IONA CITY HALL
JULY 20,2021 —7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City
Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City
Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Brian Smaka, Clint Reading, Jill Reading, Devan Thompson, Joanie Marshall,
Jolyn Louk, Brad Norby, Craig Marshall, Joel Brinkerhoff, Rebekah Brinkerhoff, Van Jackson,
Diane Jackson, Todd Brewington, Jarrett Bird, Regina Bird, Trevor Wright and Clark Morsbach.
Mayor Gubler welcomed everyone and Council Member Wadsworth led the Pledge of
Allegiance. A roll call was taken by Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of June 15,
2021 were reviewed. Council reviewed the finance reports for the period ending June 30, 2021
(75% of the fiscal year elapsed). The City had $1,726,188.14 in the bank and routine bills had
been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
consent agenda as presented. Council Member McNamara seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Business License Application; Jill's Chicken Shack — Mayor Gubler stated this item was
discussed last month. Clerk West stated last month the discussion was pertaining to a parking
variance for Jill's Chicken Shack. She continued and stated this agenda item is for the actual
Business License for Jill's Chicken Shack. Clerk West then stated she has spoken with the City's
Building Official, and the restaurant only has minor, cosmetic items to address. He said the
restaurant has passed all major inspections and has no concerns with the issuance of the license.
Clerk West stated the County Fire Inspection has also been completed and the only requirement
left is to have the fire extinguisher at the restaurant serviced. Jill Reading with Jill's Chicken
Shack then stated the health department will be there Thursday for their final inspection.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
Business License Application for Jill's Chicken Shack. Council Member Wadsworth seconded
the motion. All in favor. Motion carried.
Public Hearing, Ordinance to Amend Ordinance No. 250-03-21, Appropriations Ordinance
for the 2021 Fiscal Year, Appropriating Additional Monies that have been allocated to the
City of Iona in the sum or $253,168 as part of the American Rescue Plan Act of 2021 (Ord.
265-07-21) — Clerk West stated this action item is to amend the current year's budget to receive
American Rescue Plan Act (ARPA) funds in the amount of $253,168 and show as revenue.

Mayor Gubler stated this is a Public Hearing and asked if anyone is opposed to this course of
action by the City Council. No opposition was indicated. He then closed the Public Hearing
portion of this agenda item.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve
Ordinance No. 265-07-21, an Ordinance of the City of Iona, Idaho; amending Ordinance No.
250-03-21, the Appropriations Ordinance for the Fiscal Year beginning October 1, 2020, and
ending September 30, 2021; appropriating additional monies that are to be received by the City
of Iona, Idaho, in the sum of $253,168.00 and providing an effective date. Council President
Geray also moved to dispense with the rule of reading the proposed Ordinance in full and on
three separate occasions. Council Member Thompson seconded the motion.

Business License Application; Voyager Enterprises DBA Hitt the Road — Clerk West
informed the public the gas station in Iona was recently sold and this application is for the new
owners of the business. Mayor Gubler asked if anyone in the audience had any concerns
regarding this application. No response.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
Business License for Voyager Enterprises DBA Hitt the Road. Council Member Thompson
seconded the motion.

Retail Beer Permit Application and Retail Wine Permit Application; Voyager Enterprises
DBA Hitt the Road — Council President Geray stated the application asks if the business is
located within 300 feet from a church or school. Clerk West confirmed it is over 300 feet from
Iona Elementary School, but is less than 300 feet from the church on Denning Avenue. Attorney
Rawlings read aloud Iona City Code § 4-4-9 regarding wine location restrictions. He then
summarized and stated the 300 foot rule for nearby schools and churches only applies if wine is
consumed on premises and does not apply to retail stores selling wine. Council President Geray
accepted this explanation.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
applications for Retail Beer Permit and Retail Wine Permit for Voyager Enterprises and Jarom
Christensen, as submitted. Council Member Wadsworth seconded the motion.

