INITIATION: The regular meeting of the City Council of the City of Temple City was called to order by Mayor Tyrell who led the 2. Pledge of Allegiance to the Flag. 3. INVOCATION: Rabbi Angel of Temple Beth David, 9677 Longden Ave. Temple City, gave the invocation. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford, City Manager Woollett 5. APPROVAL OF MINUTES: Under item 11, Councilman Merritt corrected the minutes to read "Councilman Fitzjohn moved to close the Public Hearing, Council- man Merritt seconded ". Under item 6 the date of the Public Hearing was corrected to August 13, 1962. Also under item 16 the dates of the budget hearings included June 5, 1962, which was deleted in the minutes due to election day, but as the Coun- cil decided to hold the hearing as per original plan, this date should be included. Councilman Merritt moved to approve the minutes of May 28, 1962, as corrected, Councilman Nunamaker se- conded, and carried. ORDINANCE NO. 62 -77: 2nd reading. RESOLUTION NO. 62- 212 -Re. Zone Variance, Olivia F. Price. City Attorney Shatford read title to Resolution No. 62 -212, RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANT- ING A ZONE VARIANCE TO OLIVIA F. PRICE TO CONSTRUCT A SECOND BUILDING ON APPLICANT'S LOT HAVING LESS THAN THE REQUIRED SQUARE FOOTAGE AT 5036 NORTH SULTANA AVE., TEMPLE CITY, SUBJECT TO CER- TAIN CONDITIONS, Councilman Nunamaker moved to adopt Resolution No. 62 -212, Councilman Fitzjohn seconded and carried. 291 Council Minutes, June 11, 1962, page 2 9. JR. CHAMBER OF COMMERCE: Mr. Bill Green of the Jr. Chamber of Commerce spoke requesting, City funds to construct "Welcome to Temple City Signs ". Follow - ing discussion the Council recommended the Junior Chamber con- tact the various civic croups regarding financing, and also to try and secure more reasonable and accurate figures of cost of construction. City Manager Woollett advised at the present time there were no funds allocated in the proposed budget from which this could be funded. Councilman Merritt moved to receive and file, Councilman Fitzjohn seconded .. and carried. 10. TEMPLE CITY Y'S MENS CLUB: RE- FIREWORKS PERMIT: City Manager Woollett advised-that in compliance with the urgency ordinance this Club has submitted a request to sell fireworks. The reason for failure to do so by May 1 was due to a change of officers in mid - April. Councilman Fitzjohn moved to grant, Coun' cilman Merritt seconded, and carried. At this time City Manager Woollett announced the arrival of a baby girl, Sara Helen, on Friday evening, June t$, weighing 41g4,- 8 lbs. 9 oz., and both mother and babe are fine. 12. RESOLUTION NO. 62 -210: Warrants & Demands Following discussion Councilman Fitzjohn moved to adopt Resolu- tion No. 62 -210, Warrants and Demands Nos. 1538 through 1579, in the sum of $7819.85, Councilman Nunamaker seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 13. PLANNING COMMISSION RECOMMENDATIONS: 1. Zone Change Case No. 62 -34, 6258, 6252, 6246 Rosemead Blvd. Martin T. Heydel, recommend change from R -1 to C -2. Mr. Ken Topping, Planning Advisor, presented the recommendation of the Planning Commission and recommended the City Council set- a Public Hearing. Councilman Dickason moved that a Public Hear- ing be set for June 25, 1962, at 8 P. M., Councilman Nunamaker seconded, and carried. 14. TRAFFIC COMMISSION RECOMMENDATIONS: 1. Recommend a crosswalk east line of Nadine at Daines Dr. Following discussion Councilman Nunamaker moved to approve Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Nunamaker, Tyrell NOES: Councilmen- Merritt ABSENT: Councilmen -None 2. Recommend changes red and green curb markings on Temple Cit': Blvd. per Envall report. This involves 5926 Temple City Blvd. which will add 6' to existing stll to the north and 2' to stall to the south, & leave one 23' stall at existing red curb markings. Also west side of T.C.Blvd. commencing with extended stall mark- ing 93' south of south curb line of first alley south of Las .Tunas Dr., with another stall marking 117' south and one 141' south, which will rescind existing red curb from a point 91' south to a point 141 ft. south of said south curb line and add two parking stalls. Also east side of T.C. Blvd. south of south curb line of Las Tunas Dr., rescinding red curb markings presently from point 95' south of south curb line of first alley south of Las Tunas Dr. to a point 142' south to add one 20' stall and increase existing stall to a 22' stall and to place a 25' white "Mail Box Use Only" zone from point 95' south of south curb line of alley to a point 120' south of said south curb line. Councilman Mer- ritt moved to accept the recommendation, Councilman Nuna- maker seconded and carried. 