HomeMy Public PortalAboutOrdinance 890ORDINANCE NO. 890 AN UNCODIFIED ORDINANCE OF THIS: CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA, ADOPTING A ZONE CHANGE TO PRE -ZONE 236.74 ACRES OF LAND FROM COUNTY OF RIVERSIDE W-2 (CONTROLLED DEVELOPMENT) AND R R (RURAL RESIDENTIAL)TO CITY OF BEAUMONT SPA (SPECIFIC PLAN AREA) AND O -S (OPEN SPACE, CONSERVATION AND RECREATION) (ANNEXATION NO. 05-ANX-04) WHEREAS, the City of Beaumont has initiated the annexation of a 236.74 acre unincorporated area pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, and said Act requires that properties which are to be annexed to a City shall be pre -zoned prior to annexation; and WHEREAS, the current zoning designation of the subject site, under the administration of Riverside County, is W-2 (Controlled Development) and R -R (Rural Residential); and WHEREAS, duly noticed public hearings were conducted on this matter as required by law by the Planning Commission on January 10, 2006 and the City Council on January 17, 2006, and the Planning Commission, at its public hearing, recommended that the City Council approve the proposed pre -zoning. THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Official Zoning Map of the City of Beaumont is hereby amended to designate the subject property legally described in attached Exhibit "A" for the following zoning designation: SPA (SPECIFIC PLAN AREA) O -S (OPEN SPACE, CONSERVATION, AND RECREATION) SECTION 2: This Ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage the City Clerk shall cause a summary to be published in a newspaper of general circulation, printed and published in the City of Beaumont, in a manner prescribed by law for publishing of ordinances of said City. ORDINANCE NO. 890 SECTION 3: The City zoning designations for the subject area shall become effective upon the recordation of the annexation by the Riverside County Local Agency Formation Commission. AWroved Alan Kapanakijj Beaumont City Manager L Introduction This documentation has been prepared to provide the Riverside County Local Agency Formation Commission (LAFCO) and other interested individuals and agencies with pertinent information relative governmental functions, facilities, services, costs and revenues applicable to proposed Annexation to the city of Beaumont, Califomia. The annexation consists of 36.7 acres. The subject area is largely surrounded by the incorporated City of Beaumont and can be termed as an unincorporated County Riverside "Island". The annexation proposal has been initiated by the St Clair Company, owner of the Hidden Canyon site, with the encouragement from the Local Agency Formation Commission (LAFCO) Staff and the City of Beaumont Staff, due to the increased efficiency resulting from the City of Beaumont's provision of Services, rather than the County of Riverside. The document supports the Applicant's petition by addressing all of the service related considerations applicable to the property, thereby permitting the LAFCO staff and Board Members to fully understand, evaluate and approve the annexation request. This plan of services addresses the basic level of public services which are required to support the annexation of the area to the city and the manner in which urban and municipal services will be provided. II. Planning and Statutory Considerations A. Planning Considerations The Proposed annexation area is wholly contained within the City of Beaumont's existing sphere of influence. The City of Beaumont has previously considered the ultimate land use for the subject by establishing appropriate land use designations for this area, including designations of R -SF (residential single family) consistent with applicable General Plan designations. In order to comply with the requirements of the California Environmental Quality Act, the City of Beaumont prepared an Initial Study to assess the potential environmental effects of the proposed annexation, resulting in the adoption of a Negative Declaration and a finding that the project will not result in significant impacts to the environment. B. Applicable Laws LAFCO is authorized and mandated by the State law as the agency responsible for evaluating and approving annexations to an incorporated city. Subsequent to the initial consideration of an annexation request by the applicant; a public hearing is held before the LAFCO Board where an annexation proposal is either approved, disapproved or modified. If the annexation is approved, LAFCO will designate the City as the "Conducting Authority" for the purpose of finalizing the annexation processs.. C. Count`' Zoning Land use within the proposed annexation area is presently regulated by the Riverside County comprehensive General Plan, Ordinance No. 348 and the County's Zoning Ordinance. The Zoning for the area under Riverside County is W-2, Controlled Development, a designation customarily assigned to undeveloped outlying areas. III. Service Considerations A. Circulation The project shall construct all interior roadways to full City of Beaumont Standards as adjacent development occurs in order to provide a safe and efficient circulation system through the site. The project shall participate on a fair and equitable basis in the construction of Fourth Street internal to the project to its ultimate cross-section width as a secondary (88 feet right-of-way) roadway in conjunction with development. Access to the project from Fourth Street shall be limited to the two intersections to the south and the several driveways to the proposed commercial site. The project shall participate on a fair and equitable basis in the widening ofJack Rabbit Trail from two to four lanes between State Route 60 and Fourth Street and the widening of Fourth Street from two to four lanes from the project boundary to the North-South Connector road at State Route 60. The project shall participate on a fair and