HomeMy Public PortalAbout007-1996 - Rezoning - 300 South 4th StreetA SPECIAL ORDINANCE AMENDING THE ZONING MAP AT 300 SOUTH 4TH STREET WHEREAS the zoning map designates real estate at 300 South 4th Street as R-3 Special Use for Professional Office, and WHEREAS it is desirable to change the zoning designation to R-3 Special Use for Village Industry, NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the zoning designation of the real estate at 300 South 4th Street, which is more particularly described in Exhibit A attached hereto, is hereby changed to R-3 Special Use for Village Industry. The Special Use District does not stand by itself but shall be combined with an existing zoning district. The Special Use will not be injurious to the use and enjoyment of other property in the irnmediafe vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood for the following reasons: The proposed use of the property along with off street parking will not cause any additional street parking spaces in front of other residences' or business'. 3. The establishment of the Special Use will not impede the normal and orderly development and improvement of the surrounding property for uses permitted in the district for the following reasons: The property is already being used under the special use designation with no apparent ill effects. 4. Adequate utilities, access roads, drainage, buffering and other necessary facilities will be provided for the following reasons: These things already exist with the current use and will not need to be altered. 5. Adequate measures will be taken to provide ingress arid egress so designed as to minimize traffic congestion in the public streets for the following reasons: This property contains off street parking for up to 6-8 cars which should be adequate for indicated use. The following narrative is the Petitioner's detailed description of the Special Use being requested: The special use request is to enable the sale of books, candies, small amounts of bulk herbs and herbal teas. Also, there will be an amount of hand made jewlery, crystals, gemstones and greeting cards. The Site Plan submitted is to be drawn on unlined paper at an engineering scale, with a north arrow and shall show the following: 1. All property lines 2. Location of existing building(s) 3. Location of proposed building(s) and/or additions 4. Location of off street parking and loading spaces 5. Existing and proposed dimensions shall be given for the following: a. Property lines b. Existing building(s) C. Proposed building(s) and/or additions d. Building setbacks from all property lines 6. Location of existing and proposed utilities lines and sewers 7. Location of existing and proposed curb cuts 8. Arrows indicating the direction of flow of surface storm water and location of existing and proposed storm water drainage facilities 9. Location and type of existing and proposed fencing, screening, and landscaping 10. BEVER City Attorney This ordinance relates to rezoning request of 300 South 4th Street from a R-3 Special Use for Professional Office to a R-3 use "Village Industry". You may reacall that certain additional special uses are allowed in a R-3 zoning area if the property is within a Historic District. To determine if the request meets the requirements you can review Richmond Code 154.22.01.03. The property is owned by Tom Talton. The ordinance should be referred to Plan Commission for public hearing at its meeting on March 26, 1996. The ordinance could be back to Council for second reading on April 1, 1996.