3. ENFORCEMENT OF TRUCK ROUTES: The recommendation is to re -word the truck route ordinance so that the signs and the ordinance will conform and the 292 Council Minutes, June 11, 1962, page 3 4. Recommend holding two meetings per month 1st & 4th Wednesday Councilman Dickason moved to approve, Councilman Fitzjohn seconded, and carried. 11. PUBLIC HEARING: 8:00 P. M. ZONE CHANGE REQUEST FROM R -1 to R -3 5828 N. Rowland Ave., Gladys Herrington & Marilyne R. Dickerson Mr. Topping, Planning Consultant, presented the request which the Planning Commission recommend to be granted. Councilman Dickason moved to open the Public Hearing, Councilman Nunamaker seconded, and carried. The Mayor asked if anyone wished to speak in favor of the request. Mr. Norman Peters, 6233 Kauffman, representing the property owners spoke in favor of the request. The Mayor then asked if anyone wished to speak in opposition. Noone came forward. Councilman Fitzjohn moved to close the Pub- lic Hearing, Councilman Merritt seconded, and carried. City Manager Woollett read a letter of opposition received from John E. gilaski, 9917 E. A)rkman. Following discussion Councilman Merritt moved to grant the request, Councilman Nunamaker second- ed, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None Councilman Fitzjohn moved to instruct the City Attorney to draw an ordinance in conformance with the Planning Commission Ordi- nance granting this request, Councilman Merritt seconded, and carried. 16. COMMUNICATIONS: City Manager Woollett read a letter from the Temple City Lions Club requesting permission for banners across Las Tunas Dr. advertising their fireworks stand. Following discussion Council- man Merritt moved to deny the request, Councilman Fitzjohn sech onded and carried. Councilman Merritt moved that all service, non - charitable and religious organizations who have been granted permits to sell fireworks may join in a single banner naming all the organizations granted permits urging the purchase of fire- works in Temple City. Councilman Nunamaker seconded, and carr- ied. City Manager Woollett also presented letters from the Boundary Commission, Los Angeles County, Re- Annex. 283, 285, 286, 287, all to the City of El Monte. Councilman Dickason moved to re- ceive and file, Councilman Nunamaker seconded, and carried. 17. RESOLUTION NO. 62 -211: Annexation 4 -A, ':,Nest Temple City, Uninhab iced. City Manager Woollett stated the property involved is from the center line of Reno Ave. westerly to Muscatel, and from the north side of the commercial lots to the south side on Las Tunas Dr. Owners of 85% of the property have requested annexa- tion to the City of Temple City including the new Bank of Ameri- ca. City Attorney Shatford advised it was required by law to rive notice, and read title of Resolution No. 62 -211 so doing, RESOLUTION GIVING NOTfiCE OF PROPOSED ANNEXATION TO CITY OF TEMPLI CITY OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "ANNEXATION NO. 4 -A, WEST TEMPLE CITY, UNINHABITED ", AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO. Coun- cilman Fitzjohn moved to adopt Resolution No. 62 -211, Councilman Merritt seconded, roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 20. TIME RESERVED FOR THOSE I N THE AUDIENCE WHO ASH SH TO SPEAK: Gus Stinstrom, Pacific Telephone Co., informed the Council that the walk -up telephones installed in the City are now in service. The one at Las Tunas & Rosemead was not installed as the State would not grant permission to use the electricity. This is the only City in southern California with this new type of installation. 293 Council Minutes, June 1$, 1962, page 4 B. L. Meek, 6004 Rosemead Blvd., spoke requesting the Council to consider in their budget the installation of sidewalks ex- pecially on Temple City Blvd. around the school, as well as other school areas. He felt it important that they consider in particular the area from Camino Real to Lemon on Temple City Blvd. The City Attorney advised that is on school property and the school is planning to do something about it but the City can check it out, also that the City can legally expend money for this purpose and can use gas tax money. Another item Mr. Meek was concerned about was in regard to truck routes. He advised Richfield Oil trucks were going north and then east and west on Woodruff. The City Manager will have the Sheriff's Dept. check this out. 15. PUBLIC HEARING: 8:30 P. M. CURB & GUTTER 5346 T.C.BIvd. & 9602 OLIVE ST. City Manager Woollett stated this Hearing was to discusswhether owners of the above properties will be required to place curb and gutter to complete their blocks, and that the property own- ers had been notified of the Hearing by certified mail. Council- man Fitzjohn moved to open the Public Hearing, Councilman Nuna- maker seconded, and carried. The Mayor asked if anyone wished to speak in favor of the requirement, and no one wished to speak. Noone