ORDINANCE NO. 257-05-21
AN ORDINANCE OF THE CITY OF IONA, IDAHO;
AMENDING SECTION 9-4-23 OF THE IONA CITY CODE;
SPECIFYING PENAL TIES FOR VIOLATIONS OF PARKING
REGULATIONS; PROVIDING METHODOLOGY;
PRESERVING PRIOR ORDINANCES IN EACH INSTANCE;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Amendment of Section 9-4-23 of the Iona City Code. Section 9-4-23 of
the Iona City Code is amended as follows :
9-4-23: PENALTIES.
(A) Any person who violates any parking regulation herein, is guilty of an infraction and shall
be subject to penalties as follows:

If a person violates Section 9-4-19 (Handicapped Parking), then:

tihe violator shall have 21 days from the date the notice of violation is
issued to either (i) admits the violation and pays the-a $75.00 penalty or_(fil
delivers a written denial thereof to the City Clerk~ v,1ithin twenty one (21)
days of the date the notice is issued, the penalty, upon conviction or
admission , shall be as follows:
If the violator shall provide a written denial within 21 days as described
above, and is thereafter convicted of the violation, the violator shall pay a
$75.00 penalty to the City Clerk (or the City Clerk 's agent) and any costs
allowed by lawViolation of any parking regulation set forth in this chapter,
except section 9 4 19 (Handicap Parking), shall be $20 .00 .
If the violator does not complete either option (i) or option (ii) within 21
days as described in subsection (a) above, the violator shall pay a $150.00
penalty upon subsequent admission, or if convicted of the violation, the
violator shall pay a $150 .00 penalty and any costs allowed by law.Violation
of section 9 4 19 (Handicap Parking), shall be $50.00
If a person violates any parking regulation in this Chapter other than Section
9-14-19, then:and he or she fails to either deliver a '•'<'Fitten denial to the City Clerk
or to admit the violation and pay the penalty as provided in the previous subsection
(B)
1.vithin t\venty one (21) days of the date the notice is issued , the penalty, upon
conviction or admission, shall be as follov.,s:

The violator shall have 21 days from the date the notice of violation is
issued to either (i) admit the violation and pay a $50.00 penalty or (ii)
deliver a written denial thereof to the City Clerk.
If the violator shall prov ide a written denial within 21 days as described
above, and is thereafter conv icted of the v iolation, the violator shall pay a
$50.00 penalty to the City Clerk (or the City C lerk's agent) and any costs
allowed by law.
Violation of any parking regulation set forth in this chapter, eJrnept section 9 4 19
(Handicap Parking), shall be $40.00.
(c)
(a)
If the v iolator does not complete either option (i) or option (ii) within 21
days as described in subsection (a) above, the violator shall pay a $100.00
penalty upon subsequent admission, or if convicted of the violation, the
v iolator shall pay a $100.00 penalty and any costs allowed by law.
Violation of section 9 4 19 (Handicap Parking), shall be $100.00
EG1ililJn the event any person violates any provision of this chapter within sixty ( 60) days of any
prior violation of this chapter, the penalty therefor shall be double the amounts set forth
above .
Section 2. Methodology. Text that is underlined in the preceding sections means new
text added to the former Ordinance or City Code Section, and text that is stricken through means
text that is being deleted from the former Ordinance or Code Section. Text that is moved from
one location in the former Ordinance or Code Section to another location is similarly shown as
underlined text, being stricken through in its prior position.
Section 3. Preservation of Prior Ordinance. The sections of the Iona City Code
repealed and/or amended by this Ordinance shall be preserved to the extent necessary to allow the
arrest, prosecution, punishment, and indebtedness of any person who violates such provisions
prior to the effective date hereof.
Section 4. Severability. The sections and subsections of this Ordinance are severable.
The invalidity of any section or subsection shall not affect the validity of the remaining sections or
subsections.
Section 5. Effective Date. This Ordinance shall become effecti ve upon its passage ,
execution and publication in the manner provided by law.
