HomeMy Public PortalAboutOrdinance 1038ORDINANCE NO. 1 038 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA AMENDING SECTION 9.30.020 OF THE BEAUMONT MUNICIPAL CODE RE: "DANGEROUS WEAPONS" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, RIVERSIDE COUNTY, STATE OF CALIFORNIA AS FOLLOWS: Section 1: Section 9.30.020 of Chapter 9.30 of the Beaumont Municipal Code, entitled "Dangerous Weapons" is hereby amended by adding subsection "F" to read as follows: "F. Property owners possessing a permit issued by the Chief of Police for the purpose of varmint, bird and other pest control for which no other reasonable means are available, upon application therefor and the payment of a fee. Such permit shall apply for a specified period of time to a specific parcel or parcels of land, as designated by the Chief of Police, and he shall be authorized to impose such other restrictions and conditions as may be necessary to protect the public health, safety and general welfare. No permittee shall have a vested right to a permit, and the Chief may, in his sole discretion revoke the permit at any time. The permittee shall comply with all applicable state and federal regulations, and failure to do so shall result in immediate revocation of the permit." Section 2: This Ordinance shall take effect as provided by law. It has been brought to staff's attention that this prohibition limits private property owners from using firearms as a means to control varmints, birds, and other pests that cause damage to their property. This ordinance will provide for a process that will allow the private property owner to seek a permit from the Office of the Chief of Police to allow for the use of firearms subject to any restrictions and/ or conditions that the Chief of Police deems necessary to protect the public health, safety, and general welfare. Fiscal Impact: A fee will be imposed to cover staff's time in reviewing the application and inspecting the property of the applicant, as well as monitoring the permit upon issuance. Recommendation: Staff recommends that the City Council hold a Public Hearing and approve the first reading of an Ordinance amending Chapter 9.30.020 of the Beaumont Municipal Code. AGENDA ITEM 11.6 To: Mayor and City Council From: Frank Coe, Chief of Police Approval: Alan Kapanicas, City Manager OA( Agenda Date: October 1, 2013 Subject: An Ordinance Amending Section 9.30.020 RE: Dangerous Weapons - (Second Reading) Background/ Summary: The City Council approved the first reading of this ordinance amending Section 9.30.020 at the regular meeting on September 3, 2013. Staff determined at that time that we had failed to address the issue of fees and insurance for the issuance of permits. We have amended the ordinance to reflect the setting of fees by Resolution of the City Council and the requirement for insurance by anyone seeking a permit. Fiscal Impact: A fee will be imposed to cover staff's time in reviewing the application and inspecting the property of the applicant, as well as monitoring the permit upon issuance. Recommendation: Staff recommends that the City Council hold a Public Hearing and approve the second reading of an Ordinance amending Chapter 9.30.020 of the Beaumont Municipal Code as amended.