came forward to speak in opposition. Councilman Nunamaker moved to close the Public Hearing, Councilman Fitz- John seconded, and carried. City Manager Woollett asked the Council if finishing the block we would assist by giving them the 504 a lineal foot to do so. In a case like this we find the remainder of the property owners on the block have either put curb and gutter in place or signed petitions to do so. These two mentioned would not go along with the remainder of the property owners making them ineligible for the contribution of 504. The City Attorney advised the policy can be changed so everyone gets the contribution or only those that sign up voluntarily when the whole block is completed Following dis- cussion Councilman Dickason made a motion notto include them in the 504 contribution, and that this project be found in the public interest, and the Supt. of Public Works be directed to cause the work to be done, Councilman Nunamaker seconded, with a roll call vote as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None Councilman Dickason moved the City Manager draw a recommendation to clarify the policy on the 504 contribution, Councilman Fitz- john seconded, and carried. 21. MATTERS FROM CITY OFFICIALS: Councilman Merritt requested more traffic control on Baldwin Ave. in the afternoons in connection with the empty buses re- turning to the station on Hoyt Ave., in El Monte. Councilman Nunamaker advised he had received several complaints regarding the loud playing of records on Temple City Blvd. just north of Las Tunas Dr. Following discussion Councilman Merritt recommended the City Attorney ask them to cut down the sound. Councilman Dickason asked regarding the monthly report from the City Treas. Following discussion the City Attorney advised that the City Treasurer could approve the financial statement submitted to the Council. Mayor Tyrell suggested a review of the Commissions with the idea of a revolving Chairman as at present the Chairmen have been retained for a long period of time. Councilman Merritt moved that the Council recommend that each of the Commissions of the City make a reorganization each year, Councilman Fitz- john seconded. Councilman Dickason felt the Council should not interfere in the Commissions and let them manage their own af- fairs. PUBLIC HEARING: 9:00 P. M. CURB & GUTTER NORTH & SOUTH SIDE OF HOWLAND ,WE,, 9900 BLOCK City Manager Woollett presented the petition for the north side of Howland Ave. in the 9900.block between Agnes and Baldwin with a total lineal footage of 686 ft. with petition representing 516 ft. or 75.21 %. The petition for the south side of the same block represented 560 ft. of a total lineal .footage of 686 Ft. c or 75.21 %. Councilman Fitzjohn moved to open the Public Hearing Councilman Merritt seconded and carried. The Mayor asked if any one wished to speak in favor of the petitions. John Drew, 9908 Howland, Leonard Filloon, 9903 Howland, W. T. Reynolds, 9942 Howland, R. J. Stubbs, 9948 Howland, all spoke in favor of the improvement. Mayor Tyrell asked if anyone wished to speak in opposition. Harry Glassbrook, 5247 N. Baldwin, who lives at the corner of Baldwin & Howland, spoke in opposition advising he was not op- posed to curb and gutter but to the manner in which the project was handled. Councilman Fitzjohn moved to close the Public Hearing, Councilman Merritt seconded, and carried. Councilman Dickason moved to approve and find the project in public inter- est and direct the Supt. of Public Works to cause the work to be done, Councilman Nunamaker seconded, roll call vote as fol- lows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 19. POUND SERVICES: Mayor Tyrell recognized Paul Erskine, Atty. at Law, 317 W. Main St., Alhambra, who spoke representing the San Gabriel Valley Humane Society. Mrs. Joan Coleman who operates the hound also spoke for the S.G.Valley Humane Society. Mr. Marvin Throndsen County Poundmaster spoke representing the Los Angeles County Pound. The following people wrote in favor of the S. G. Valleys Humane Society: Mrs. E. E. Kipp -5338 N. Camellia, Mrs. Jas. Renalt. -4935 N. Cloverly, Mrs. R. J. North -no address, Mrs. R. D. Davenport -5552 N. Pal Mal. The So. Calif. Veterinarian Medi- cal Assn. wrote recommending the Los Angeles County Pound. Mayor Tyrell read in full a letter from two local veterinarians; Dr. Dar Jobeand Dr. Leonard Minsky, listing various reasons why' they recommend continuing the County Pound Services. Mr. Me- lone, 6029 N. Rowland, and Dr.Geo. Wilson, Veterinarian of So. Pasadena, Dave McMullen -4901 Agnes Ave., and B. L. Meek, 6004 Rosemead Blvd., John Drew -9908 Howland, Hazel Brouhard -5116 Pal Mal, Dorothy Jensen -6058 Rowland Ave., all spoke favoring the San Gabriel Valley Humane Society. Dr. Jobe and Dr. Minsky both being present spoke