Public Hearing, Conditional Use Permit Application; Gary & Lark Elliott, Residential
basement occupancy at 3652 N. Dayton Street per Iona City Code § 11-4-3(B)(7) — Mayor
Gubler stated the Elliotts are not in attendance tonight. He then asked if this was approved by the
Planning & Zoning Commission (P&Z) at their last meeting. Clerk West confirmed it was
approved by P&Z and the Elliotts were present for that meeting. Mayor Gubler suggested tabling
this discussion until next month when the Elliotts are present. Council President Geray stated he
would be okay to proceed without them present, unless there is a lot of opposition. Mayor Gubler
explained the history of this permit application. He stated there was a Conditional Use Permit for
the previous property owners to rent the basement, while they occupied the upstairs of the home.
However, the new owners do not live in the home and want to rent the upstairs and the basement
as two separate units.
Mayor Gubler opened the Public Hearing portion of this agenda item and asked if anyone from
the audience would like to speak in favor of or against this application.
Joanie Marshall of 3588 N. Dayton Street approached the podium and stated she lives next door
to the house on the application. She stated she is very opposed to this application. Mrs. Marshall
expressed her opinion that this will set a precedent that anyone in the City can turn their home
into a duplex. She continued and stated they did not have a problem with the previous owners
renting their basement because she knew they were living upstairs and were taking care of the
PIN home. Mrs. Marshall continued and stated there is a problem with parking and the current renters
are parking vehicles across the street in the City Park parking spaces because there are not
enough spaces available at the home.
Brad Norby of 4849 E. Steele Avenue approached the podium and stated he is also opposed to
this application because of the precedent it sets to have multiple rentals on the same property.
Jolyn Louk of 5428 E. Rockwood Avenue stated she was under the impression the previous
owners would have to reapply each year for their permit, but they did not. She continued and
asked if that is a requirement for Conditional Use Permits. Mayor Gubler stated Conditional Use
Permits can be revisited by the City at any time, but they are not required to be renewed each
year.
Mayor Gubler closed the Public Hearing portion of the agenda. Council Member McNamara
stated she is concerned they are already renting the upstairs and they are now requesting to rent
the basement. Clerk West stated there is nothing in the current code that would restrict them
from renting them separately, or requiring the owners to occupy the home. She continued and
asked if there are grounds to deny the application if they meet all of the existing criteria.
Attorney Rawlings stated the City can always deny a Conditional Use Permit, as long as there is
a reasonable basis for doing so. Mayor Gubler then stated he thinks this part of the City Code
does need to be addressed at the next meeting. Clerk West agreed and stated her opinion that if
the City wants to require the homeowner to occupy the residence while renting out another
portion of the home, that should be specified in the Code. Mayor Gubler agreed.

Council President Geray stated the problem with this situation is the way the current City Code is
written. He continued and stated he doesn't see any justification for denying this application,
based on what the current Code allows. Council President Geray suggested tabling the vote and
discussing further when the applicants are present. He continued and stated since there is
opposition, he feels it is appropriate for the applicants to hear the opposing arguments and have a
chance to defend themselves. Council Member Thompson agreed and stated he would like the
applicants there to be able to answer questions and share their perspective. Council Member
Wadsworth stated he would rather just deny the application.
Mayor Gubler entertained a motion. Council President Geray made a motion to table this item
until the Elliotts are available to attend. Council Member Thompson seconded the motion.

Mayor Gubler voted YES as the tiebreaker vote. Agenda item will be tabled until the next City
Council Meeting.
Public Hearing, Preliminary Plat Application; Eagle Rock Engineering; Elim Estates, a
Subdivision located on the North side of Iona Road, between 45th East and Olsen Avenue —
Devan Thompson approached the podium and introduced himself as the developer. He stated he
and his engineer have reviewed the notes they received from the City Engineer and will make the
necessary adjustments. Discussion began regarding the requirements for a temporary cul-de-sac.
Mayor Gubler stated there were problems with the original Preliminary Plat submitted earlier
this year with emergency access. They have now agreed that widening the road will satisfy that
need, in addition to two stub outs on the north end of the subdivision. Brian Smaka with
Forsgren Engineers stated the P&Z expressed concern over the turning radius at the end of the
road. Mr. Thompson stated he believes they are able to put a permanent cul-de-sac at the end of
the road for turnaround capabilities. Mr. Thompson then expressed concern regarding possible
drainage issues for a wider road.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience would like to
come up in opposition of this application.
Brad Norby of 4849 E. Steele Avenue approached the podium and asked who owns the property
behind the church on Iona Road. Mayor Gubler stated Jayce Howell is in the process of
purchasing that property. Mr. Norby expressed concern over land locking adjacent properties.
Mr. Thompson stated that is the reason for the two roads that will stub out of the subdivision, to
avoid land locking property. Mr. Norby attempted to discuss the history with previous proposals
for development of this property. Mayor Gubler explained past proposals and stated this new
application addresses many of the past concerns.
Clark Morsbach of 4840 E. Rockwood Avenue approached the podium and stated his property is
near this development and he did not receive a Public Hearing notice for this agenda item. Clerk
West stated she receives a list from Bonneville County for all of the landowners within 300 feet

