Chairman James West, Member Ray Hart, Member Gary Elliott and Member Bill Koester. ABSENT: Member Jason Cooper VISITORS: Devan Thompson, Kurt Roland and Brian Smaka. Chairman West welcomed everyone and led with the Pledge of Allegiance. Approval of Minutes: Chairman West entertained a motion. Member Elliott moved to approve the minutes for July 14th, 2021. Member Hart seconded the motion. All in favor, the motion carried. Items of Business: Amendment to Iona City Code 11-4-3, specifying terms for Conditional Uses in R-1 Zones. (Ord. 268-08-21) Member Elliott surmised that this pertains to his Conditional Use Permit hearing from the previous month, so he chose to abstain from voting, but participate in the discussion. Chairman West noted that this was triggered by the discussion around the Elliott property's Conditional Use Permit, but this has been discussed in the past by City Council. The Commission briefly discussed that there is going to be an impact from out of town investors purchasing properties to rent out both the upstairs and downstairs or a residence for profit. Member Hart clarified that this change would mean that in an R-1 zone if you wanted to rent out your basement, you as the owner would have to reside in the home. Chairman West noted that The City has been against duplexes, and that our City Code has made it difficult for them to be approved in the past. He stated that this makes The Code whole, because R-2 is the zoning for duplexes, but that in an R-1 zone to be considered R-1 the land owner must live on the property. Member Elliott questioned if this would prevent a home from being rented to a single family. Chairman West noted that it would not apply to single families renting; number 7 only applies when the renter is located in the basement of an existing structure. Member Elliott agreed that the breach comes when there are multi-family renters. Chairman West asked if The City already allows home occupation in R-1. Member Elliott clarified that we do, but they are required to get a Conditional Use Permit. Member Hart made a motion that we pass as written. Member Koester seconded the motion. Chairman West noted that there was a concern about the requirement in line 7 ( G) that basement occupancy has a separate water line from the main floor occupancy. Member Elliott noted that anytime they do any major upgrades to the water, The City requires that they update it to be meter ready. Member Koester noted that there is a necessity to have both lines because if one occupant didn't pay, The City's Public Works Director would be able to shut down only the one who didn't pay without affecting the other occupant. Chairman West stated that his issue is that if it was a temporary rental situation for the owner's family, or just to help someone temporarily, the owner would have to pay for another water hook up and install, upwards of ten thousand dollars. Member Elliott said that the renter should only be allowed to do that for 2-4 years. Member Koester asked how long is temporary? That should be specified. Member Elliott stated that they should be required to get a Conditional Use Permit yearly, so that after 3 years you'd need to pay for the addition of the water line. Member Koester asked how many basements in Iona are being rented out. No one had a specific answer. Member Hart recommended that line (9) should be added that shows that they could get a temporary Conditional Use Permit once a year, similar to the home occupation Conditional Use Permit. Chairman West makes a motion that we approve the ordinance 11-4-3 specifying terms for uses in R -1 zones as indicated in red, with the addition of either a line 9 or line 7 (H) that allows for a temporary use of the basement for a rental property to not exceed 3 years, that would not require the water service line to be separate as indicated in 7(G). And he added to his motion that they need to renew their Temporary Conditional Use Permit every year in that 3 year period. Member Koster seconded the motion. All are in favor; Motion Carried Final Plat Application & Annexation Agreement -Eagle Rock Engineering; Elim Estates; a Subdivision located on the North side of Iona Road, between 45th East and Olsen Avenue Chairman West invited a representative to the podium. He asked that they tell the commission what has changed from the Preliminary Plat. Kurt Rowland Eagle Rock, 1331 Fremont Ave. Idaho Falls, representing the developer of Elim Estates approached the podium. He noted that these are Half Acre lots. It's been recommended by the City Council and the City Attorney that they put a cul de sac at the intersection. The subdivision will be using City Services. They were asked to put in 3 fire hydrants, they will be spaced differently as per the information from Forsgren. They were asked to make the roads 28 ft. wide, with 14 feet of asphalt instead of 12. Member Elliott stated that in the last plan the Cul De Sac was not permanent. Kurt Rowland clarified that it is now permanent, and allows for all of the lots to be developed, even before the stub outs on either side are developed. He also noted that it was recommended that they have a 90 ft. diameter tum around, but they made it 120 ft. diameter to accommodate fire trucks and other emergency vehicles. Member Elliott talked about meeting with a stake president last Monday, he said they signed off on the sale of the lot behind the Church building adjacent to this lot. Devan Thompson, 246 Harter came to the podium and stated that Jace Howell who owns the property on the other side of the Church Building made an offer, and it was accepted. Part of the reason they accepted his offer was because he allowed it to be at The Church 's pace, and is open ended in nature. From what he understands they 're working on an easement on the "back side" from Progressive which is the Canal District. Member Elliott asked if he knows if it is going to be residential, personal, will there be a park? Dev an Thompson said he doesn 't currently know. Some talk has been about the McIntire ' s, and whether they should create the access through their property. Some talk has been about connecting through Howell's Property. The reality is that the stub may not be utilized. Chairman West noted that he is looking at it as if there is not going to be an access through the property behind The Church. Devan noted that he believes that Josh Williams will develop his property which is to the East. Devan Thompson stated that they have been approached about having commercial lots in the frontage. He said it was in passing and very conceptual, down the road, and not what they currently intend. It would require an additional hearing, Member Elliott asked if there would be anything that they know of in the near future being developed to the East or West of the current stub outs and Devan Thompson replied that he doesn't have any idea of anything. Chairman West asked if there were any other comments. Devan Thompson said that Zech noted to potentially change the location of the water line to get better pressure. Chairman West entertained a motion by Member Hart to recommend that they move forward on this Final Plat with the note that the fire hydrants need to be moved per engineer specs. Member Elliott seconded the motion. All are in favor; motion Carried Motion to adjourn the meeting by Chairman West.
