HomeMy Public PortalAboutORD 263-05-21_Annexation Harrigfeld_05192021ORDINANCE NO. 263-05-21 (Harrigfeld Property) AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF IONA, IDAHO; DESCRIBING THESE LANDS; ESTABLISHING THE INITIAL ZONING FOR SUCH LANDS; REQUIRING THE FILING OF THE ORDINANCE AND AMENDED CITY MAP AND AMENDED LEGAL DESCRIPTION OF THE CITY WITH THE APPROPRIATE COUNTY AND STATE AUTHORITIES; AND ESTABLISHING EFFECTIVE DA TE. WHEREAS, the land described in Section 1, below (referred to herein as the "Land"), is contiguous and adjacent to the City oflona and is subject to annexation to the City oflona pursuant to the provisions of Section 50-222, Idaho Code, as amended; and WHEREAS, it appears to the Mayor and City Council that this Land should be annexed to and become a part of the City; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Annexation. The Land, described below, is hereby annexed to the City of Iona, is described on the Warranty Deed recorded in Bonneville County, Idaho as Instrument No. 1447825, being specifically described as follows: PART OF THE SE¼ OF THE SW¼ OF SECTION 36, TOWNSHIP 3 NORTH, RANGE 38 EAST, BOISE MERIDIAN, IN BONNEVILLE COUNTY, IDAHO, AND MORE PARTICULARLY DESCRIBED AS: BEGINNING AT A POINT THAT IS WEST 10.20 FEET ALONG THE SECTION LINE FROM THE SOUTH ¼ CORNER OF SAID SECTION 36 AND RUNNING THENCE WEST 650.09 FEET ALONG THE SECTION LINE TO THE WEST LINE OF THE EAST ½ OF SAID SE¼ OF THE SW¼; THENCE N00°41 '50"E 1317.79 FEET ALONG SAID WEST LINE TO THE NORTH LINE OF SAID SE¼ OF THE SW¼; THENCE N89°59'2l"E 609.62 FEET ALONG SAID NORTH LINE; THENCE S01°05'00"E 1318.03 FEET TO THE POINT OF BEGINNING. CONTAINING APPROXIMATELY 19.75 ACRES. Filing. The City Clerk shall file a certified copy of this Ordinance with the Bonneville County Auditor, Treasurer, and Assessor and with the Idaho State Tax Commission within 10 days after the effective date hereof; and shall , within 30 days after such effective date , file an amended legal description and map of the City with the Bonneville County Recorder and Assessor and the Idaho State Tax Commission, all in accordance with Section 50-223 and 63-215 , Idaho Code. The City Clerk shall not order the Land to be surveyed. Section 3. Initial Zoning. The Land annexed by this Ordinance shall be and hereby are zoned as R-1 (Single Family Residential ) pursuant to the provisions of the Zoning Ordinance of the City of Iona. Section 4. Effective Date. This Ordinance shall be effective upon its passage, execution and publication in the manner provided by law.
