Commissioner Dale was excused. Commissioner Tinker was absent. Pledge of Allegiance Adjustments to the Agenda: • Request for Chairman Smith to hear item b and c prior to item a due to potential conflict PUBLIC COMMENT PERIOD: None 1) Approval of the Minutes of the Regular Meeting of August 11, 2015. ACTION: Approval of the Minutes of August 11, 2015 as presented. Motion by Wirick, Seconded by St. Martin to approve the minutes as presented. AYES: Smith, St. Martin, Wirick ABSTAIN: None NOES: None ABSENT: Dale, Tinker 2) Scheduled Matters/Public Hearin s b. Temporary Use Permit 15-TUP-20; Temporary Occupancy of a Travel Trailer located at 1341 E. 8th Street. Actions: Receive the Staff Report and Take Testimony Options: • Approve Temporary Use Permit No. 15-TUP-20 as presented, subject to the proposed conditions that the temporary use permit will not be valid until they have been issued building permit for the house and shall expire after 1 year from the issuance of the permit. • Modify and Approve Temporary Use Permit No. 15-TUP-20, subject to modified conditions; or, • Continue Temporary Use Permit No. 15-TUP-20; or, • Deny Temporary Use Permit No. 16-TUP-20 Staff report was given by Rebecca Deming, Director of Planning Open Public Hearing at 6:06 p.m. No Speakers Closed Public Hearing 6:07 p.m. Motion by Wirick, Seconded by St. Martin to approve Temporary Use Permit 15-TUP-20 subject to the conditions that the temporary use permit will not be valid until they have been issued building permit for the house and shall expire after 1 year from the issuance of the permit. With the added condition that all utilities installed to the trailer shall be abandoned and removed prior to final occupancy of the house. Plot Plan No. 15-PP-01 for a proposed 3,474 square foot office/storage building with 7 parking spaces located on a .21 acre lot at 263 W. 4th Street. ACTIONS: Receive Staff Report and Take Testimony; OPTIONS: • Approve Plot Plan No. 15-PP-01, subject to the proposed conditions of approval with the findings; or, • Modify and Approve Plot Plan No. 15-PP-01; or subject to modified conditions of approval with the findings. • Continue Plot Plan No. 15-PP-01; or, • Deny Plot Plan No. 15-PP-01. Receive Staff Report 2. Take Public Comments (Public Hearing Open) 3. Continue Revocation of Administrative Plot Plan No. 07-APP-81 to December 8, 2015 Planning Commission Meeting. Summary: • Continuation due to outstanding criminal case • Located at 578 Chestnut Avenue • Originally Approved in 2007 (07-APP-81) • Approved for Tire Shop • Request to revoke Land Use Approval Background and Analysis: This was originally continued from the November 25, 2014 meeting at the request of the applicant's attorney. Due to the recommendation of the City Attorney, Planning Commission action would be to continue this item to the December 8, 2015 Planning Commission Meeting. Menos Tire, Administrative Plot Plan 07-APP-81, was approved for a tire shop located at 578 Chestnut Avenue. This application being presented to the Planning Commission is part of the revocation process in order to revoke the Plot Plan approval and therefore revoke the permit to operate. The East Valley Street Enforcement Team (EVSET) in conjunction with the Beaumont Police department received information in September regarding possible drug sales at Menos Tire. The team performed surveillance and witnessed activity that was suspicious. Based on the information during surveillance the department received a search warrant for this location. During the service of the search warrant enough evidence was found to arrest Emmanuel Espinosa for the possession of Controlled substances for sale. Due to the fact that this location was approved only for tire shop and not sale of controlled substances, staff has initiated the revocation process for Planning Commission Approval. Attached to the report is the application, search warrant, and arrest report associated with the business.