and that is who the City sends notices to. Mr. Morsbach stated he has lived there for 2 years and
has received previous notices for other developments on this property. Clerk West stated she will
look over her list and determine why he was not sent a notice. She reviewed her list and
informed Mr. Morsbach the list provided by Bonneville County still has the previous owner
listed on his property and that is who received the notice. She continued and stated she will
inform Bonneville County of this error and will ensure he receives all future notices.
Diane Jackson of 4814 E. Rockwood Avenue approached the podium and stated she is concerned
about the length of the road. Mayor Gubler stated the road will be wider than normal to address
the concerns for emergency vehicles to turn around. Mrs. Jackson then asked how this
development will affect the irrigation ditch. Mayor Gubler stated the developer will be
responsible to design around the irrigation ditch so the adjacent property owners are not
negatively affected. Mrs. Jackson then asked questions regarding the church's water system and
asked if the City has enough water availability to accommodate all the new subdivisions. Mayor
Gubler confirmed the City has enough water and just purchased additional water rights two years
ago with money the City received from the growth.
Council Member Thompson expressed concern regarding the placement of the stub out to the
property behind the church and the negative affect it could have on the development of that
property. Mayor Gubler stated that property is not the responsibility of the current developers.
They are only required to provide a stub out to the property.
Council President Geray asked if Director Prouse had any input on this application. Director
Prouse stated he will have more input when the Final Plat is submitted. However, this is only the
Preliminary Plat and he does not have any initial concerns. He continued and added, there is an
existing 10" water line coming out of the Homer Estates Subdivision to the North that will need
to be connected to in order to loop the water system.
Mayor Gubler closed the Public Hearing portion of this agenda item to allow the Council time to
discuss. No further discussion.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve the
Preliminary Plat Application for Elim Estates. Council Member McNamara seconded the
motion.

Contested City Code Violation; Jarrett Bird, Iona City Code § 5-4-10(A) Barking Dog,
issued 06/07/2021 —Jarrett Bird of 5345 E. Steele Avenue approached the podium and stated he
is contesting a violation for his dog barking. He stated they received warning in September and
just received this citation in June. He said they got their dog fixed after the September incident.
Mr. Bird continued and stated he does not bark continuously, but he does have a loud bark. He
also stated he has spoken to his neighbors on both sides of him that have told him they do not
hear his dog barking. Regina Bird also approached the podium and stated they are working with

