AN CRDINANCE ESTABLISHING THE POSITION OF HEALTH AND
ANIMAL CARE OFFICER AND ESTABLISHING THE DUTIES OF
SAID OFFICER.
BE IT ORDAINED BY THE OOVERNING OODY OF THE CI'lY OF BEL AIRE:
Section 1. CREATION OF POSITICN
It is hereby created the position of HEALTH AND ANIMAL CARE OFFICER for
the City of Bel Aire, Kansas as defined in Ordinances No. 24 and 27 of the
City of Bel Aire, Kansas.
Section 2. DUTIES
The duties of the HEALTH AND ANIMAL CARE OFFICER as created: in Section
1 herein are as follows:
(a) All of the duties and responsibilities set forth in Ordinances No.
24 and 27 of the City of Bel Aire, Kansas are incorporated herein by reference
as though set forth fully herein.
(b) In addition thereto the HEALTH AND I ANIMAL CARE OFFICER is granted
law enforcement powers for the purpose of signing carplaints ana issuing and
serving Notices to Appear for violations of Ordinance 24 pertairiing to Aninal
Control and Ordinance No. 27 pertaining to Public Health and Sanitation.
(c) It shall further be the duty of the HEALTH AND ANIMAL CARE OFFICER
to maintain records on all dogs over three months old, to proVide licensing
therefore, pursuant to Sections 3 & 4 of Ordinance No. 24 of the City of Bel
Aire, Kansas.
(d) It shall further be the responsibility of the HEALTH AND ANIMAL
CARE OFFICER to issue Notices and hold revocation hearings for said dog licensing
and sUcti other hearings as are required as Set forth more fully in Sections
8, 9 and 10 of Ordinance No. 24 of the City of Bel Aire, Kansas.
(e) The HEALTH AND ANIMAL CARE OFFICER is further required and authorized
to make such COllections and retentions of aninals as necessary and required
to fully enforce the provisions of Ordinance No. 24 of the City of Bel Aire,
Kansas.
(f) It shall further be the duty of the HEALTH AND ANIMAL CARE OFFICER
of the City of Bel Aire, Kansas, to issue such Notices and hold such hearings
as authorized and rquired by Ordinance No. 27 pertaining to Public Health
and Sanitation of the City of Bel Aire, Kansas.
(g) It shall also be the duty of the HEALTH AND ANIMAL CARE OFFICER
to monitor violations that occur for which Notices are issued pursuant to
Section 3 of Ordinance No. 27 of the City of Bel Aire, Kansas.
(h) It shall further be the duty of the HEALTH AND ANIMAL CARE OFFICER
with the approval of the CI'IY (X){JNCIL and after consul ta tion with the CI'lY
ATIORNEY to abate any nuisances that shall continue to exist contrary to Ordinance
No. 27 of the City of Bel Aire, Kansas.
Section 3. EFmIVE DATE
This ordinance shall take effect and be in force fran and after its publication
in the official city publication.
