional proposed connections to the Town's sewer main from
Sage Hill Farm parcel would require separate connections and additional availability fees.
5. The Town Council must approve or deny any subsequent request, via a subsequent Town
Council Resolution, for increased sanitary sewer flow capacities over and above the
quantities set forth in this Resolution.
6. The Town Council must approve or deny a request for water extension to Sage Hill Farm.
7. Based on the extension of Town sanitary sewer service to Sage Hill Farm, the Town
anticipates that Sage Hill Farm will be incorporated into the Town boundaries in the future,
either by Boundary Line Agreement or Annexation, as provided for in the Town Plan.
8. Nothing herein shall be deemed a "holding out" by the Town as the sole sanitary sewer
provider outside its boundaries in this vicinity nor shall it operate as a commitment to

provide such services to any party other than the Applicant or for any purpose other than the
purposes stated herein.
SECTION II. The Town shall not provide sanitary sewer service to Sage Hill Farm until
all conditions set forth in Section I above are met.
SECTION III. The approval of extension of sanitary sewer service for one single family
dwelling and the accompanying conditions shall apply to any subsequent purchaser of the
parcels listed in this Resolution, and/or successor or assignee of the Applicant.
