RESOLUTION NO. 23-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY,
STATE OF IDAHO, PROVIDING FOR FINDINGS AND PURPOSES; PROVIDING NOTICE
BE PUBLISHED FOR THE PURCHASE OF LIBRARY SHELVES FOR THE NEW LIBRARY
EXPANSION; PROVIDING FOR AUTHORIZATION OF THE MAYOR TO ENTER INTO,
ON BEHALF OF SAID MUNICIPALITY, A CONTRACT BETWEEN THE CITY OF McCALL
AND HIGHMARK CAPITAL, LLC dba OEC WORKS AN AUTHORIZED DEALER FOR
MONTEL SHELVING; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Idaho Code §67-2808(2) provides that the City Council of the City of McCall may
request a sole source expenditure if it declares that there is only one (1) vendor for the personal
property to be acquired based on the following circumstances ;(v) The purchase of public works
construction, services, or personal property for which it is determined there is no functional
equivalent; and viii) Where competitive solicitation is impractical, disadvantageous, or
unreasonable under the circumstances; and
WHEREAS, for the purpose of promoting the safety and general welfare of the City of McCall,
by providing shelving that allows the general public to safely engage in library resources and
allows staff to effectively organize and manage the physical assets of the City's resources; and
WHEREAS, City staff and OEC have conducted a complete review of available vendors of library
shelving systems that are structurally compatible with the existing library shelving units and
determined that only one supplier can meet the requirement that the new shelves are compatible
with the existing shelves thereby allowing the Library to avoid purchasing replacements for the
current shelves; and
WHEREAS, City staff recommends Highmark Capital, LLC dba OEC Works shelving be selected
as the sole source provider of new shelving for the McCall Library Department.
NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of
McCall, Valley County, Idaho, as follows:
SECTION 1: Findings
The McCall City Council finds as follows:
1. The City has need for the addition of new shelves in order to assist Library
Department staff in providing safe access to the general public at the McCall
Library.
2. Pursuant to Idaho Code 67-2808(2) there is only one (1) vendor for the library

shelving that is structurally compatible with the existing shelving that will be
relocated to the new library and the compatibility of the shelves with existing
shelves from the same manufacturer is the paramount consideration to avoid
unnecessary expense.
3. The Montel shelving available through OEC Works is best suited to meet the
needs of the City of McCall Library Department.
SECTION 2: Directing the City Clerk
The City Clerk shall cause a notice of sole source procurement to be published in the official
newspaper of the City.
SECTION 3: Entering of Contract
So long as there are no written challenges or objections to this determination of sole source
expenditure, the contract to procure the Montel shelving through OEC Works may be awarded
fourteen (14) days following publication of the notice of sole source procurement, but not before.
SECTION 4: Effective Date
This Resolution shall take effect and be in force from and after its passage and approval.
PASSED AND APPROVED by the Council and Mayor of the City of McCall this 28
day of December 2023.
