HomeMy Public PortalAboutResolution 22-25 Designating Cougar Island in Payette Lake as an "Area of Critical Concern"City of McCa11 RESOLUTION 22-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, VALLEY COUNTY, STATE OF IDAHO DESIGNATING COUGAR ISLAND IN PAYETTE LAKE AS AN "AREA OF CRITICAL CONCERN". WHEREAS, Chapter 7 of Title 9 of the McCall City Code and the parallel provisions in the Valley County Impact Area Code set forth Special Subdivision Development Standards with the purpose to identify various types of developments that normally pose special concerns to the city and county when reviewing and acting upon subdivision requests; and WHEREAS, section 9.7.08 of the McCall City Code and the parallel provisions in the Valley County Impact Area Code specifically provide for the City Council to designate areas of critical concern with hazardous or unique characteristics, including areas within the area of city impact outside the city boundaries; and WHEREAS, section 9.7.08 of the McCall City Code and the parallel provision in the Valley County Impact Area Code further provides for the preparation of an environmental assessment prepared by professionals for areas designated as an area of critical concern; and WHEREAS, the City and Valley County have significant concerns about the effect of future development on Cougar Island and the resulting impact on water quality because Big Payette Lake is the City's sole drinking water source; and WHEREAS, Cougar Island is an island on Big Payette Lake and within the area of city impact; and WHEREAS, the current zoning on Cougar Island is Rural Residential designation and is the least intense residential designation in the Impact Area and is intended to guide development away from unsuitable areas, to preserve ecologically sensitive and important recreation areas. This zone allows for the development of single-family homes on significant acreage at a maximum density of one dwelling unit per ten (10) acres; and WHEREAS, Cougar Island has already been subdivided into 5 parcels but such subdivision was not done according to Valley County adopted ordinances and codes. Each of these parcels, if sold, is subject to Valley County's McCall Impact Area development codes and standards including Design Review/Payette Lake Shoreline Environs Zone and providing for required infrastructure for further development; and WHEREAS, State Land Board adopted the Payette Endowment Land Strategy (PELS) in March 2021. Cougar Island is identified as Parcel M and in Tier One of the PELS which slates it for disposition within 1- 5 years of adoption of PELS; and Page 1 of 3 Resolution 22-25 August 11, 2022 WHEREAS, the Idaho Department of Lands (IDL) plans to auction Parcel M in August or September 2022, either by individual lots or by the whole. It is estimated the base bid will be advertised at approximately $10.5 million; and WHEREAS, Cougar Island meets the purpose and intent for designation of an area of critical concern by its size, natural environmental site features, potential impacts on established neighborhoods within the Impact Area, the special provision of the Comprehensive Plan for this area and the transportation and infrastructure needed for development of the property. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCCALL, IDAHO THAT: THE PROPERTY KNOWN AS COUGAR ISLAND STATE SUBDIVISION, LOTS 1-5, BLOCK 1, OWNED BY IDAHO DEPARTMENT OF LANDS, AND OTHERWISE IDENTIFIED AS VALLEY COUNTY ASSESSOR PARCELS, XR006650010010, XR006650010020, XR006650010030, XR006650010040, AND XR006650010050 BE DESIGNATED AS AN AREA OF CRITICAL CONCERN REQUIRING THE PREPARATION OF AN ENVIRONMENTAL ASSESSMENT AS PART OF DEVELOPMENT APPLICATION REVIEW PROCESS. THIS DESIGNATION IS SUBJECT TO RATIFICATION BY THE VALLEY COUNTY BOARD OF COMMISSIONERS ACTING PURSUANT TO THEIR AUTHORITY UNDER Article XII, Sec. 2, Idaho Constitution.
