HomeMy Public PortalAbout19810408CCMeeting1 1 1 21 Tybee Island, Georgia April 8, 1981 The regular monthly meeting of the Tybee Island City Council was held at 3:30 p.m. on Wednesday, April 8, 1981, at the Tybee Island City Hall. In the absence of Mayor Michael J. Counihan, Mayor- pro -tem W. C. Fleetwood presided and the following members of council were present: Jerome W. Betten- court, Nick C. Alexander, John J. Owen, James L.Fabrikant. Mrs. Julianne J. Meyers was absent. The City Attorney, James E. McAleer, was present. The minutes of the meeting of March 11, 1981 were approved as written. Bills for the month of March, 1981 were approved as follows: Police Department $4,166.50 Sanitation 3,675.47 Public Works 4,899.95 General Government 2,897.49 Recreation 411.09 Ceramics 339.10 Fire Department 583.02 Parking Meters 211.68 Other Expenses 3,732.78 Capital Outlay 268.75 A resolution of respect for A. Pratt Adams, Jr. was then read by Mr. McAleer. After the reading Mayor - pro -tem Fleetwood recognized Mrs. Elizabeth Jamieson Adams, Mrs. A.A. Lawrence and Mrs. Mary Adams Odom, wife, sister and daughter of Mr. Adams. He presented the resolution to Mrs. Adams and she res- ponded with appreciation for the thoughts expressed in the resolution. A copy is attached to, and becomes a part of, these minutes. Ordinance #1 -1981 was read for the second time. This ordinance concerns public drinking on streets, in parking lots, on sidewalks and on the beach, as well as in open view of the public and within automobiles. Mr. Alexander had 1 1 1 22 questions concerning public notification of this ordinance. Councilman Fabrikant responded that his department will be posting signs warning the public of the new ordinance and that the newspaper has been asked to report its enactment. Mr. Alexander questioned whether this is enough notice and the Police Commissioner, Jack Owen, replied that it is to everyone's best interest that drinking be confined to the interior of the bars. Major David McCutchen, speaking for the Police Department, promised to alert the media to the new ordinance and publicize it. Mr. Alexander then suggested that a letter might be sent to bar owners informing them of the enactment of the ordinance. Mr. Fabrikant stated that a form letter to license holders should present no problem, and a vote was called for. The ordinance was passed without dissenting vote. Councilman Fleetwood then explained the 1982 budget, especially noting that there is no general bond endebtedness and no outstanding notes. He stated that the only bonds outstanding are water /sewer bonds. A copy of the General Fund budget, and of the Water /Sewer budget are attached to, and becomes a part of, these minutes. Councilman Fleetwood further indicated that the Revenue Sharing budget will be approved at a later meeting, after a public hearing is held as required by the federal law. He further stated that the budget is sound and that it may be possible to reduce the millage rate soon. He advised department heads to carefully study their individual departmental budgets and adhere to them strictly. He indicated that certain capital expenditures, such as fire equipment and water /sewer improve- ments are not included in this budget. After a lengthy discussion Councilman Bettencourt moved approval of the proposed 1982 budget, Councilman Owen seconded and approval was unanimous. 1 1 23 Councilman Bettencourt stated that the Tybee Island Branch Library's annual report, prepared by Mrs. Diana Solomon, is complete and that those who wish a copy can contact him after the meeting. Mr. Sebastian Orsini spoke briefly, thanking the City Council for budgeting the funds for recreation that the Recreation Board had requested. He further thanked the Council on behalf of the Optimist Club, who are known as "Friends of Youth ". Mr. William Whelan asked about a water drainage problem on his property which he feels might be worsened by the construction of condominiums on Bay Street. Councilman Fleetwood replied that the condominium owners are responsible for street paving and for drainage and that their engineers are Hussey, Gay & Bell, who have considered these problems in the plans for the development. There being no further business, the meeting was adjourned. TOTAL ANTICIPATED EXPENSES $ 440,116. -2- 1 1 Ordinance Number 1 -1981 AN ORDINANCE REGULATING THE CONSUMPTION OF ALCOHOLIC AND MALT BEVERAGES UPON THE STREETS, PARKING LOTS, SIDEWALKS, WALKWAYS, AND PUBLIC BEACHES IN THE CITY OF TYBEE ISLAND; AND PROVIDING PENALTIES FOR THE VIOLATION OF SUCH. BE IT ORDAINED by the Mayor and Council of the City of Tybee Island, Georgia, that at a regularly scheduled meeting of the City Council, that Section 9 -2 -9 of the Code of Ordinances, City of Tybee Island, Georgia is to be added, to read as follows: It shall be unlawful for any person to consume alcoholic or malt beverages on the public streets, parking lots, sidewalks, walkways or public beaches in the City of Tybee Island or to consume alcoholic or malt beverages in an automobile on the public streets or parking lots of Tybee Island, Georgia. It shall also be unlawful for any person to carry in cups, glasses, or open cans and bottles alcoholic or malt beverages for the purposes of consumption of same on the streets, parking lots, sidewalks, walkways and public beaches. Any person violating any of the provisions, rules, or regulations of this Section, upon conviction shall be subject to punishment as provided in Section 1 -1 -8 of this Code and punishment as provided by the laws of the State of Georgia. The above and. foregoing Ordinance being adopted and approved this 8th day of April , 1981 after the Second Reading in Open Council meeting of the City of Tybee Island, Georgia. Pratt Adams, Jr.; and WHEREAS, A. Pratt Adams, Jr. has, through his foresight and his enthusiasm for this community which was his lifelong, beloved summer home, earned the affection of the people of Tybee Island, Georgia; and WHEREAS, the stature he attained in this community, and throughout the State of Georgia, by his exemplary life and monumental public achievements was recognized during his lifetime; BE IT THEREFORE RESOLVED, that the Mayor and City Council of the City of Tybee Island, Georgia, does, by this Resolution and Public Record, recognize the profound influence for the public good which A. Pratt Adams, Jr. did exercise upon the development of Tybee Island, Georgia, recognizing further that his death is a distinct loss to this City for which he confidently worked and where he won the deep respect and affection of its citizens. BE IT FURTHER RESOLVED, that this Resolution be spread upon the minutes of the of the Council and a copy thereof presented to his wife, Mrs. Elizabeth Jamieson Adams, in recognition of Mr. Adams' beloved and respected place in this community.
