AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BEAUMONT AMENDING CHAPTER 9.04
"ALCOHOLIC BEVERAGE CONTAINERS IN PUBLIC"
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT,
RIVERSIDE COUNTY, STATE OF CALIFORNIA AS FOLLOWS:
Section 1: Chapter 9.04 entitled "Alcoholic Beverage Containers in Public", is hereby
amended in its entirety to read as specifically provided for in Exhibit "A", which Exhibit is
attached hereto and made a part hereof.
Section 2: This Ordinance shall take effect as provided by law.

CHAPTER 9.04
ALCOHOLIC BEVERAGE CONTAINERS IN PUBLIC
Sections:
9.04.010 Possession of Containers

Section 9.04.010 Possession of Containers.
No person shall have in his or her possession, while in any public park or playground,
any bottle, can, or other container containing any alcoholic beverage.
Section 9.04.020 Possession of Open Containers.
No person shall have in his or her possession, while in or upon any public park,
playground, street or in any parking lot, publicly or privately owned, any open container
containing any alcoholic beverage.
Section 9.04.030 Exception to Chapter.
The exception to the provisions of this Chapter shall be when an organization or group
has reserved the pavilion for an organized function.
Section 9.04.040 Penalty.
Any individual violating any provision of this Chapter shall be deemed guilty of an
infraction or misdemeanor as hereinafter specified. Such individual shall be deemed guilty of a
separate offense for each and every violation of any of the provisions of this Chapter is
committed, continued, or permitted. Any individual convicted of a violation of this Chapter shall
be: (1) guilty of an infraction offense and punished by a fine not exceeding One Hundred
Dollars ($100.00) for the first violation; (2) guilty of an infraction offense and punished by a fine
not exceeding Two Hundred Dollars ($200.00) for the second violation of the same Chapter
provision and perpetrated by the same individual. The third and any additional violations of the
same Chapter provision and perpetrated by the same individual shall constitute a misdemeanor
offense and shall be punishable by a fine not exceeding One Thousand Dollars ($1,000.00) or six
(6) months in jail, or both. Notwithstanding the above, a first offense may be charged and
prosecuted as a misdemeanor.
