CITY OF TIFFIN ORDINANCE NO. 2017-410
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, FROM R-1A TO R-4 FOR CERTAIN PROPERTY
KNOWN AS PAR
DEVELOPMENT, PART 1, TIFFIN, JOHNSON COUNTY, IOWA, AND AS
LEGALLY DESCRIBED HEREIN
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, concerning property locally
described as Parie Village Residential Development, Part 1,
Tiffin, Johnson County, Iowa, attached hereto and incorporated herein.
Section 2. Amendment. The following legally described
property:
REZONING DESCRIPTION - - R-1A TO R-4
A PORTION OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER IN SECTION 27,
TOWNSHIP 80 NORTH, RANGE 7 WEST, OF THE FIFTH PRINCIPAL MERIDIAN, CITY OF TIFFIN,
JOHNSON COUNTY, IOWA, DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHWEST CORNER OF THE NORTHWEST QUARTER OF THE
NORTHWEST QUARTER OF SECTION 27, TOWNSHIP 80 NORTH, RANGE 7 WEST, OF THE FIFTH
PRINCIPAL MERIDIAN, CITY OF TIFFIN, JOHNSON COUNTY, IOWA; THENCE N89°41'04"E ALONG
THE NORTH LINE OF SAID NORTHWEST QUARTER OF THE NORTHWEST QUARTER, A DISTANCE
OF 158.00 FEET FOR THE POINT OF BEGINNING; THENCE CONTINUING N89°41'04"E ALONG SAID
NORTH LINE, A DISTANCE OF 1017.92 FEET TO A POINT ON A CURVE; THENCE SOUTHWESTERLY
ALONG A CURVE TO RIGHT HAVING A RADIUS OF 300.00 FEET AND A CHORD BEARING OF
S02°33'24"W, AN ARC LENGTH OF 109.37 FEET; THENCE S13°00'04"W, A DISTANCE OF 157.02
FEET TO A POINT OF CURVATURE, THENCE SOUTHWESTERLY ALONG A CURVE TO THE LEFT
HAVING A RADIUS OF 500.00 FEET AND A CHORD BEARING OF S05°46'46"W, AN ARC LENGTH
OF 126.04 FEET; THENCE S88°33'28"W, A DISTANCE OF 226.48 FEET TO A POINT OF
CURVATURE; THENCE NORTHWESTERLY ALONG A CURVE TO THE RIGHT HAVING A RADIUS OF
850.00 FEET AND A CHORD BEARING OF N79°48'08"W, AN ARC LENGTH OF 345.36 FEET;
THENCE N68°09'45"W, A DISTANCE OF 149.17 FEET TO A POINT OF CURVATURE; THENCE
NORTHWESTERLY ALONG A CURVE TO THE LEFT HAVING A RADIUS OF 312.84 FEET AND A
CHORD BEARING OF N79°25'49"W, AN ARC LENGTH OF 123.05 FEET; THENCE S89°18'07"W , A
DISTANCE OF 143.00 FEET; THENCE N00°41'53"W, A DISTANCE OF 278.39 FEET TO THE POINT
OF BEGINNING.
SAID ZONING PARCEL CONTAINS 8.31 ACRES, AND IS SUBJECT TO EASEMENTS AND
RESTRICTIONS OF RECORD.

shall be changed from zoning classification R-1A(Single Family 18,000
S.F. MIN) TO R-4 (Multi-Family 3 or 4 Plex) and further, that the official
zoning map of the City be amended to reflect the change described
herein.
Section 3. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 5. Effective Date. This ordinance shall be in effect after
its final passage, approval, and posting as provided by law.
On the 19 th day of September 2017, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No.
2017-410, and moved that it be given its first reading. The motion was
seconded by Councilperson Kahler.
Ayes: Bartels, Havens, Ryan, Kahler,
Nays: None.
Absent: Upton
Four members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2017-410, was read the first time, discussed, and placed on record.

On the 3 day of October 2017, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No.
2017-410, and moved that it be given its second reading. The motion
was seconded by Councilperson Havens.
Ayes: Upton, Bartels, Havens, Ryan, Kahler.
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2017-410, was read the second time and discussed and placed on
record.
On the 17 th day of October 2017, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Havens introduced Ordinance No.
2017-410, and moved that it be given its third and last reading. The
motion was seconded by Councilperson Upton.

Ayes: Upton, Bartels, Havens, Ryan, Kahler.
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and the ordinance was
passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2017-410 be adopted
and signified his approval of same by fixing his signature thereto. Passed
