HomeMy Public PortalAboutOrdinance 824ORDINANCE NO. 824 AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT,CALIFORNIA, ADOPTING A ZONE CHANGE TO PRE -ZONE 332 ACRES OF LAND FROM COUNTY OF RIVERSIDE W-2 (CONTROLLED DEVELOPMENT) TO CITY OF BEAUMONT SP -A (SPECIFIC PLAN AREA) AND TO PRE -ZONE THE NOBLE CREEK PARK SITE FROM COUNTY OF RIVERSIDE W-2 (CONTROLLED DEVELOPMENT) AND R-1 (SINGLE-FAMILY RESIDENTIAL) TO CITY OF BEAUMONT O -S (OPEN SPACE) (ANNEXATION NO. 02-ANX-01, NOBLE CREEK VISTAS SPECIFIC PLAN) WHEREAS, the City of Beaumont has initiated the annexation of the 332 -acre Noble Creek Vistas Specific Plan and Noble Creek Park site, both County unincorporated areas, pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, and said Act requires that properties which are to be annexed to a City shall be pre -zoned prior to annexation; and WHEREAS, the current zoning designation of the subject site under the administration of Riverside County is W-2 (Controlled Development) and R-1 (Single -Family Residential); and WHEREAS, the subject site composed of the Noble Creek Vistas Specific Plan, and the proposed pre -zoning would facilitate the implementation of said project upon the completion of annexation proceedings, and the Noble Creek Park site operated by the Beaumont Cherry Valley Recreation and Parks District; and WHEREAS, duly noticed public hearings were conducted on this matter as required by law by the Planning Commission on January 22, 2002 and the City Council on February 5, 2002, and the Planning Commission, at its public hearing, recommended that the City Council approve the proposed pre -zoning. THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Official Zoning Map of the City of Beaumont is hereby amended to designate the subject property legally described in attached Exhibit "A" for the following zoning designation: SP -A (SPECIFIC PLAN AREA) - Noble Creek Vistas Specific Plan site O -S (OPEN SPACE) - Noble Creek Park site ORDINANCE NO. SECTION 2: This Ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage the City Clerk shall cause a summary to be published in a newspaper of general circulation, printed and published in the City of Beaumont, in a manner prescribed by law for publishing of ordinances of said City. SECTION 3: The City zoning designations for the subject area shall become effective upon the recordation of the annexation by the Riverside County Local Agency Formation Commission.
