The regular monthly meeting of the Tybee Island City Council was held
at City Hall at 7:30 p.m. on Wednesday, February 9, 1983, with Mayor Charles J.
Hosti presiding. Councilpersons present were: John C. Wylly, Jr., Jim Fabrikant,
Jeanne Hutton, Ki]ma McCutchen, Sebastian J. Orsini, and Jerome W. Bettencourt.
Mr. John Ranitz represented Mr. Tom Mahoney, City Attorney, who was out of town.
There were no visitors who wished to speak; the meeting was therefore
opened forubusiness legally presented.
Minutes of the meeting of January 12, 1983 were approved as written upon
motion of Councilperson Orsini, seconded by Councilperson Bettencourt and unanimously
passed.
Bills for the month of January, 1983 were approved as follows: Water
Department - $2,752.73, Sewer Department - $7,540.57, Police Department - $3,830.42,
Parking Meters - $21.88, Ceramics - $603.23, Recreation Various - $172.59, Fire
Department - $1,152.41, Public Works - $6,671.76, Sanitation - $1,832.61, General
Government - $1,505.13, Other Expenses - $18.00, and Capitol Outlay - $835.00. It
was noted that the back hoe has been repaired and is used by two departments: Public
Works and Water /Sewer. The capitol outlay expense was for repair of the roof of
the Ceramics Building.
Councilperson Wylly reported that bids are being solicited for the
auditing of the city's accounts for the fiscal year. He also reported that an
Erosion Control Task Force has been formed by Mayor Hosti. Serving on this task
force are two County Canmissioners: Chairman Bill Stephenson and Barnard Portman,
three local delegation members: Senator Tam Colman and Representatives Bobby Phillips
and Ronald Ginsberg, and two from Tybee: Mayor Hosti and himself. He stated that
Governor Harris has promised an additional $20,000.00 to complete the work along the
seawall in the 17th -18th Street area, and that Commissioner Tanner has promised $5,000.00

as well. With these funds, it is hoped that the work of stabilizing the south end
sea wall can be completed, and that the sidewalk and railings can be replaced before
the season begins. He added that he believes the wall would have gone during the
last storm if the riprap had not been in place.
Councilperson Hutton reported that too much rain has slowed the grading
of the dirt streets; otherwise the winter schedule is proceeding as planned.
Councilperson Fabrikant reported that $2,472.00 in court fines were
received in January, and that 66 cases were heard.
Councilperson Bettencourt reported that a new Saturday class has begun
in Ceramics, and that the city basketball league is well underway. He added that a
survey is being made of Memorial Park, and that monuments will be placed at all
corners to mark the boundary lines.
Councilperson McCutchen reported that a 40 -hour First Responder Course
will begin next Wednesday night at the Fire Station. She also reported that an ISO
Evaluation was begun today. She added that the volunteer firemen have been spending
a lot of time preparing for the ISO Evaluation which, hopefully, will lower the fire
rating for our city. She' also said that it is planned that a van be purchased and
equipped for the First Responder Unit. Mayor Hosti praised Chief Solomon and the
firemen for the work they have done on the ISO Report these past six months, adding
that this is being done so that everyone will benefit free savings on fire insurance.
Councilperson Orsini announced that the Water Department has been working
closely with the Fire Department on the ISO Study. He noted again that lines are
deteriorating and that several ruptures occurred in the past two weeks; most of them
seem to happen in late afternoon, which necessitates overtime for employees.
Under Communications, a letter was read from Lonice Barrett of Department
of Natural Resources, dated February 1, 1983 and stating that an additional $5,000.
will be forthcoming, after agreement forms are signed. A copy of this letter is
attached to, and becomes a part of, these minutes.

