Pledge of -Allegiance Adjustments to the Agenda: • Chairman Smith requested that items 2.b and 2.c be flipped due to a potential conflict on items 2.a and 2.c. PUBLIC COMMENT PERIOD: Libi Uremovic — Comments about staff, fire stations, general plan 70 Judy Bingham —Read a letter from 2005 1) Approval of the Minutes of the Regular Meeting of July 14, 2016, ACTION: Approval of the Minutes of July 14, 2015 as presented. Motion by Tinker, Seconded by Wirick to approve the Minutes as presented. AYES: Dale, Tinker, Smith, St. Martin, Wirick ABSTAIN: None NOES: None ABSENT: None Chairman Smith recused himself on items 2a and 2c due to potential conflict and left the chambers. 2) Scheduled Matters/Public Hearings a. Conditional Use Permit No. 15-CUP-07; Proposed Establishment of a Wireless Communications Facility at 36211 Champions Dr (Continued from July 14, 2015) ACTIONS: Receive the Staff Report and Take Testimony OPTIONS: • Approve Conditional Use Permit No. 15-CUP-07, subject to the proposed conditions of approval; or, • Modify and Approve Conditional Use Permit No. 15-CUP-07; or subject to modified conditions of approval. • Continue Conditional Use Permit No. 15-CUP-07; or, • Deny Conditional Use Permit No. 15-CUP-07. Variance 154-03, Consideration of:6 Variance for Reduction in Required Parking for the Guang Jih Temple located at 1316 E. a Street Actions: Receive the Staff Report and Hold a Public Hearing Options: • Approve Variance No. 15-V-03 as presented, subject to the proposed conditions of approval; or, •: Modify and Approve No. 15-V-03, subject to modified conditions of approval; or, • Continue Variance No. 15-V-03; or, • Deny Variance No. 15-V-03 Staff report was given by Rebecca Deming, Director of Planning Open Public Hearing 6:40 p.m. Speakers: James Broeske — Applicant Closed Public Hearing 6:49 p.m. Motion by St. Martin, Seconded by Wirick to Approve Variance No. 15-V-03 as presented, subject to the proposed conditions of approval. Commissioner Wirick recused himself and left the chambers due to business relationship with employer and property owner. d. Conditional Use Permit No. 15-CUP-08, Request For Alcohol Sales - Type 41 - On - Sale Beer And Wine Sales At "Sugoi Sushi" Located at 890 Oak Valley Parkway, Suite #E. ACTIONS: Receive the Staff Report and Hold a Public Hearing OPTIONS: • Approve Conditional Use Permit No. 15-CUP-08, subject to the proposed conditions of approval with the findings stated herein; or, • Modify and Approve Conditional Use Permit No. 15-CUP-08; or subject to modified conditions of approval with the findings stated herein. • Continue Conditional Use Permit No. 15-CUP-08; or, • Deny Conditional Use Permit No. 15-CUP-08. Sale of Alcoholic Beverages shall be limited to the hours of operation and limited to 10:00 AM to 12:00 AM (Midnight), Seven Days a Week. AYES: Dale, Tinker, St. Martin, Smith ABSTAIN: None NOES: None ABSENT: Wirick Commissioner Wirick returned to the dais. e. Conditional Use Permit No. 14-CUP-07; Twelve (12) Month Review of an in -home day-care facility at an existing residence at 1248 Larkspur Lane. ACTIONS: Receive the Staff Report and Take Testimony OPTIONS: • Approve Conditional Use Permit No. 14-CUP-07, subject to the Approved Conditions of Approval; or, • Approve Conditional Use Permit No. 14-CUP-07, or subject to modified conditions of approval. • Continue Conditional Use Permit No. 14-CUP-07; or, • Terminate Conditional Use Permit No. 14-CUP-07 and Require Removal of the Temporary Tent Staff report was given by Rebecca Deming, Director of Planning Open Public Comments 7:06 p.m. Miranda Banister — Applicant/Owner Closed Public Comments 7:08 p.m. Motion by Wirick, Seconded by St. Martin to Approve Conditional Use Permit No. 14CUP-07, subject to the existing Conditions of Approval.