strongly in favor of the County Pound Services. Councilman Fitzjohn moved to close the Public Hearing Councilman Merritt seconded and carried. Councilman Fitzjohn stated he had studied this the past three weeks and finds no reason to say anything against the County Pound, but felt there were three reasons beneficial to entering into an agreement with the Humane Society, i. e., 1. it is closely located to Temple City, 2. in the agreement they will be patroling the City for two hours each day and if they do not live up to it the contract can be broken, 3. he was in favor of using sodium oentathol for injured or sick animals on the spot instead of waiting for the pound to pick up and take to a decompression chamber, and for these reasons believed it would be beneficial to the community. Councilman Merritt felt by using Humane Society services resi- dents would pay a. license fee and a fee for pick -up of animals, whereas the County pick -up without charge, and he would be in favor of staying as we are. Councilman Nunamaker felt if the City did change that they should furnish reports to the City and also asked about the finances of the Society.. Attorney 295 Council Minutes, June 11, 1962, page 6 Erskine advised they were building a new office building in San Gabriel, had invested in real property in Rosemead with idea of possibly expanding in the future. This is a non - profit or- ganization and money made is held for improvement and develop- ment. Councilman Dickason felt the City should be represented on the Board of Directors if an agreement is entered into. Atty. Er- skine informed the Council there was no reason the City could not have a member -by going the proper channels of membership, nomination and election to the Board of Directors. He also advised Mrs. Coleman said they could give a report every three months as to animals picked up, license fees, etc. Councilman Nunamaker made a motion that we have the City Mana- ger and City Attorney negotiate a contract with the San Gabriel Valley Humane Society and have it for the Council by the 25th day of June, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen- Dickason, Fitzjohn, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett read a letter from Mr. Dan P i nzow of the Optimist Club requesting permission for a fireworks stand for the Club, the 1-eason for the late application being they did not until now have a location. Following discussion Councilman Merritt moved that due to the lateness of the date that the request be denietd, Councilman Fitzjohn seconded, and carried. City Manager Woollett requested the Council to set for Public Hearing 10206 01iVe St. for curb and gutter. Councilman Nuna- maker moved to set a Public Hearing to be held June 25, 1962, at 8:30 P. M., Councilman Fitzjohn seconded, and carried. City Manager Woollett also requested Public Hearings be set for curb and gutter at 5325 and 5327 Halifax Ave. Councilman Fitzjohn moved to set the Public Hearing for 8:15 P. M. on June 25, 1962, Councilman Merritt seconded, and carried. The City Manager requested the City Council to authorize him to have the Master Plan date run through data processing and that the sum of $1500.00 was budgeted for this. Councilman Dickason so moved, Councilman Fitzjohn seconded, roll call vote as follows: AYES: Councilmen-Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett advised there were various organizations in the City who conduct classes on the public streets such as drum majorettes, etc., which sometimes are in conflict with traffic and also annoy adjacent property owners, and would like to have an indication from the Council if when using the streets for this purpose it would be good to determine the feeling of the property owners as to what we should do about this. Unless they block traffic for a long time we cannot prevent them from using the streets. Following discussion Councilman Merritt . moved that the parties involved be contacted and they be request 'ed to use the street east of Live Oak Park between Bogue and Daines for their activities or other area than now used, Coun- cilman Dickason seconded, and carried. Councilman Nunamaker asked regarding outside lights over garages and at apartments, and was advised the planning advisor will re- commend an ordinance to the Planning Commission and then to the Council. Mayor Tyrell read a request from the California Society of the Sons of the American Revolution requesting a proclamation urg- ing the flying of the flag on the Fourth of July, and also the ringing of church bells for five minutes from twelve to twelve- 296 Council Minutes, June $/, 1962, page 7 five, ( 5 minutes) on that day. Councilman Fitzjohn so moved, Councilman Merritt seconded, carried, and so proclaimed by the Mayor. Councilman Fitzjohn moved to adjourn until 7:30 P.
