HomeMy Public PortalAboutOrdinance 93-7361 1 ORDINANCE NO. 93 -736 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING THE DOWNTOWN SPECIFIC PLAN AND CHANGING THE ZONING TO THE "DOWNTOWN SPECIFIC PLAN" (DSP) CLASSIFICATION THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS: SECTION 1. Based upon information provided in the Downtown Specific Plan, Environmental Impact Assessment, Planning Commission staff report and Planning Commission minutes of January 12, 1993, information and discussion provided in the City Council staff report dated February 16, 1993, and based upon the City Council public hearing of February 16, 1993, the City Council hereby adopts the Downtown Specific Plan and rezones the area depicted on the attached maps, labelled as Exhibits A and B to the Downtown Specific Plan (DSP) classification. SECTION 2. The Downtown Specific Plan (DSP) zoning classification shall be codified and referenced in the Zoning Code as follows: CHAPTER 1 - ZONING CODE PART XIV - COMMERCIAL DISTRICTS DIVISION IV - DOWNTOWN SPECIFIC PLAN (DSP) 9400. DOWNTOWN SPECIFIC PLAN Ordinance No. 93 -736 enacts a Specific Plan for the downtown area. Said Specific Plan identifies land use districts, with a matrix of permitted uses and conditionally permitted uses. Said Specific Plan establishes development standards, development incentives/bonuses, design guidelines, sign regulations and other requirements and criteria to ensure the orderly development of the area. Reference is made to said Ordinance and Specific Plan document for the detail of said Plan, which shall override all other zoning regulations with regard thereto, except as specifically contained therein. SECTION 3. Zoning within the Downtown Specific Plan area is hereby changed as shown on the attached map, labelled as Exhibit A. Said properties are currently designated as C -2, C -1, R -3 and R -2 and shall be redesignated as DSP. SECTION 4. Zoning within the Downtown Specific Plan area shall be designated on the City's Zoning Map as DSP. Within the Downtown Specific Plan (DSP) area, subcategories of land use designations shall apply, as shown on the attached map labelled as Exhibit B. SECTION b. The Downtown Specific Plan shall replace and supplant the existing Zoning Code within the area designated on the attached maps labelled as Exhibits A and B. Provided however, the Zoning Code shall continue to govern those regulatory areas not specifically addressed by the Downtown Specific Plan. SECTION 6. Adoption of the Downtown Specific Plan and this rezoning is based upon the following findings: 1. With the exception of a limited number of properties, which are currently zoned as R -2 or R -3, land within the Specific Plan area is currently zoned as Commercial, either C -1 or C -2. Properties being redesignated from a non - commercial classification to a commercial classification are in proximity to the downtown area and would benefit from the latitude provided for in the Downtown Specific Plan. (Said properties are specifically referenced by address in the General Plan Amendment contained in Resolution 93 -3212 and are shown on the attached map labelled as Exhibit A. 3. The Downtown Specific Plan is a result of an extensive year long effort to complete a comprehensive document to effectuate downtown revitalization and renewal and provide for the long term prosperity and vitality of the City's commercial core. 4. While the Downtown Specific Plan necessitates certain zone changes, as shown on Exhibit A, it will not significantly alter the existing land use pattern. This zone change has been evaluated in terms of CEQA requirements, as indicated below, and is not anticipated to result in adverse impacts to adjacent areas or the community in general. SECTION 7. The completed Environmental Assessment concludes that the project will have no significant affects upon the environment and a mitigated declaration should be approved in accordance the State CEQA Guidelines. The initial statement as prepared indicates that there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 8. The City Clerk shall certify to the passage and adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Foothill Star Tribune, a newspaper circulated in the City of Temple City.