Next a letter fran City Attorney Mahoney to George B. Lewis of NFIP,
dated February 8, 1983, was read, asking that an explanation be given concerning
letters going out to Tybee citizens who have flood insurance. These letters are
asking for pictures and other documentation of insured properties. Mayor Hosti
added that he is personally concerned about the meaning of these letters, and that
he believes the city has shown good faith in trying to conform to FEMA's guidelines,
and that he will follow thismatter closely. A copy of this letter, and of two
other letters concerning flood control, are attached to, and became a part of, these
minutes.
A letter to Governor Harris from Mayor Hosti, dated January 27, 1983
was read. A copy is attached to, and becomes a part of, these minutes.
A letter to Senator Mack Mattingly, dated January 25, 1983, and asking
for help in securing permission to erect a parking fee booth on Highway 80, was read.
A letter fran Carl E. Puckett, Jr., of ISO, dated January 27, 1983, was
read. This letter announced his intention to visit to gather information to determine
a fire insurance classification for Tybee Island. Mr. Puckett is present today, and
has began his investigation.
A letter from Richard and Mary Grosse, owners of the Sugar Shack was
read. This letter commends actions of the fire and police departments in answering
an emergency call. A copy is being sent to both fire and police departmeits, with
appreciation of the Mayor and Council for the excellent job they're doing.
A letter fram Lighthouse Point Associates, dated January 24, 1983,
including a donation of $1500.00 to be used for the betterment of Jaycee Park, was
read. The donation was accepted with thanks from Mayor Hosti, and Councilperson
Bettencourt, chairman of the Recreation Committee.
A letter from Fire Chief John P. Solomon, dated February 8, 1983, was
read. The Chief thanked the City Council for its support in preparing for the ISO
evaluation. Mayor Hosti complimented the fire department and other city employees
for the work they did in preparation, and expressed hopes that fire insurance rates

will soon be lowered as a result of this extra effort.
A Resolution declaring the week of February 6th through 12th as Youth
Safety Week was signed by Mayor Hosti and presented to Mr. Orville Rosen, Lt. Governor
of the State Society in the absence of Mr. Ernest Hosti, President of the Tybee
Optimists Club. Mr. Rosen accepted for Mr. Hosti, and thanked the Mayor and Council
on behalf of the Tybee Optimists. A copy of this Resolution is attached to, and
becomes a part of these minutes.
A Resolution endorsing a movement to stop drugs at the source was read
by Mr. Ranitz. Mayor Hosti added his personal appeal to the citizens to cooperate
with this attempt to stop drug traffic. A copy of the Resolution is attached to,
and becomes a part of, these minutes.
First Reading of an ordinance to amend the City Charter was read by Mr.
Ranitz. The ordinance brings our city charter into conformity with the new Georgia
Code, and refers mainly to traffic laws. It was accepted on First Reading with no
dissenting vote, and will be read again in March.
Councilperson Bettencourt explained that the Jaycees need an updated lease
for property they are using as a clubhouse, known as the old Fire Station. After
discussion it was unanimously agreed to authorize the Mayor to execute a lease on
behalf of the city; terms will be $1.00 per year, and the lease must be renewed
annually.
Councilperson Fabrikant stated that an application for a beer & wine
license for a business to be known as Pooh's Food & Spirits, located at 1311 Butler
Avenue, and owned by Henry M. Buckley, Jr. has been investigated by the Police
Department; he then moved the license be granted, stating that the business will be
a nice little restaurant, and the alcoholic beverages would be served with food on
the premises. Councilperson Bettencourt seconded. During discussion Councilperson
Hutton stated that she does not believe granting of licenses improves the quality
of the restaurants here; she reccamends waiting until a business is well established
before granting such licenses. A vote was taken, with five in favor, none against.

Councilperson Hutton abstained.
Councilperson Wylly reported that a Downtown Development Authority has
been formed and that the following members will serve: Chairman - Jack McCusker,
Vice - chairman, Dean Nichols, Secretary -Treasurer - Robert Duffy, and members -at- large,
Mayor Charles J. Hosti, Paul Jackson, John Ludlow and Anthony P. Simon. He stated
that the Authority has sought certification from the Georgia Secretary of State, and
should soon be officially recognized.
Councilperson Wylly then introduced a petition for a temporary sales
office to be placed within the boundaries of the Tybee Beach Ocean Villas, at #1
Fifteenth Street for one year. He moved to allow the temporary structure, and
Councilperson Fabrikant seconded. The motion carried unanimously.
The meeting was then adjourned until the next regular or special called
meeting.

R E S O L U T I O N
WHEREAS, the week of February 6th through February 12th, 1983, has been
designated as Youth Safety Week by the Optimists in cooperation
with other state, local and national organizations; and
WHEREAS, the Tybee Island Optimist Club has undertaken to sponsor the
Youth Safety Week in Tybee Island by programs and events at our
local schools, in cooperation with our local school officials and
law enforcement officials; and
WHEREAS, we, the Mayor and Council of the City of Tybee Island, have
traditionally endorsed this worthy effort on behalf of our youth;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council in open meeting
assembled, that we do hereby endorse the "YOUTH SAFETY WEEK" as
sponsored by the Tybee Island Optimist Club, and that we do hereby
declare the week of February 6th through February 12th, 1983 as
YOUTH SAFETY WEEK FOR THE CITY OF TYBEE ISLAND, CHATHAM COUNTY, GEORGIA.

