HomeMy Public PortalAbout03/18/97 CCM63 MEDINA CITY COUNCIL MEETING MINUTES OF MARCH 18, 1997 The City Council of Medina, Minnesota met in regular session on March 18, 1997, at 7:30 p.m. in the City Hall Council Chambers. Mayor John Ferris presided. Members present: John Ferris, John Hamilton, Jim Johnson, and Phil Zietlow. Members absent: Ann Thies. Also present: Public Works Director Jim Dillman, Police Chief Rick Rabenort, City Engineer Shawn Gustafson, City Attorney Ron Batty, and City Clerk -Treasurer Paul Robinson. 1. Adoption of the Agenda Moved by John Hamilton, seconded by Phil Zietlow, to adopt the published agenda with the following additions: 1. Congratulations to Loren Kohnen for being named the building inspector of the year. 2. Update on police hiring. Motion passed unanimously. 2. Minutes Moved by Phil Zietlow, seconded by John Hamilton, to approve the minutes of the regular meeting of March 4, 1997, as submitted. Motion passed unanimously. 3. Consent Agenda A. Resolution 97-07 Approving CUP for McDonalds. Jim Johnson asked that this item be removed from the consent agenda. 4. Resolution Approving CUP for McDonalds. f -off Moved by John Ferris, seconded by Jim Johnson, to approve the resolution 97-07 Approving CUP for McDonalds. Jim Johnson expressed concerns about the traffic at the intersection of TH 55 and CR 116. He said his main concern with the McDonalds' plan was from people using McDonalds' southern exit who wanted to ultimately go west on TH 55. To do this they would have to cross two lanes of traffic. John Ferris asked Rick Rabenort what the city could do if this happened. Rick Rabenort said that they could issue tags for unsafe lane usage. He said there was a state law that prohibits vehicles from crossing two lanes of traffic, when making a right turn. Medina City Council Meeting Minutes March 18, 1997 64 Shawn Gustafson said that the county did not raise any concerns about this issue in their review of the McDonalds' plans. Susan MacKay, the Planning Commission representative in attendance, asked if the City Council could require that there be no right hand turns from this exit during the hours when this problem would occur. There was some discussion about such signage. Ron Batty said that several states allow cities to charge impact fees as a part of CUP. However, Minnesota is not one of those states. He said that in Minnesota city council's are left with the comprehensive plan and the zoning ordinance as tools for regullating what types of development would be appropriate and where. Jim Johnson said that he was sure that each person involved in approving the McDonalds' plan did it appropriately. He still did not believe that the design of the McDonalds' building and site was done right and he said he wished there was ore the City could do. Phil Zietlow asked if it would be possible to add a condition that after a certain n mber of accidents within a year, or some time period, a service road to be constructe Ron Batty said he did not think there would be an ordinance provision that would support that specific of a condition. There was discussion about how a frontage road would be paid for, legal conditions for a petition and waiver agreement, and the tools available to the City Council for regulating development. John Ferris said that the issue of stacking onto 116 would be taken care of by is citations. Ron Batty said that this would be the application of an existing ordinance. uing John Ferris said that they could post a sign that would prohibit going to the left turn lane from the southern exit of McDonalds during certain hours of the day. There was some discussion about how traffic could be regulated at that intersection and that the City Council was concerned that a potential problem could occur. Ron Batty said that the City Council may want to add a condition that the City C•uncil review the traffic situation at this intersection one year from now and at that time address any problems. Medina City Council Meeting Minutes March 18, 1997 65 John Ferris stated that the primary purpose of monitoring traffic at this intersection was to ensure the safety in this area. Moved Phil Zietlow, seconded by John Hamilton, to amend the original motion and add an additional condition to the CUP that an annual traffic safety evaluation be performed on roadways adjacent to this property. Motion passed unanimously. Vote on original motion which was moved by John Ferris, seconded by Jim Johnson, for approving resolution 97-07 Approving CUP for McDonalds was passed unanimously. 5. Park Commission Comments - There were none. 6. Planning Commission Comments Jim Johnson asked if Anne Heideman had served more years then allowed. Paul Robinson said he would look into this and get back to the City Council. Susan MacKay, Planning Commission representative, commented that a DNR survey that had been done in conjunction with the Spring Hill Golf Course development raised the Planning Commission's awareness of potential natural resources in the city that may be worth preserving, such as, the Big Woods area at the proposed golf course site. Jim Johnson said that the Planning Commission had recently sent a memo to the City Council about using some of the monies from the antenna leases for several purposes, one of them being the acquisition of land for preserving natural areas and open space. Susan MacKay said that she and Caroline Smith were also interested in looking into cluster home development. She felt this would be an alternative way to develop areas of the city and still maintain areas of open space and preserve the feel of Medina. She asked if the City Council would be interested in having the Planning Commission look into this type of development. Some potential areas where this could happen were discussed. 7. Police Hiring Update Rick Rabenort said that to date he had received 43 resumes. He said review of these resumes would begin immediately. Medina City Council Meeting Minutes March 18, 1997 66 8. John Hamilton said that he wanted to congratulate Loren Kohnen for recently being named "Building Inspector of the Year". This was followed by wild applause. 9. Pay the Bills Moved by Jim Johnson, seconded by Phil Zietlow, to approve order checks numbers 16903-16955 for $ 355, 647.04 and payroll checks 15159-15170 for $ 9,858.28.
