AN UNCODIFIED ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BEAUMONT,CALIFORNIA, ADOPTING A ZONE CHANGE
TO CHANGE THE ZONING FOR A 4.14 ACRE PARCEL
TO R -OB (RESIDENTIAL OVERLAY BONUS) (06-RZ-01)
LOCATION: EAST SIDE OF XENIA AVENUE, NORTH OF SIXTH STREET
(APN # 419-170-031)
WHEREAS, the City of Beaumont has received an application from Sherman & Associates
to apply Residential Overlay Bonus (R -OB) zoning to a 4.14 acre site to facilitate development of a
affordable multiple family housing project, which is described in Exhibit "A" which is attached
hereto; and
WHEREAS, the zoning designation for the subject site at the present time is C -HS
(Commercial Highway Service); and
WHEREAS, the proposed rezoning action would facilitate development of a 120 -unit low
and moderate income housing project to increase housing opportunities for various income levels in
Beaumont; and
WHEREAS, the proposed change is consistent and compatible with existing zoning
designations adjoining and in the vicinity of the subject site, and the development of the site for the
proposed use would be compatible with future land uses planned for the vicinity; and
WHEREAS, the Beaumont Planning Commission conducted a duly noticed public hearing
on December 12, 2006 and recommended that the City Council adopt the proposed zone change; and
WHEREAS, the Beaumont City Council conducted a duly noticed public hearing on January
16, 2007 as required by law on said zone change; and
WHEREAS, the Beaumont City Council adopted Negative Declaration No. 06 -ND -18 in
compliance with the California Environmental Quality Act, found the document to be adequate in its
assessment of possible environmental impacts, and determined that with the proposed mitigation the
project will not have a significant impact on the environment.
THE CITY COUNCIL OF THE CITY OF BEAUMONT DOES HEREBY ORDAIN AS
FOLLOWS:
SECTION 1: The Official Zoning Map of the City of Beaumont is hereby amended to
designate the subject property described in attached Exhibit "A" for the following zoning designation
as indicated on Exhibit "B":
R -OB (Residential Overlay Bonus)
ORDINANCE NO. 909
SECTION 2: This Ordinance shall take effect thirty (30) days after its final passage and
within fifteen (15) days after its passage the City Clerk shall cause a summary to be published in a
newspaper of general circulation, printed and published in the City of Beaumont, in a manner
prescribed by law for publishing of ordinances of said City.
