WfiEREAS, the Town of Gulf Stream has the home rule
'powers granted unto municipalities by the Constitution of
the State of Florida; and
�J WHEREAS, the Town of Gulf Stream, pursuant to the
Constitution and laws of the State of Florida, has the
authority to exercise all powers for municipal government
purposes; and
WHEREAS, the Town of Gulf Stream is charged with the
responsibility of protecting the health, safety and general
welfare of its citizens; and
WHEREAS, the Town of Gulf Stream has no commercial
zoning but is impacted by the presence of adult
entertainment establishments located in adjacent
municipalities; and
WHEREAS, the Town of Gulf Stream and other local
governments have compelling state interest in regulating
adult entertainment establishments to protect the citizens
of the Town of Gulf Stream and the County from the negative
secondary effects of adult entertainment establishments; and
WHEREAS, there is a proliferation of adult
entertainment establishments in Palm Beach County; and
WHEREAS, the Town Commission of the Town of Gulf Stream
believes the most effective regulation of existing and
future adult entertainment establishments in Palm Beach
County must involve the cooperation of municipal, county and
state governmental entities, and the state and local law
enforcement agencies.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS:
Section 1. In order to further the compelling state
interest of protecting the citizens of the Town of Gulf
Stream and Palm Beach County from the adverse secondary
effects of adult entertainment establishments, the Town
Commission of the Town of Gulf Stream recommends the
creation of a task force consisting of legal and
administrative officials from municipalities, Palm Beach
County, the Palm Beach County Sheriff's Office, State of
Florida Division of Alcohol, Beverages and Tobacco, and the
Office of the State Attorney of the Fifteenth Judicial
Circuit.
Section 2. The purpose of the above - referenced task
force would be to evaluate existing regulations which
pertain to the regulation of adult entertainment
establishments and to recommend ways to strengthen the
regulation of adult entertainment establishments so as to
further the compelling state interest of protecting the
public from the adverse secondary effects of adult
entertainment establishments.
Section 3. The Town Clerk is hereby directed to
transmit copies of this resolution to the Palm Beach County
League of Cities and the Palm Beach County Board of County
Commissioners.
Section 4. This Resolution shall take effect
immediately upon adoption.
