A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING
THE BULLIS RAIN GARDEN PROJECT, FY 2022-2023 (CIP 4011.68.069) AS
COMPLETE; AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION WITH
THE LOS ANGELES COUNTY RECORDER'S OFFICE AND THE RELEASE OF THE 5%
RETENTION 35 DAYS AFTER THE ACCEPTANCE
WHEREAS, the Bullis Rain Garden Project consisted of but was not limited to,
installation of three (3) sections of rain garden to mitigate stormwater drainage problem
along Bullis Road from Martin Luther King Junior Boulevard to Platt Avenue; and
WHEREAS, on December 12, 2022, 316 Engineering & Construction submitted a
quote for the proposed work and on December 20, 2022, a contract was awarded in the
amount of $145,150.00; and
WHEREAS, the construction on the Project started on January 26, 2023; and
WHEREAS, there was one (1) contract change order executed in the amount of
$14,511.19; and
WHEREAS, the final date of construction was July 26, 2023 and all work was
completed in accordance with the project plans and specifications; and
WHEREAS, the total construction cost including change orders, project
management, construction management, inspection, and other cost is $161,646.15; and
WHEREAS, the total construction budget was $659,878.00; and
WHEREAS, no additional appropriation was needed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. The City Council for the City of Lynwood finds and declares that the
forgoing recitals are true and correct and incorporates said recitals fully into this
Resolution as substantive findings.
Section 2. That the City Council of the City of Lynwood accepts the Bullis Rain
Garden Project (CIP 4011.68.069) as complete in accordance with contract documents.
Section 3. The City Council authorizes the Director of Public Works or his
designee to process the recordation and filing of the Notice of Completion with the Los
Angeles County Recorder's Office.
Section 4. The City Council authorizes the release of the 5% retention 35 days
after acceptance.
Section 5. Authorize the Mayor to execute the Resolution for and on behalf of
the City of Lynwood.
Section 6. This Resolution shall take effect immediately upon its adoption.
Section 7. The City Clerk shall certify to the adoption of this resolution and
hereafter the same shall be in full force and effect.
