AN ORDINANCE OF THE CITY OF BEAUMONT
AMENDING THE TRANSPORTATION UNIFORM MITIGATIO
FEE SCHEDULE OF ORDINANCE NO. 839
THE CITY COUNCIL OF THE CITY OF BEAUMONT ORDAINS AS FOLLOWS:
Section 1: Amendment.
The Schedule of Fees set forth in Ordinance No. 839 is hereby amended as
From April 1, 2005 through June 30th 2005
$ 7,248 per single family residential unit
$ 5,021 per multi -family residential unit
$ 0.52 per square foot of an industrial project
$ 2.83 per square foot of a retail commercial project
$ 1.75 per square foot of a service commercial project
From July 1, 2005 through June 30th 2006
$ 7,248 per single family residential unit
$ 5,021 per multi -family residential unit
$ 1.05 per square foot of an industrial project
$ 5.67 per square foot of a retail commercial project
$ 3.52 per square foot of a service commercial project
From July 1, 2006
$ 7,248 per single family residential unit
$ 5,021 per multi -family residential unit
$ 1.58 per square foot of an industrial project
$ 8.51 per square foot of a retail commercial project
$ 5.28 per square foot of a service commercial project
follows:
Section 2: Effective Date.
The Schedule of Fees set forth in Section 1 above shall take effect as of th date specified
in Section 3 below and shall remain effective until such time as it is further amende .
Section 3: Judicial Review.
In accordance with State law, any judicial action or proceeding to attack, re iew, set aside,
void or annual this Ordinance shall be commenced within 30 days of the adoption .f this
Ordinance.
Section 4: Effective Date.
This Ordinance shall take effect on the 31s` day following its enactment.

SUBJECT: Amendment to TUMF Ordinance No. 839 to Increase Impact Fees - Second
Reading
Background and Analysis:
On March 18, 2003, the City Council enacted Ordinance No. 839, which established the
Transportation Uniform Mitigation Fee, or TUMF Fee, which is levied and collected from new
residential, commercial and industrial development. The purpose of the TUMF Fee is to finance
the construction of regional road improvements and transportation programs. Once collected,
TUMF Fees are transmitted to the TUMF Program Administrator, who, under our Ordinance, is
the Executive Director of WRCOG, for allocation and expenditure.
At the time the Council adopted our Ordinance, it also adopted the following schedule of fees:
$6,650.00 per single family residential unit
$4,607.00 per multi -family residential unit
$1.45 per square foot of an industrial project
$7.81 per square foot of a retail commercial project
$4.84 per square foot of a service commercial project
The fee for Industrial, Retail Commercial and Service Commercial projects was adopted with a
three year phase in beginning July 1, 2004 at one-third the fee increasing July 1, 2005 to two
—thirds and July 1, 2006 the full fee will be in effect.
The Ordinance also provides that the schedule of fees be periodically reviewed and the amounts
adjusted up (or down) to reflect changes in actual and estimated costs of constructing the regional
transportation system of improvements and the implementation of regional transportation
proj ects.
In cooperation with the TUMF Administrator, staff has determined that, due to increased costs,
the schedule of fees needs to be adjusted to ensure the availability of sufficient funds. Based on
staff's evaluation, staff recommends that the fees be adjusted as follows:
$ 7,248 per single family residential unit
$ 5,021 per multi -family residential unit
$ 1.58 per square foot of an industrial project
$ 8.51 per square foot of a retail commercial project
$ 5.28 per square foot of a service commercial project
From April 1, 2005 through June 30, 2005
$ 7,248 per single family residential unit
$ 5,021 per multi -family residential unit
$ 0.52 per square foot of an industrial project