The Year Of Stop Drugs At The Source
WHEREAS, Our school district has initiated the Stop Drugs at the Source Petition
and treaty campaigns to keep drugs away from children; and
WHEREAS, Law enforcement, religion, business, service, government, and media
{ leaders are urged to participate in the petition and treaty campaigns; and
WHEREAS, The President of the United States has signed the "Response to the People"
Executive Treaty which serves as evidence that the stop drugs at the source
petition will be answered; and
WHEREAS, The Governor has cosigned the "Response to the People" Executive Treaty; and
WHEREAS, The Chairman of the County Commission can cosign the "Response to the People"
Executive Treaty upon completion of the petition campaign; and
WHEREAS, I, your Mayor, will cosign the "Response to the People" Executive Treaty
upon completion of the campaign; and
WHEREAS, Every city, county and state in our great nation can participate in the
Stop Drugs at the Source petition and Treaty Campaigns in 1983

Dear Mayor Hosti:
We have received your itemized statement of expenditures
for emergency stabilization of Tybee Island's southend seawall
and your accounting of the use of the $20,000 Governor's Emergency
Fund grant you received in July, 1982. Your documentation looks
more than adequate, and Commissioner Tanner has requested that I
immediately transmit to you the necessary agreement forms whereby
the additional $5,000 can be released to the City of Tybee Island.
The additional $5,000 which you discussed with Commissioner
Tanner will be from our Recreation Emergency Fund. These funds
are appropriated to the Department of Natural Resources by the
General Assembly, and we have exhausted all of our Recreation
Emergency Funds for the remainder of this fiscal year. We hope
to have limited additional funds after July 1, 1983, and as
Commissioner Tanner informed you when he met with you last week,
he will be willing to consider a request for another small grant
at that time. Candidly, I do not expect that we would be able
to provide the full $20,000 to $25,000 as you mentioned in your
letter. Most of our grants to cities and counties are in the
$5,000 to $10,000 range.
Within a few days you should be receiving the necessary
paperwork on the $5,000 grant. Upon receipt of your signed
copies, we will immediately process a check for $5,000 and
arrange to have it transmitted to the City of Tybee Island.

Dear Mr. Mahoney:
This is in response to your letter of January 6, 1983, requesting
information concerning a request for a variance in Tybee Island.
The program regulations provide variance criteria to guide the
community in providing administrative relief from the minimum
flood plain management standards in cases where they impose
exceptional unnecessary hardship for a particular applicant.
Perhaps some confusion has been generated by the terms "applicant"
or "individual applicant." The NFIP variance criteria are
based on the general rule of law that variances are not personal
in nature; they relate to the property. Granting a variance from
the flood plain management standards for personal reasons would
rarely be an appropriate action. The reason for this is that such
an action would not be consistent with the need for public safety.
Once the character of the owner changes (i.e. the property is
sold, leased, etc.), the reason for the variance no longer exists
but the structure remains. Future owner /occupants are exposed to
the nonconforming nature of the property and whatever hazards
are associated with it. This exposure to flood risk is unnecessary
except for the personal condition of the previous owner. Also, a
variance after - the -fact is rarely ever appropriate.

sheet which we provide to communities.

Dear Community Official:
The Federal Emergency Management Agency (FEMA) is undertaking a review of the
minimum flood plain management standards for community participation in the
National Flood Insurance Program (NFIP). A copy of the Advanced Notice of
Proposed Rulemaking (ANPR) to initiate this review is enclosed for your .
consideration and comments.
In the years since 1976, when the minimum NFIP standards last underwent a major
review and revision, FEMA, the States, and local flood -prone communities have
gained substantial experience in implementing and administering flood plain
management programs. The purpose of issuing an ANPR is to solicit comments fran
organizations and individuals based on their experience.
The ANPR does not address any insurance or engineering aspects of the NFIP.
This review is only of the minimum flood plain management standards for
community participation. FEMA's objective in setting forth these participation
criteria is to ensure that at least minimal measures to reduce flood losses are
being taken by the community so that the insurance risk, and premiums, can be
kept within reasonable limits and that the costs of disaster relief can be
reduced.
