A GENERAL ORDINANCE AMENDING SECTION 70.03
OF THE CITY OF RICHMOND CODE
WHEREAS, The City of Richmond has previously adopted an ordinance, now codified
in Richmond City Code 70.03, requiring the payment of a $3.00 fee for a
copy of an accident report as provided in former statute I.C. 9-3-1-3; and
WHEREAS, The current statute for fees fixed by ordinance for accident reports, I.C. 9-
29-11-1 (b) (3), was amended to provide that city police departments may
charge a fee in an amount not less than five dollars ($5) for each report;
and
WHEREAS, The Richmond Police Department has experienced greater accident
reporting requests and there are complexities with the adoption of the
National Incident Management System (NIMS) as the standard for
incident management; and
WHEREAS, The Richmond Police Department and the Wayne County Sheriffs
Department wish to charge the same fees for accident reports; and
WHEREAS, The proposed fee for accident reports furnished by the Richmond Police
Department should be eight dollars ($8) per report; and
WHEREAS, The proposed increased rate for obtaining copies of police accident reports
is consistent with both state law and surrounding jurisdictions; and
WHEREAS, The fees collected for such reports are required to be deposited in the
City's local law enforcement continuing education fund established by
I.C. 5-2-8-2; and
WHEREAS, It is in the best interests of the City to make certain amendments to Section
70.03.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond that current Section 70.03 of the City Code be amended in its entirety as
follows and the previous Section 70.03 is hereby repealed:
70.03 ACCIDENT REPORT ACCOUNT
The Police Department shall collect a fee of $8 for each copy of an accident
report as provided in I.C. 9-29-11-1. The fee collected shall be deposited in the local law
enforcement continuing education fund established by I.C. 5-2-8-2.
This ordinance shall become effective September 1, 2007.
Passed and adopted this _20th day of _August_, 2007, by the Common
Council of the City of Richmond, Indiana.
