ORDINANCE NO. 852 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT AMENDING CERTAIN TIME LIMITATIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE BEAUMONT REDEVELOPMENT PROJECT IN ACCORDANCE WITH HEALTH AND SAFETY CODE SECTIONS 33333.2 AND 33333.6 WHEREAS, the Beaumont Redevelopment Agency (the "Agency") has been duly created and activated pursuant to the provisions of Section 33100, et. seq. of the Health and Safety Code of the State of California by a duly adopted Ordinance of the City of Beaumont, California; and WHEREAS, the City Council, by enacting Ordinance 741 on December 27, 1993, adopted the Redevelopment Plan for the Beaumont Redevelopment Project; and WHEREAS, Senate Bill 1045, which was enacted by the State of California and became effective on September 1, 2003, added Section 33681.9 of the Health and Safety Code. Senate Bill 1045 requires a redevelopment agency to , prior to May 10, remit payment in a pre -determine amount to the county auditor for deposit into the county's Educational Revenue Augmentation Find (the "ERAF"); and WHEREAS, Senate Bill 1045 also amended Sections 33333.2 and 33333.6 of the Health and Safety Code to provide that when a redevelopment agency is required to make a ERFA payment pursuant to Section 33681.9, the legislative body may amend' a redevelopment plan to extend by one year the time limit of the effectiveness of the plan and the time limit to repay indebtedness or receive property taxes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The forgoing Recitals are true and correct and are incorporated herein by this reference. SECTION 2. The Redevelopment Plan for the Beaumont Redevelopment Project ( the "Plan") is hereby amended to extend by one year the time limit on the effectiveness of the Plan. SECTION 3. The Plan is hereby amended to extend by one year the time limit on the repayment of indebtedness or receipt of property taxes, if applicable pursuant to Health and Safety Code Section 33670. SECTION 4. If any part of this Ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portion of this Ordinance, and this City Council hereby declares that it would have passed the remainder of this Ordinance if such invalid thereof had been deleted. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law in a newspaper of genetal circulation which is and/or circulated in the City of Beaumont.
