HomeMy Public PortalAbout03/19/96 CCM43 MEDINA CITY COUNCIL MEETING MINUTES OF MARCH 19, 1996 The City Council of Medina, Minnesota met in regular session on March 19, 1996, at 7:30 p.m. in the City Hall Council Chambers. Mayor Anne Theis presided. Members present: John Ferris, Jim Johnson, Ann Thies, and Mayor Anne Theis. Members absent: Phil Zietlow. Also present: Public Works Director Jim Dillman, City Engineer Shawn Gustafson, City Attorney Ron Batty, and City Clerk -Treasurer Jeff Karlson. 1. Adoption of the Agenda MOVED BY THIES, SECONDED BY MAYOR THEIS, TO ADOPT THE PUBLISHED AGENDA WITH THE FOLLOWING ADDITIONS: • UPDATE ON DEER HILL ROAD PROJECT • DISCUSSION REGARDING NEW TELECOMMUNICATIONS ACT MOTION PASSED UNANIMOUSLY. 2. Consent Agenda MOVED BY THIES, SECONDED BY FERRIS, TO APPROVE THE CONSENT AGENDA, AS FOLLOWS: • RESOLUTION NO. 96-11, "RESOLUTION APPROVING THE RENEWAL OF A PREMISES PERMIT TO THE HAMEL VOLUNTEER FIRE DEPARTMENT TO CONDUCT LAWFUL GAMBLING" MOTION PASSED UNANIMOUSLY. 3. Minutes MOVED BY THIES, SECONDED BY FERRIS, TO APPROVE THE MINUTES OF THE REGULAR MEETING OF MARCH 6, 1996, AS AMENDED, AS FOLLOWS: • PAGE 4, ITEM 9, PARAGRAPH 4, LINE 2, TO READ, "HE STRONGLY RECOMMENDED THAT KOHNEN INFORM THE HAULER..." MOTION PASSED UNANIMOUSLY. 4. Approval to Purchase Park Equipment MOVED BY FERRIS, SECONDED BY JOHNSON, TO APPROVE THE PURCHASE OF A TRAILER FOR THE TORO MOWER AT A COST OF $3,182.44. MOTION PASSED UNANIMOUSLY. 5. Update on Deer Hill Road Project Shawn Gustafson reported that there was an error in the construction of the Deer Hill Road pond. He said the pond was one and a half feet higher in elevation from what was called for in the design plan. Gustafson pointed out that the surface area of the pond was the same, the depth was the same, and the volume was the same, but it was 18 inches higher. Gustafson said the higher elevation could impact the property owner, 44 Jack Wahlfors. The primary concern was that the Minnehaha Creek Watershed District did not notify the City or Jack Wahlfors of the error. John Ferris asked how a mistake like this could happen. Gustafson said the error probably occurred during the surveying. Ron Batty recommended that the City obtain "as -built' plans to reflect the true elevation of the pond. Gustafson said he would ask the Minnehaha Creek Watershed District for as -built plans. 6. Mark Roskop — Request for Reduction of Financial Guarantee Shawn Gustafson reported that Mark Roskop planned to construct only one mini - storage building this year and might need up to three years to complete the remaining nine buildings shown on the approved construction plan. Gustafson said the council should consider allowing Roskop to separate the project into phases. He pointed out that by separating the construction work into phases, the City could come up with new figures for a financial guarantee. Approximately $47,000 of the original amount of $121,050 was completed. Roskop said he would begin the second phase of the project this spring. He specified that breaking up the project into phases loosened up credit for him to complete the next phase. Ron Batty said the council approved the entire construction project and the financial guarantee covered everything in the development plan. Batty said the council could amend Roskop's conditional use permit and require that the second phase be completed before approving the next phase. MOVED BY FERRIS, SECONDED BY MAYOR THEIS, TO DIRECT CITY ATTORNEY RON BATTY TO DRAFT A RESOLUTION AMENDING MARK ROSKOP'S CONDITIONAL USE PERMIT TO INCLUDE A PROVISION FOR DIVIDING THE MINI - STORAGE CONSTRUCTION PROJECT INTO PHASES. MOTION PASSED UNANIMOUSLY. 7. Discussion Regarding New Telecommunications Act Ann Thies said there were a lot of questions regarding the new Telecommunications Act of 1996, particularly whether the Act superseded the city's ordinances and its franchise agreements with the utility companies. Thies suggested that Ron Batty look into the city's existing utility agreements with U.S. West, Minnegasco, NSP, and Wright -Hennepin Electric and review the draft ordinance proposed by the League of Minnesota Cities. Thies pointed out that if the new Telecommunications Act did 45 supersede existing ordinances and agreements, the City would have to amend its ordinances and decide how it should be compensated for use of public rights -of -way. MOVED BY THIES, SECONDED BY MAYOR THEIS, TO DIRECT STAFF TO REVIEW THE NEW TELECOMMUNICATIONS ACT AND ITS POTENTIAL IMPACT ON THE CITY'S EXISTING UTILITY AGREEMENTS AND TO REVIEW THE DRAFT ORDINANCE THAT WAS PROPOSED BY THE LEAGUE OF MINNESOTA CITIES. MOTION PASSED UNANIMOUSLY. 8. Payment of Bills MOVED BY THIES, SECONDED BY MAYOR THEIS, TO APPROVE PAYMENT OF ORDER CHECK NUMBERS 15668-15710 FOR $38,686.35 AND PAYROLL CHECK NUMBERS 14729-14740 FOR $11,621.15. MOTION PASSED UNANIMOUSLY. 9. Adjournment MOVED BY THIES, SECONDED BY JOHNSON, TO ADJOURN THE MEETING AT 8:00 P.M. MOTION PASSED UNANIMOUSLY. Anne E.
