A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING AN ADDITIONAL $60,000 IN PURCHASING AUTHORITY UNDER THE
CITY'S CONTRACTING AND PURCHASING POLICY & PROCEDURES FOR
LEGAL/INVESTIGATIVE SERVICES PROVIDED BY FAGEN, FRIEDMAN &
FULFROST, LLP, AND APPROVING AN APPROPRIATION IN THE AMOUNT OF
$75,000 FROM THE UNASSIGNED GENERAL FUND.
WHEREAS, the City's Human Resources Department received an influx of
employee complaints throughout the current fiscal year that required formal administrative
inquiries be conducted; and
WHEREAS, the aforementioned administrative inquiries needed to be conducted
by a Licensed Investigator and/or Attorney per the State of California's Business and
Professions Code (§7520); and
WHEREAS, the City's Human Resources Department entered into a Legal
Services Agreement with Fagen, Friedman & Fulfrost, LLP, under the City Manager's
Purchasing Authority ($50,000) in March of this year to provide investigative/legal
services on behalf of the City in accordance with the Business and Professions Code;
and
WHEREAS, the City's Human Resources Department is approaching the City
Manager's Purchasing Authority limit of $50,000 and is seeking City Council approval for
an additional $60,000 in Purchasing Authority from the City Council, per the City's
Contracting and Purchasing Policy & Procedures (Exhibit A. - refer to Section X.,
Purchasing Authorization Table), in order to remit payment for pending/future invoices for
services rendered by Fagen, Friedman & Fulfrost, LLP; and
WHEREAS, the increase in legal/investigative services also require a budget
adjustment increasing the Human Resources Department's budget for its Professional
and Contractual Services in the amount of $75,000.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY RESOLVE AND DETERMINE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and declares
that the foregoing recitals are true and correct, and incorporates them herein as findings
and as a substantive part of this Resolution.
Section 2. The City Council authorizes an additional $60,000 in purchasing
authority under the City's Contracting and Purchasing Policy & Procedures with Fagen,
Friedman & Fulfrost, LLP, for legal/investigative services rendered and in order to remit
payment for pending and future invoices for said services; and
Section 3. The City Council authorizes and approves an appropriation from the
unassigned general fund in the amount of $75,000 to cover the costs of pending and
future invoices, approved as to form by the City Attorney.
Section 4. The City Council of the City of Lynwood authorizes the use of monies
from the Unappropriated General Fund for this FY 23-24 budget adjustment as follows:

Section 5. Authorize the Mayor to execute the Resolution for and on behalf of
the City of Lynwood.
Section 6. This Resolution shall take full force and effect immediately upon
adoption by the City Council.
Section 7. The City Clerk shall certify as to the adoption of this City Council
Resolution.