equitable basis, in the phased construction of the following interim off-site roadway improvements. The widening of Jack Rabbit Trail and Fourth Street as noted in Mitigation Measure 4 above; The installation of traffic signals at: - Jack Rabbit Trail/Fourth Street - Viele Street/Sixth Street. The project shall participate, on a fair and equitable basis, in the phased construction of the following ultimate off-site roadway improvements: a. Construction of a new interchange on State Route 60 at a point approximately one mile east ofJack Rabbit Trail. b. Extension of and/or improvements to Fourth Street from Rolling Hills Ranch to Jack Rabbit Trail. c. Construction of a North-South Connector road between the new interchange and Fourth Street. d. Installation of traffic signals at: - Jack Rabbit Trail/Fourth Street - North-South Connector/State Route 60 Westbound Ramps - North-South Connector/State Route 60 Eastbound Ramps - North-South Connector,'Fourth Street. The project shall dedicate right-of-way and provide for the construction of a park-and- ride facility within the proposed corrunercial uses within the Hidden Canyon project in order to accommodate ridesharing and mass transit opportunities. Given the Caltrans' standard of one park-and-ride space per 40 dwelling units, a total of 12 spaces should be provided within the proposed commercial uses. Its location near a freeway access point offers an ideal location for such a facility �Ahi1e also being ofpositiv e value to future commercial tenants. Water and Sewer The Hidden Canyon project will be served from a 16 -inch water line located on Fourth Street as it passes through the project site. Off-site facilities to be constructed to serve the proposed project include 16,000 lineal feet of pipelines and a two million gallon water storage reservoir to be funded by a Community Facilities District. Water storage of 0.4 million gallons will be required for the proposed project. All water and sewer service improvements shall be maintained by the Beaumont -Cherry Valley Water District. The Hidden Canyon project is anticipated to generate an average of 0.20 million gallons of sewage per day. Off-site facilities to serve the proposed project include a lift station north of State Route 60, a north -south connector line under State Route 60, and a sewer main on Fourth Street to be funded by a Community Facilities District. Reclaimed water shall he used in areas of extensive landscaping including but not limited to public rights-of- way, easements and parks within the Specific Plan when reclaimed water facilities are available within close proximity of the project site. Fire Service The applicant will participate in either the existing Riverside County Fire Protection Impact Mitigation Program ($400.00 per dwelling unit and $.25 per square foot for commercial/industrial use) that provides funds for the purchase of equipment, remodel or construction of fire stations when necessary as development occurs, or participate in a fire protection impact program as adopted by the Beaumont City Council. The program shall provide for fair share funding to purchase land, build and equip a fire station or provide personnel. As the project is located in a "hazardous fire area" of Riverside County, buildings constructed within this area shall comply with the special construction provisions contained in Riverside County Ordinance No. 546, or comparable City of Beaumont requirements. All buildings shall be constructed with fire retardant roofing material as described in Section 3202 of the Uniform Building Code. Any wood shingles or shakes shall have a Class 'B' rating and shall be approved by the Fire Department prior to installation. Police Services The Beaumont Police Department has indicated that there are no current fee requirements in effect to offset impacts due to new development. However, a capital mitigation program currently in the planning process proposes a one -tune development fee and the possible formation of Community Facilities Districts to offset the cost of construction, operation, maintenance, etc. as a result of new development. Within this program, the project shall participate on a fair and equitable basis in the funding of any required police facilities and personnel needs. Police protection services to the project will also partially be paid by taxes and other revenue generated by the project. Personnel required to cover one beat is 5.2 officers. The project is estimated to generate the demand for 2.0 additional officers. Schools An estimated 439 students will be generated by the Hidden Canyon project and will require accommodations within the existing Beaumont Unified School District facilities. The developer shall cooperate with the Beaumont Unified School District in order to fully mitigate school impacts of the Hidden Canyon development. The development shall comply with the state mandated S.B.-50 requirements in order to mitigate school impacts. Parks and Recreation A eight acre community park will be constructed in Planning Area C. The proposed park is planned to include two baseball fields, a soccer field, two tennis courts, a volleyball court, a basketball court, barbecue/picnic areas, and open turf. The park will include parking for approximately 75 cars and centrally located restroom facilities. The park would also be sufficiently sized to meet City and State standards. The proposed park satisfies the requirements of the City's Park/Open Space and City Beautification Plan. Utilities Development plans will be provided to Southern California Gas Company, Southern California Edison, and General Telephone Company as they become available in order to facilitate engineering, design and construction of improvements necessary to provide services to the project site. Solid Waste The development shall be served by the cities authorized franchised refuse hauler.