the dog and have made him start wearing a bark collar. Council Member Wadsworth asked when
they started using the bark collar. Mrs. Bird stated it was after the first complaint in September.
She continued and stated their son was also discharged from the military and moved in with
them, along with his dog. She then stated the two dogs cannot be outside together. Mrs. Bird then
stated they have a metal fence, which she thinks adds to the loudness of the barking.
Council President Geray requested to hear from Deputy Williams, who issued the citation. Clerk
West stated Deputy Williams gave her information prior to the meeting and requested it be added
to the record. Clerk West stated she has reports of 5 calls from May 2020 to June 2021 from
different neighbors that had called to complain. Mrs. Bird stated she was aware of a couple of the
calls and got him fixed to help settle him down. Council Member Wadsworth stated he has
received calls from a few of their neighbors and informed the Birds that this is a real problem.
Mrs. Bird stated she would like her neighbors to approach them, instead of calling the police.
Council Member Wadsworth stated he understands how hard it is, but the City has a
responsibility to address the concerns of all residents. Deputy Williams stated when he arrived at
the house to issue the citation, the dog was outside and was not barking. However, he issued the
citation due to the long history of calls.
Council President Geray stated he has not heard any reason to reverse Deputy Williams' actions
to issue the citation. Council Member Wadsworth agreed and stated he does feel bad for the
Birds, but he feels it needs to be addressed. Mayor Gubler agreed and stated the City has no
intention of overturning the citation. He continued and thanked the Birds for coming, but the
OIN citation and penalty still stand.
Ordinance to Amend Iona City Code § 5-9: Litter and Weed Control (Ord. 266-07-21) —
Attorney Rawlings stated they have determined that to enforce this Code, it needs to be
categorized as an infraction. Council President Geray recognized and understood the needed
change.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve
Ordinance No. 266-07-21, an Ordinance of the City of Iona, Idaho; amending Section 5-9-12 of
the Iona City Code; specifying that failure to remove weeds is an infraction; providing
methodology; preserving prior ordinances in each instance; providing for severability; and
establishing an effective date. Council Member Wadsworth also made a motion to dispense with
the rule of reading the proposed Ordinance in full and on three separate occasions. Council
Member McNamara seconded the motion.

Approval of Fiscal Year 2022 Preliminary Budget — Clerk West displayed the proposed
budget for the General Fund and explained various line items. She stated the City is allowed to
take a 3% increase each year in property taxes and that would equal approximately $8,800 this
riN4 year. All Council Members and Mayor Gubler agreed to the 3% allowable increase. Clerk West

continued and explained areas she feels need to be more fully defined and will be splitting the
budget line items to allow more transparency.
Clerk West then discussed the Water Fund budget and expressed concerns with showing savings
account balances as part of the operating budget. She continued and stated she feels this inflates
the budget to increase the revenue, which then allows the expenses to be increased as well. Clerk
West stated she believes the Water Budget can be balanced without including the savings
account balances. Council President Geray agreed and stated if the City needs to withdraw
money from savings for an emergency situation, they have the option to open the budget at any
time. Clerk West agreed. Mayor Gubler agreed and advised Clerk West to keep the savings
numbers out of the operating budget. Clerk West agreed. Discussion continued regarding the
Water Fund various revenues and Clerk West explained her justification for the amounts listed.
Mayor Gubler then stated the City will need to do another valuation of the water system to
determine if the water connection fee needs to be changed. He continued and stated he will
discuss this with the City Engineer.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
Preliminary Budget as indicated from the General and Water Funds for a total of $2,434,753.
Council Member Thompson seconded the motion.

STAFF REPORTS: Clerk West stated she received a phone call from Allen Horton and said he
was unable to make it to the meeting, but would like to publicly thank Director Prouse and Bryce
Stucki for their work on fixing the irrigation ditch on Free Avenue. Clerk West then informed the
Council the Iona Days Celebration would be this weekend and encouraged everyone to attend.
Clerk West lastly reported there are 2 City Council positions and the Mayor position that are up
for reelection this year. Candidate filing will begin in August.
Director Prouse stated the chip sealing of Free Avenue and 50th East will take place on July 29tn
He also reported Sunrise Acres is getting closer to requesting acceptance for the improvements in
the subdivision. He continued and stated once that is accepted, the City can begin issuing
building permits. Director Prouse then reported the hiring deadline for the Public Works Laborer
position was extended and he has received several additional applicants.
Deputy Williams stated nothing to report.
Council President Geray, Council Members Wadsworth and Thompson all stated nothing to
report.
Council Member McNamara stated the Iona Historical Museum will be involved with Iona Days
this year. She continued and stated they will be giving carriage rides from the park to the
1/114110 museum telling stories about the history of Iona. She also stated they will be having a bake sale
and additional activities.

Mayor Gubler reported the new water tank project should be completed by the first week of
August.
SUGGESTED AGENDA ITEMS: Joanie Marshall of 3588 N. Dayton Street approached the
podium and stated she would like the Council to discuss at a future meeting the requirement for a
homeowner to rent any portion of their home; they also need to live in the home. Mayor Gubler
stated this will be on next month's agenda.
